I don't doubt that I may have made a statement to the effect that iYs not likely that the City would extend Fox Street given the topographic issues. However, I have no recollection of suggesting that the history of problems with your house construction would have any impact on the City's future decisions on use of the public right of way. Last week I acknowledged recalling that you wanted some assurance in writing that the City was not going to suddenly take away your driveway and that it can stay where it is. In fact, the City granted you variances in 2003 knowing full well that you have two driveways and a parking area that rely on use of the public right-of-way. Most residential properties make use of some part of the public right-of-way for access. Your access within the right-of- way is no different than others, other than it is particularly distant from an improved traveled road, hence its existing reasonable configuration. I can tell you that the City currently has no plans and no intent to eliminate your driveway in the right-of-way. The City has no plans to extend Fox Street easterly from its terminus west of you, given the topographic challenges and the lack of a current need for such extension. I cannot, however, "promise"you that the City will never change the access to your property. There are probably circumstances under which such a change might be warranted; for instance, if the Rail Authority were to successfully deny access across their right-of-way. That does not appear to be the case. I've never had the authority to make a promise that binds the City to limit its use of the public right-of-way. From my perspective, I cannot make the City's position regarding your driveway any clearer. Consider this email as my response to your request for written confirmation of the City's intent. I am obviously disappointed about the gate issue, but as a reasonable person I will walk away from the project. It makes no sense to ruin the visual appearance and functionality of my property by placing the gate where you are recommending. We will have to continue to tolerate the unwelcome turnaround traffic we get regularly. I will accept the offer made to me by public works to install a private drive sign. In reference to your last paragraph, that information does not comply with what you originally promised me. And, when I was in your office last week you acknowledged you had not put in writing for me as you said you would 4/7/2008 , Page 2 of 3 approximately three years what you promised in relation to the driveway. You said last week, again, that you would put in writing what you promised which was this: the entrance and driveway up to and in front of my house would not change and that you would provide me with a letter to put in a file so that when I go to sell my home this would never be an issue--to date I have not received that letter, last week you promised it to me, once again. The last paragraph in your email contradicts the promise you made to me. In looking at your illustration you are actually indicating now that there may be an open road running past my house some day, which you promised me face to face would NEVER happen--you even acknowledged that based on all the neglect that was present in the home inspections by the city during the building and inspection process, I had nothing to worry about. FYI to date the city has never once maintained, plowed or had anything to do with that piece of asphalt-- It is not reasonable that the city would even consider to allow what you are posing as a possibility, to happen, nor would it be reasonable for me to sit back and allow that to happen based on the significant financial impact I absorbed to fix the issues that the city inspection department failed to recognize as it relates to my home --you as well as many other employees at the city are well aware of the history with my house, and the history speaks for itself. I have been more than fair, tolerant and reasonable over the past 5 or so years. Mike, we are both reasonable and fair people or at least I would like to think so. I compiled this from your survey, County piat drawings and our discussion last week to depict where you propose to place a gate system. I must advise you that after discussing the matter with the City Attorney, the City cannot allow the placement of a gate system at any location that would block the public's access to and across the various rights-of-way; i.e. a gate would not be allowed at location "A"where you propose it, and would not be allowed at"B"where we had suggested as a possibility last week. The City would not oppose a gate system within your property boundaries at locations "C" or"D", meeting the City's minimum standard of 5' setback into the property from your property line, and a horizontal opening not less than 14' wide with gates open. We understand that gates at locations "C" and/or"D" may not accomplish your goal. As an alternative, we strongly encourage you to consider placing a "private driveway— no outlet" sign at a location you and the City find mutually acceptable; I don't know whether the Railroad Authority or Hennepin County would allow such a sign on their respective right-of-ways. With respect to your request for verification that the driveway can remain in its current location, the City has no immediate plans to reconstruct the portion of Fox Street that abuts your home. The City will not deny you reasonable access to your property but the City can not guarantee that the paved portion of Fox Street will not be widened at some point in the future.
