**NOTE CHANGE** Before scheduling an exterior insulation and/or drain tile inspection, a
foundation as-built survey must be submitted and approved by the City or a Stop Work order
will be issued.
Schedule a minimum of one hour for the framing inspection. /� �

Erosion control mechanisms must be installed and inspected by the City prior to any land
disturbing activities. The contractor must provide a minimum of a 24 hour notice prior to ,�
inspection.
Erosion control shall be installed and maintained throughout the entire project and must
remain until vegetation has been established.
A haul route shall be submitted to the City Engineer for approval and inspection prior to
commencement of hauling from the site.The property owner shall be responsible for cleaning
and repair of roadways for any adverse impacts.

Prior to the issuance of a Certificate of Occupancy an as-built survey and hardcover calculations
must be submitted and approved.
In the event of winter or other extended unfavorable weather conditions (which prevent the
completion of the exterior improvements and/or as-built survey) a Temporary Certificate of
Occupancy(TCO) may be necessary. A TCO requires a $10,000 escrow.
Advisory Comments
Any changes to the exterior/landscaping improvements, i.e. patios,grading, sidewalks, retaining
walls, etc. not currently shown on the approved survey and landscaping plan will require a
separate Zoning Permit application to be submitted and approved prior to the work
commencing.
Any retaining walls that are over 4-feet in height or tiered walls not separated by twice of the
height of the lower wall require engineered plans and a building permit to be submitted and
approved prior to construction.

This is a follow up to our phone conversation we had this afternoon.Your soils report from Haugo Geotechnical Services
shows that soil boring#1 near the proposed garage location does not appear to be suitable soils for construction in their
opinion.Code R403.1 of the 2015 Minnesota Residential Building requires all footings to be on naturally occurring soils
or engineered fill.You will need an evaluation from an engineer registered in the State of Minnesota if the proposed
design for the garage is adequate for the current soil conditions.
Due to winter conditions the evaluation may not be able to be completed in the immediate future. If you would like,you
could apply for a permit separately for the detached garage.This way we can continue with the review process for the
home. 1 have attached a permit application to this email if you would like to do so.We will need 2 copies of the survey
and we can detach the plans for the garage from the house plans. If the design for the garage changes based on the
engineer's evaluation then we will need new plans for the garage at that time.

structure. Staff conducted a preliminary review based on the information provided and recommends the following
items be submitted or revised in order for your application to be considered complete and for the plan review to
continue:
1. Certificate of Survey. We have reviewed the survey and request the following information:
a. Top of Foundation. The top of foundation elevation is not shown on the survey. Please have the
surveyor call out the top of foundation elevation for the house and the accessory structure as well as
show the point or spot on the perimeter of the foundation where the top of foundation elevation is in
reference to. Please note, we expect the location to be consistent when submitting the foundation
as-built survey.
Please provide two copies of an updated, full-size certificate of survey (copy of the City's survey standards
enclosed).
2. Landscape Plan. Prior to the issuance of the building permit a landscape plan must be submitted showing all
the proposed exterior/landscaping improvements, i.e. patios,grading,sidewalks,retaining walls,etc. The plan

Dear Mr.Berg:
We have completed the geotechnical exploration report for the proposed single family
residence at 2800 Shadywood Road in Excelsior,Minnesota. A brief summary of our results
and recommendations is presented below. Additional details regarding our procedures,
results and recommendations follow in the attached geotechnical exploration report.
Two soil borings were completed for this project that extended to nominal depths of 21 feet
below the ground surface. The soil borings encountered about 2 to 7 feet of pavement
and/or fill over 2 to 6 feet of organic soils that extended to depth ranging from about 4 to 12
feet below the ground surface. Below theses material the borings encountered native sandy
lean clay glacial till soils that extended to the termination depths of the borings. The glacial
till had a rather soft consistency to a depth of about 7 feet in boring SB-2. Groundwater was
encountered after drilling in boring SB-1 at a depth of about 5 feet which corresponds to an
elevation of about 9271/z feet.
The vegetation, fill, organic and soft clay soils are compressible and not suitable for
foundation support. Soil corrections to remove the compressible soils would require
excavations extending to depths ranging from about 7 to 12 feet below the ground surface.
Given the close proximity to Lake Minnetonka and existing structures, we anticipate that
dewatering and shoring will be required.
The lowest floor grade of fl1e house should be at least 2 feet above the 100 year flood level of
Lake Minnetonka.

1.0 INTRODUCTION
1.1 Project Description
Mr. Hans Berg is proposing to purchase the property at 2800 Shadywood Road in Excelsior,
Minnesota with the intent of constructing a new single family home. We understand that
sale of the property is contingent,in part, on the suitability of site soil condition to support
the proposed home. Mr. Berg retained Haugo GeoTechnical Services (HGTS) to perform a
geotechnical exploration to evaluate the suitability of site soil conditions to support the
proposed development.
1.2 Purpose
The purpose of this geotechnical exploration was to characterize subsurface soil and
groundwater conditions and provide recommendations for foundation design and
construction of the proposed single family residence.
1.3 Site Description
The project site is located at 2800 Shadywood Road in Excelsior,Minnesota. The property is
located on the north side of the channel between Lafayette Bay and Carman Bay of Lake
Minnetonka. The project site is also located adjacent to the bridge over the channel.
The property contains an existing house, detached garage and several mature trees. The
ground surface of the lot is relatively flat and generally slopes to Lake Minnetonka. The
ground surface elevations at the soil boring locations ranged from about 9311/z to 9321/z feet
mean sea level(MSL).
1.4 Scope of Services
Our services were performed in accordance with the Haugo GeoTechnical Sexvices LLC
(HGTS)proposal dated June 21,2016 and under the terms of our General Conditions.
Our scope of services was limited to the following tasks:
• Completing two(2)standard penetration test boring to a nominal depth of 21 feet.
• Visually/manually classifying samples recovered from the soil boring.
� Preparing soil boring logs describing the materials encountered and the results of
groundwater level measurements.
• Performing laboratory tests on selected samples recovered from the borings.
• Preparing an engineering report describing soil and groundwater conditions, and
providing recommendations for foundation support.
1.5 Documents Provided
A lot survey or consiruction plans for the new house have not been prepared at this time.

1.6 Locations and Elevations
The soil boring locations were selected by Haugo GeoTechnical Services (HGTS) based on
the anticipated construction and site access. The ground surface elevation at the boring
location was obtained by HGTS using GPS measuring equipment. The GPS measurements
were based on the MN County Coordinate System (Hennepin County) in US Survey Feet
using the GEOID09(Conus)model.T'he approximate location GPS boring location of the soil
borings are shown on Figure 1,"Soil Boring Location Sketch",in the Appendix.
2.0 FIELD PROCEDURES
Two (2) standazd penetration test boring was advanced on June 30, 2016 by HGTS with a
rotary drilling rig, using continuous flight augers to advance the boreholes. Representative
samples were obtained from the boring, using the split-barrel sampling procedures in
general accordance with ASTM Specification D-1586. In the split-barrel sampling procedure,
a 2-inch O.D. split-barrel spoon is driven into the ground with a 140-pound hammer falling
30 inches. The number of blows required to drive the sampling spoon the last 12 inches of
an 18-inch penetration is recorded as the standard penetration resistance value,or"N"value.
The results of the standard penetration tests are indicated on the boring log. The samples
were sealed in containers and provided to HGTS for testing and soil classification.
A field log of the boring was prepazed by the HGTS drill crew. The log contains visual
classifications of the soil materiaLs encountered during drilling, as well as the driller's
interpretation of the subsurface conditions between samples and water observation notes.
The final boring log included with this report represents an interpretation of the field log
and includes modifications based on visual/manual method observation of the samples.
The soil boring log, general terminology for soil description and identification, and
classification of soils for engineering purposes are also included in the appendix. The soil
boring log identifies and describes the materials encountered, the relative density or
consistency based on the Standard Penetration resistance (N-value, "blows per fooY') and
groundwater observations.
The strata changes were inferred from the changes in the samples and auger cuttings. The
depths shown as changes between strata are only approximate. The changes are likely
transitions,variations can occur beyond the location of the boring.
3.0 RESULTS
3.1 Soil Conditions
Boring SB-1 was taken in the driveway near the detached garage and encountered a
pavement section consisting of about 3 inches of bituminous and 6 inches of aggregate base.
Boring SB-2 was taken near the north/northwest corner of the existing home and
encountered about 1 foot of silty sand topsoil fill.

Below the pavement or topsoil boring SB-lencountered about 6 feet of clayey sand and silty
clay fill that extended to a depth of about 7 feet. Boring SB-2 encountered about 1 foot of
sandy lean clay fill that extended to a depth of about 2 feet.
Below the fill both borings encountered organic silt (swamp deposits) that extended to a
depth of about 12 feet at boring SB-1 and 4 feet at boring SB-2.
Underlying the pavement section,fill and/or organic silt the borings encountered sandy lean
clay glacial till soils that extended to the boring termination depths at about 21 feet below the
ground surface.
The penetration resistance values (N-Values), shown as blows per foot (bp fl on the boring
logs,within the clay glacial till soiLs ranged from 5 to 17 bpf. These values indicate the clays
to have a medium to very stiff consistency with some upper soft zones.
3.2 Groundwater
Groundwater was encountered in boring SB-1 at a depth of about 8 feet while drilling and at
a depth of about 5 feet after drilling,which corresponds to elevations of about 9241/z and
9271/z feet,respectively. Groundwater was not encountered in boring SB-2 while drilling or
after removing the augers from the borehole to a cave-in depth of 12 feet. The ordinary high
water level of Lake Minnetonka is 929.4 feet.
The soil borings were completed in clayey soils and given the cohesive nature of the site soils
it is likely that insufficient time was available for groundwater to seep into the borings and
rise to its hydrostatic level. Groundwater monitoring wells or piezometers in conjunction
with deeper soil boring(s)would be required to more accurately determine water levels.
Water levels were measured on the dates as noted on the boring logs and the period of water
level observations was relatively short. Seasonal and annual fluctuations in the
groundwater leveLs should be expected.
3.3 Laboratory Tests
Laboratory moisture content tests were performed on selected samples recovered from the
soil borings. Table 1 below summarizes the results of the laboratory tests. Results of the
laboratory moisture content tests ranged from 16 1/z to 19 1/2 percent and are shown on the
boring logs adjacent to the sample tested.

3.4 OSHA Soil Qassification
The upper fill and swamp deposits encountered in the borings do not meet the OSHA
Classifications for Type A, B or C soils. Temporary excavations in the swamp deposit soils
will likely require side-slopes significantly flatter than those for Type C soils.
The underling clay till soils encountered in the borings will generally be Type B soils under
Department of Labor Occupational Safety and Health Administration(OSHA)guidelines.
4.0 DISCUSSION AND RECOMMENDATIONS
4.1 Propoaed Construction
A lot survey or construction plans for the new house have not been prepared at this time.
We assume the proposed house will be a slab-on-grade type with a main floor and garage
floor grade of about 932 feet. The new home is assumed to be constructed with cast-in-place
concrete or masonry block foundation walls supported on concrete spread footings with the
above grade construction consisting of wood framing,a pitched roof and asphalt shingles.
Based on the assumed construction we estimate wall loadings will range from about 1 to 2
kips(1,000 to 2,000 pounds)per lineal foot and column loads,if any,will be less than 50 kips
(50,000 pounds).
If the proposed loads exceed these values, the proposed grades differ by more than 2 feet
from the assumed values or if the design or location of the proposed building changes, we
should be informed. Additional analyses and revised recommendations may be necessary.
4.2 Discussion
The soil borings encountered very loose or soft fill, swamp deposits and soft clay soils that
extended to depths ranging from about 7 to 12 feet below the ground surface. These
materials aze compressible and are not suitable for foundation support. Groundwater likely
matches the water level of Lake Minnetonka which is at a depth of 3 to 4 feet below the
ground surface.
Briefly, the lot, in our opinion, is "buildable', however, soil corrections to remove the
topsoil, fill, organic soil and soft clays and replacing them with suitable compacted
engineered fill will be required for adequate foundation support. Soil corrections to remove
theses material are anticipated to extend to depths ranging from about 7 to 12 feet.
Given the close proxunity to Lake Minnetonka,extensive dewatering will likely be required
to complete the soil corrections. In addition, the required excavation will likely require
shoring in areas to prevent damage to existing streets and properties.

4.3 Mass Grading Recommendations
Excavation We understand that the existing house and detached garage will be demolished
to make way for the new home. We recommend all remnants of the structures including
footings, foundation walls, slabs and underground utilities be removed from within the
proposed building and oversize areas. We further recommend that all pavements,
vegetation, topsoil, fill, organic soil and soft clays be removed from the proposed building
and oversize azeas. Table 2 below summarizes the anticipatecl excavation depths at the
boring locations.Excavation depths may vary and could be deeper.

We recommend fill required to replace the soil removed during soil corrections consist of
granular soil (sand) meeting the ASTM Classifications SP. We recommend soil with less
than 5 percent passing the number 200 sieve and at least 50 percent retained on the number
40 sieve.
Organic soils such as topsoil, organic silt or soils that are black in color are not suitable for
use or reuse as structural fill.
Oversizing If the excavation extends below the proposed footing elevation, the excavation
requires oversizing. We recommend the perimeber of the excavation be extended a foot
outside the proposed footprint for every foot below footing grade (1H:1V oversizing). The
purpose of the oversizing is to provide lateral support of the foundation.
Excavations for soil corrections are anticipated to extend to depths ranging from about 7 to
12 feet below the ground surface. At excavation side slopes of 1H:1V the excavation will
extend 7 to 12 feet laterally beyond the perimeter of the excavation. Excavations could
extend onto adjacent properties posing a significant risk of undermining structures on those
properties. If site constraints will limit the excavations,temporary shoring will be required.
Dewatering Groundwater likely matches the water level of Lake Minnetonka which is at a
depth of 3 to 4 feet below the ground surface. T'he deeper soil corrections will extend below
groundwater levels. In addition, utility installations will likely extend to depths ranging
from about 7 to 10 feet below the ground surface which will extend below the ground water
level. We anticipate that dewatering will be required.
We recommend the groundwater level be temporarily lowered to a minimum of 2 feet below
the lowest anticipated excavation elevation to allow for construction. In sandy soils we do
not recommend attempting to dewater from within the excavation. Upward seepage will
loosen and disturb the excavation, resulting in a "quick condition." Rather, we recommend
groundwater be drawn down below the anticipated excavation bottom.

We recommend that a dewatering contractor be consulted to review the soil boring logs,
develop a dewatering plan and evaluate the impact of dewatering on adjacent structures.
Backfilling We recommend that backfill placed to attain site grades be compacted to a
�nimum of 95 percent of its standard Proctor density(ASTM D 698). Granular fill classifiied
as SP should be placed within 65 percent to 105 percent of its optimum moisture content as
determined by the standard Proctor. All fill should be placed in thin lifts and be compacted
with a large self-propelled vibratory compactor operating in vibratory mode.
In areas where fill depths will exceed 10 feet below footings,we recommend that compaction
levels be increased to minimum of 98 percent of the materials standard Proctor density.
Even with the increased compaction levels a construction delay may be appropriate to allow
for post construction settlement of the fill mass.
Fill and backfill placed on slopes,if any,must be"benched"into the underlying suitable soil
to reduce the potential for slip planes to develop between the fill and underlying soil. We
recommend"benching" or excavating into the slope at 5 feet vertical intervaLs to key the fill
into the slope. We recommend each bench be a minimum of 10 feet wide.
Foundations We recommend the perimeter footings bear a minunum of 42 inches below
the exterior grade for frost protection. Interior footings may be placed immediately below
the slab provided construction does not occur during below freezing weather conditions.
Foundation elements in unheated areas should bear at least 5 feet below exterior grade for
frost protection.
We anticipate the foundations and floor slabs will bear on compacted engineered fill or
native cohesive soils. With the building pads prepared as recommended it is our opinion the
footings can be designed for a net allowable bearing pressure up to 2,000 pounds per square
foot(ps fl.
4.4 Interior Slabs
The anticipated floor subgrade is granular fill following soil corrections. It is our opinion a
modulus of subgrade reaction, k, of 250 pounds per square inch of deflection (psi) may be
used to design the floor.
If floor coverings or coatings less permeable than the concrete slab will be used, we
recommend that a vapor retarder or vapor barrier be placed immediately beneath the slab.
Some contractors prefer to bury the vapor barrier or vapor retarder beneath a layer of sand
to reduce curling and shrinkage, but this practice often traps water between the slab and
vapor retarder or barrier. Regazdless of where the vapor retarder or vapor barrier is placed,
we recommend consulting the floor covering manufacturer regarding the appropriate type,
use and installation of the vapor retarder or vapor barrier to preserve the warranty.
We recommend following all state and local building codes in regards to a radon mitigation
plan beneath interior slabs.

4.5 Below Grade Walls
We anticipate the new home will be a slab on-grade structure and do not anticipate below
grade levels or below grade basement walls. Recommendations and estimated soil
parameters for below grade walls can be provided if required or requested.
4.6 Exterior Slabs
Exterior slabs will likely be underlain by non-frost-susceptible fill soils consisting of poorly
graded sand soils. This being the case,it is our opinion that special subgrade improvements
in excess of topsoil/vegetation stripping in advance of slab construction will not be required.
However,we recommend sloping exterior slabs to cirain away from the homes.
4.7 Site Grading and Drainage
The ordinary high water level of Lake Minnetonka is 929.4 feet.The lowest floor grade of the
house should be at least 2 feet above the ordinary high water level of Lake Minnetonka.
We recommend the site be graded to provide positive run-off away from the proposed
buildings. We recommend landscaped areas be sloped a minimum of 6 inches within 10 feet
of the building and slabs be sloped a minimum of 2 inches. In addition we recommend
downspout�with long splash blocks or extensions for each house.
4.8 Utilities
We anticipate that the utilities will be supported on granular soil (sand) following soil
correction or native clay till soils which in our opinion are suitable for pipe support. We
recommend removing all topsoil, organic, soft or other unsuitable soils, if encountered,
beneath utilities prior to placement.
We recommend bedding material be thoroughly compacted around the pipes. We
recommend trench backfill above the pipes be compacted to a minimum of 95 percent
beneath slabs and pavements, the exception being within 3 feet of the proposed pavement
subgrade, where 100 percent of standard Proctor density is required. In landscaped areas
we recommend a minimum compaction of 90 percent.
Groundwater will likely be encountered between depths of about 3 to 4 feet below the
ground surface. At typical pipe burial depths ranging from about 7 to 10 feet below the
ground surface, we anticipate groundwater will be encountered during utility i.nstallations
and dewatering will be required.
5.0 CONSTRUCTION CONSIDERATIONS
5.1 Excavation
The upper fill and swamp deposits encountered in the borings do not meet the OSHA
Classifiications for Type A, B or C soils. Temporary excavations in the swamp deposit soils

will likely require side-slopes significanfly flatter than those for Type C soils. Temporary
excavations in Type C soiLs should be constructed at a minunum of 11/z foot horizontal to
every 1 foot vertical within excavations.
The underling clay till soiLs encountered in the borings will generally be Type B soils under
Departrnent of Labor Occupational Safety and Health Administration(OSHA)guidelines.
Temporary excavations in Type B soils should be constructed at a minimum of 1 foot
horizontal to every 1 foot vertical within excavations.
We recommend the required slopes be further evaluated during construction. If site
constraints do not allow the construction of slopes with these dimensions then temporary
shoring may be required.
5.2 Observations
A geotechnical engineer should observe the excavation bottoms to evaluate if the subgrade
soils are similaz to those encountered in the borings and adequate to support the proposed
construction.
5.3 Backfill and Fills
We recommend density tests of backfill and fills placed during grading activities.Samples of
the proposed materials should be submitted to our laboratory prior to placement for
evaluation of their suitability and to determine their optimum moisture content and
maximum dry density(Standard Proctor).
5.4 Testing
We recommend density tests of backfill and fills placed for the proposed house foundaiion.

for evaluation of their suitability and to determine their optimum moisture content and
maximum dry density(Standard Proctor).
5.5 Winter Construction
If site grading and construction is anticipated to proceed during cold weather,all snow and
ice should be removed hom cut and fill areas prior to additional grading and placement of
fill. No fill should be placed on frozen soil and no frozen soil should be used as fill or
backfill.
Concrete delivered to the site should meet the temperature requirements of ASTM and/or
AQ. Concrete should not be placed on frozen soil. Concrete should be protected from
freezing until the necessary strength is obtained. Frost should not be permitted to penetrate
below the footings.
8
6.0 PROCEDURES
6.1 Soil Qassification
The drill crew chief visually and manually classifiied the soils encountered in the boring in
general accordance with ASTM D 2488, "Description and Identification of Soils (Visual-
Manual Procedure)". Soil terminology notes are included in the Appendix. The samples
were returned to our laboratory for review of the field classification by a soils engineer.
Samples will be retained for a period of 30 days.
6.2 Groundwater Observations
Immediately after taking the final samples in the bottom of the boring, the hole was checked
for the presence of groundwater. Immediately after removing the augers from the borehole
the hole was once again checked and the depth to water and cave-in depths were noted.
7.0 GENERAL
7.1 Subsurface Variations
The analyses and recommendations presented in this report are based on data obtained from
a limited number of soil borings. Variations can occur away from the borings,the nature of
which may not become appazent until additional exploration work is completed or
construction is conducted. A reevaluation of the recommendations in this report should be
made after performing on-site observations during construction to note the characteristics of
any variations. The variations may result in additional foundation costs and it is suggested
that a contingency be provided for this purpose.
It is recommended that we be retained to perform the observation and testing program
during construction to evaluate whether the design is as expected, if any design changes
have affected the validity of our recommendations, and if our recommendations have been
correcfly interpreted and implemented in the designs, specifications and construction
methods. This will allow correlation of the soil conditions encountered during construction
to the soil borings and will provide continuity of professional responsibility.
7.2 Review of Design
This report is based on the design of the proposed structure as related to us for preparation
of this report. It is recommended that we be retained to review the geotechnical aspects of
the design and specifications. With the review we will evaluate whether any changes have
affected the validity of the recommendations and whether our recommendations have been
correctly interpreted and 'unplemented in the design and specifications.
7.3 Groundwater Fluctuations
We made water level measurements in the borings at the times and under the conditions
stated on the boring logs. The data was interpreted in the text of this report. The period of

observation was relatively short and fluctuations in the groundwater level may occur due to
rainfall, flooding, irrigation, spring thaw, drainage, and other seasonal and annual factors
not evident at the time the observations were made. Design drawings and specifications and
construction planning should recognize the possibility of fluctuations.
7.4 Use of Report
lfiis report is for the exclusive use of Hans Berg and his design team to use to design the
proposed structure and prepare construction documents. In the absence of our written
approval, we make no representation and assume no responsibility to other parties
regarding this report. The data, analysis and recommendations may not be appropriate for
other structures or purposes. We recommend that parties contemplating other structures or
purposes contact us.

This permit is not transferable without District approval, and is valid to the date of expiration. No
activity is authorized beyond the expiration date. If the permittee requires more time to complete
the project, an application for renewal of the permit must be received by the District at least 30
days before expiration.
The applicant is responsible for compliance with all District Rules and for the action of their
representatives, contractors, and employees.
Conditions: Project to be completed as described in plans submitted to the
MCWD office on November 16�', 2016 according to the provisions of this permit.
• Properly install and maintain all required erosion control measures until the
disturbed areas are re-stabilized
• Notify MCWD in writing upon completing installation of perimeter and
sedimentation controls
• When the site is re-stabilized and the MCWD staff has performed a final
inspection, all perimeter control must be removed
• Per MCWD Floodplain Alteration Rule, an as-b�ilt survey must be submitted
to the MCWD upan completion of the project

Inspection/AnalvsisiMonitorin� Fees
A site inspection and monitoring by District staff will be performed where the activity involves:
• a commercial/industrial/multi-family residential development
• a single family residential development greater than 5 acres or of any size if within the
Minnehaha Creek subwatershed
• any alteration of a floodplain or wetland
• dredging within the beds, banks or shares of any protected water or wetland
• a violation
• any project which in the judgment of the District staff should be inspected due to project
location, scope, or construction techniques
In these cases, the applicant shall pay to the District a fee equal to the actual costs of field
inspection of the work, including investigation of the area affected by the work, analysis of the
work, and any subsequent monitoring of the work, which in the case of a violation shall be at
least $35.

ESCROW AGREEMENT
AGREEMENT made this�Z day of , 20�, by and between the CITY OF ORONO, a Minnesota
municipal corporation ("City")and Hans& Sharon ergh ("Owner(s)").
RECITALS
A. The undersigned is/are the Owner(s)of the Subject Property and hereby agrees to and consent to the
terms and conditions of this Escrow Agreement.
B. Owner has: (check one)
■ Filed a zoning application# 16-3885.
■ Filed an application for a Building Permit#2017-00020
❑ Agreed to comply with Orono City Code Section 78-1432 regarding accessory structures.
❑ Filed an Individual Sewer Treatment System (ISTS) permit application.
❑ Requested to do work within public Right-of-Way
■ Filed a request for a Temporary Certificate of Occupancy
❑ Other
("Application") on land situated in the City and located at 2800 Shadywood Road (the "Subject
Property"); and
C. The City is willing to review or monitor the Application only if the Owner agrees to reimburse the City
for the actual costs expended by the City on behalf of, or on account of, the Owner.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT REQUIRED. Contemporaneously with the execution of this Escrow Agreement, the Owner
shall deposit $10,000 ("Escrow") with the City necessary to secure coverage of the total costs
associated with review, approval, and monitoring of the Application. Any Escrow shall be held in a
special escrow account and shall be credited to the Owner.
2. PURPOSE OF ESCROW.
■ Zonin4. The purpose of the Escrow is to guarantee reimbursement to the City for expenditures
including but not be limited to staff time, at the rates established by the City Council, in excess of
that covered by the standard application fees, engineering consultant and legal consultant
expenses incurred by the City in reviewing and approving the Application and all other city staff
administrative and consultant services pertormed in the processing of said review and approval.
■ Buildin4/Zoning. The purpose of the escrow is to guarantee completion of the site plan as approved
and the provision of the as-built survey as required by the Building official.
■ Accessorv Structure. The purpose of the Escrow is to guarantee reimbursement to the City for
expenditures including but not limited to staff time, at the rates established by the City
Administrator, engineering and legal consultant expenses incurred by the City in removing an
accessory building if the Owner fails to pertorm the obligations in Orono City Code Section 78-1432
and all other City staff administrative and consultant services pertormed in removing the accessory
building, including land stabilization.
■ ISTS. The purpose of the Escrow is to guarantee reimbursement to the City for expenditures
including but not be limited to staff time, at the rates established by the City Council, in excess of
that covered by the standard apptication fees, engineering consultant and legal consultant
expenses incurred by the City if Owner for any reason is unable or unwilling to honor the
requirements of Chapter 58 of the Orono City Code, and all other city staff administrative and
consultant services performed in relating to the Application. The City may also reimburse itself for
all engineering and legal expenses associated with the construction, removal, alteration, or repair
of the ISTS if the Owner fails to do so.
■ Temrsorarv Certificate of Occupancv. The purpose of the Escrow is to guarantee completion of
exterior improvements (driveway, grass, etc.) that cannot be accomplished due to weather
conditions.

3. MONTHLY BILLING. The City will monthly forward to the Owner a statement and bill for the
expenditures incurred by the City for staff and consultant services. Such statements shall be due and
payable within 15 days for receipt by the Owner. No statement will be sent if there are no expenses
incurred in the period since the most recent statement. The City shall itemize all time, services, and
materials billed to any Owner and said time, services, and materials shall be in accordance with the
rules, regulations, and fees as promulgated and adopted by the City Council.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event the Owner does not make payment the
City as required under paragraph 3, the City may draw from the Escrow without further approval of the
Owner to reimburse the City for eligible expenses the City has incurred. The City shall periodically
notify the Owner of the draws the City has made and the nature of the expense for which the
reimbursement is being made.
5. REIMBURSEMENT OF ESCROW. The Owner shall reimburse the Escrow fund for any deficits caused
if the amount actually expended by, or billed to, the City exceeds the escrow fund balance.
6. RIGHT OF ENTRY.
■ Zonina. This section is not applicable.
■ Buildin4. This section is not applicable.
■ Accessory Structure. The Owner hereby grants the City, its agents, employees, officers and
contractors the right to enter the property to remove the accessory building(s) should the Owner
not complete the removal obligations in Orono City Code Section 78-1432.
■ ISTS. The Owner hereby grants the City, its agents, employees, officers and contractors the right
to enter the property to perform all work and inspections deemed appropriate by the City in
conjunction with replacement of the septic system, including but not limited to constructing or
completing any and all of the agreed upon improvements should the Owner not complete those
improvements by the date agreed upon.
■ Temporary Certificate of Occu�ancv. This section is not applicable.
7. NO INTEREST PAID. All accrued interest, if any, shall be paid to the City to reimburse the City for its
cost in administering the Escrow account.
8. CLOSING ESCROW. When the review has been completed or the project has been completed, the

9. CERTIFIED UNPAID CHARGES. If the Application is abandoned by Owner, or if the eligibte expenses
incurred by the City exceed the amount in Escrow, the City shall have the right to certify the unpaid
balance to the Subject Property pursuant to Minn. Stat. §§415.01 and 366.012.

the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and dces
not grant permission for additional or related work w6ich requires separate
permits. All provisions of laws and ordinances governing this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not

Exhibit"B".
NOW,THEREOFRE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement,
the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to reimburse the
City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for
all out-of-pocket costs(including planning, engineering, or legal consultant review)the City has incurred to assure that
the erosion control measures are installed and maintained so the property complies with the provisions of Orono City
Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions
associated with the work and to repair any damage to public property or infrastructure that is caused by the work. If
compliance with the approved Land Disturbance Permit is not accomplished within the allowable time period, the City
may bring the project into compliance by use of the security.
3. RIGHT OF ENTRY. The Owners hereby grant the City, its agents, err�ployees, officers and
contractors the right to enter the property to perform all work and inspections deemed appropriate by the City in
conjunction witn the required erosion control measures, including but not limited to constructing or completing any and
all of the agreed upon improvements should the Owners' contractor not complete those improvements by the date
specified herein.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owne�s shall be responsible for payment ta the City within 30 days of the Owners' receipt
of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owmers do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. Any remaining amount of the financial security deposited with the City for
faithful pertormance of the plans and specifications and any related remedial work will be released after the
completion and inspection of all such measures and the establishment of final stabilization for the Subject Property.
City Staff shall review the terms of this escrow agreement two times per year to determine whether the requirements
of the project have been successfully campleted and whether it is appropriate to return the funds. Owner may also
request the release of the funds, and such funds shall be released upon City Staff receiving the appropriate
verification that all requirements of the project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
