Box 1490 Minneapulis Minnesota 55440 Re: 1300 Shoreline Drive - Robert Howard Residence Dear Mr. Prosser: This letter is to address building and zoning code issues related to the fire damage of the residence at 1300 Shoreline Drive in Orono. The property is located in the RR-1B Zoning District. This district requires lots to be a. minimum of 2 acres in size and not less than 200' in width. The required setbacks are as follows: Front Rear Side Street Side From Wetland 50' S0' 30' S0' 26' Mr. Howard's property has streets on 3 sides and a rear yard. Therefore, a 50' set back is required from all lot lines [see attached survey]. The property is approximately 19,346 square feet or .44 acres and is 129.95' wide. The existing house does not meet the front or side setback . The Orono Municipal Code allows buildings to be rebuilt if damaged by fire unless the damage to the structure is 75% or more of the market value as shown on the assessment records at the time of the damage, in which case the whole thereof shall be demolished and any construction there after shall be for a use in accordance with the provisions of the zoning chapter [Section 10.03, Subd 5 (D) enclosed]. Since the damage exceeds 75%, the City must require removal of the structure. Variances would also be required if the structure can not be placed to meet the required setbacks. The next deadline for variance applications is February 18, 1998. The application would go to the Monday, March 17, 1998 Planning Commission meeting and then if there are no problems to the April 13, 1998 City Council meeting. At your request the undersigned has investigated the referenced fire loss claim for the purpose of determining the foundation condition and its adequacy for use in the rebuilding of this home. Date of loss is unknown to me at this time. This is a one story wood frame home with a tuck under 3 car garage. I would estimate the age of the original structure at about 60 yrears. The home would appear to have been added to several times. In fact there is an excavated area in the southwest corner indicative of an in progress � addition. I would not hazard a guess at the age of the additions. Damage to the superstructure inlcuded virtually the whole house. Damage to the lower level was not as extensive,with areas to the north and east undamaged. In my judgment the foundation walls can be used in the reconstruction of this home. This � recommendation is made subject to the following: 1. Presumably there is an architectural plan indicating the nature of the in progress work that is proposed to the southwest comer of the home. Further that this plan was subject to review by the Building Official and a building permit issued. Absent the foregoing, it is a condition that a building permit be obtained. (The existing wall footing has been exposed during the excavation f�r:h� aw�itEon i^ an �:nacceplw�lp mar.ner, i.e. the ex�ava!�on hws bee!? m��+e 5elqw an� immediately to the edge of the existing footing, excavations below existing footings should not come closer than 2 units horizontal for every unit of cut below the existing footing.) 2. Vertical separations in the exterior foundation wall were noted on the north and west foundation walls. These separations and any other cracks found should be repaired. 3. At the northwest comer of the home is an addition built over a crawlspace. The top of the concrete footing in this area is visible on the exterior. It must be ascertained that this footing does extend the minimum distance (3'-6'� below grade for frost protection. 4. At such time as the debris is cleaned out another inspection should be made to determine if other corrective work needs to done. Alistate Insurance Inc. Even though building permits do not expire if work is ongoing, the exterior portion must be finished to protect the appearance of the neighborhood. Your project has been in progress for too long, and your property is slowly taking on the appearance of a war zone. Please work toward a general cleanup this spring. Specifically: 1. Get dirt and whatever off of the fence and back from the property line by April 25. We agreed to April 15 when we discussed this but let's extend that 10 days due to cold weather and the refreezing of the piles. 2. Yard grading must be completed and grass growing by the end of the summer. We understand there have been difficulties with this project, but we need to see some real progress soon.
