not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances governing this type of work

1. Submit a survey, aerial photo or sketch showing all structures on the property. Note which structures ar�
ta be demolished.
2. Submit a survey, aerial photo or sketch showing proposed erosion controi measures in accordance with
Chapter 79, Constructron Site Runoff Cot�trol.
3. Submit a copy of permit approval from the Mir�nehaha Cr�ek Watersf�ed District {MCWD). The Gity will
not issue a demolition permit witho�t a copy of the permit(s) from the MCWQ or documentation stating
permit{s) are not required.

4. Submit a $2,500 escrow and an escrow agreement signed by the property nwner(copy attached}.
, 5. Keep ail structure(s} enclased andlor secured untii such time as demalition is compfete.
6. Keep all demolition debris off adjoining property andfor the public rights-of way unless specific priar
approval is obtained in writing for temporary use thereof.
7. Completefy remove foundation(s) from the ground.
8. Gompleteiy dispose of ali demalition debris off site in accordance with all applicabie PCA requirements.
9. Abandon water wells in accordanee with State Nealth Qepartment regulations.
10. Call far an inspectian when ail debris has been removed, before backfilling.
11. Within 5 working days of superstructure removal, a final inspection shall be requested. The site shall be
left clean and clear c�f a(I debris, with any excavatian filled with earth level with the adjacent ground
elevation {except when such excavation is to be used as part of a new building and such new building is
actuaily under construetion�.
12. Abandon septic systems per Minnesota Rules Chapter 7080. AU septic tanks must be pumped, crushed
and filled with native soils. An inspectian is required af�er the tanks are pumped and before the tanks are
crushed and filied.
13. The undersigned owner shall and hereby does indemnify and hold harmless the Cifiy of Orono. its agents,
employees and assigns fram and against all clairns, damages, losses or expenses, including attorney
fees, against the Cify; its agents, employees and �ssigns arising out of or resulting from the demolition
described herein as perFormed by the praperty owner, his employees; agents, subcan#ractors or assigns.

Sec.78-72.-Lots of record.
{a) A lot of record is any lot for which a deed or registered land survey has been rec�rded in the affice of the register of
deeds or the registrar of tides for Hennepin Caunty pMor to January 1,1975,and after approvai by the council if required.
(b) A lot of record located withtn an R(Res�iential)or RR(Rural Residential)distriat but not within the Shoreland Overiay
district, RS Seasonal Recreationai district, or any of the LR-Lakeshore Residential districts,which does not meet the
requ�ements of this chapter as ta area or width may be utilized fw a single-family detached dweAing purpase,provided
that in the judgmenf of the council or administrative a�roval by the plan�ing director, such use does not adversely
affect pubilc health or safely and the foilowing requirements are met:
(1) In R districts of one acre or less and served by public sanitary sewer. A lot o#'record extsting upon January 1,
1975* fn any R district of the aty of up to and inciuding one acre, which lot is servEced by public sanihary sew�er
and which does not meet the requirements �thfs chapter as to area o�width only, may be utilized for single-
family detached dwelting purposes without council approvai if all other requirements of the underlying zoning
district are met, induding but not limited to requfr�yards, setbacks, lot c�verage by structures, t�rdcbver,etc.
However,the!ot of record shall not be more irrtensely developed unless combined with one or mor�abutting lots
o�portians so as to create a lot meeting the requirements of this chapter.

a. It is at least one acre in size, and the average width af the lot is at least 100 feet;
b. it is served by public sanitary sewer;and
c. tt otherwise meets the requirements of this chapter ar other appiicabie Code�ovisions.
(3) In R or RR distNcts not served by public sanitary sewer.A lot of record in any R or RR district in the city not
served by public sanitary sewer must meet the arrya and width requirements of this chapter and shall not be
utilized for singie-family detached dweNing purposes without councN approval. Administrative approval may
be granted for a lot of record not meeting the lot area and wldth requirements tf the planning director find�
that the foilawing conditions are met:
a. The lot area and!ot width each meet at least 50 perc;ent af the district standard.
b. Suitabie primary and altemate septic sites are ident�ed on the property and are protected from future
development by execution of a cavenanf.
c. All other zoning ordinance requirements must be met, including but not limited to the foilowing:
1. Setbacks.
2. Herdcaver.
3. Lot ooverage by structures.
4. Accessory structure requirements.
{c) A lot of record located in any shoreland district, induding the Shareland Overlay district� RS Seasonai Recxeaponal
distrrct, and any of the�R-Lakeshore Residerrtial district�,thai does not meeE the requirements of this chapter for lot
size ar lot width shail be subject to the following regulations:
(1) A nonconforming single Iot of recard may be allowed as a buliding site without variances from lot size and width
requirements, prov�ded that:
a. All setback requlremerrts can be met;
b. A Type 1 sewage treatment system consistent with Minnesota Rules, chapter 7080, can be installed or the
lot is connected to a public sewer;and
c. The impervious surFace coverage meets all hardcover location and square footage restrictions of this chapter
and the tofal square footage of hardcover does nat exceed 25 percerrt of the errtfre lot area.
d. All other zoning district standards can be met.
(2) In a �oup of two or more contiguous lots of recorc! under a common awnership, an indhridual bt must be
cansidered as a separate parcel ot' Iand for the purpose of sale or development, if it meets the fallowing '
requlrements:
a. The tot must be at least 66 percent of the dimens'ional standard for lot width and lot size for the shoretarxf
classification consistent with Minnesota Rules,chapter 6120;
b. The lot must be connected to a public sewer, if available,or must be suitable for the instailation of a Ty� 1
sewage treatmertt system consistent with Minnesota Rules� chapter 7080, and Iocaf government controls;
and
c. Impervious surface coverage must meet ail hardc�ver locatian and square footage restrictions of this chapter
and the ta�al square footage of hardoover must not exceed 25 perc:ent of the enare lot area;and
d. Development of the lot must be consis#ent with the comprehensive plan.

(3) A tot subject ta either subsections 78-72(cx9)or(2)remains subject to the harcicover restrictions o�f this chapter,
as folbws:
a. Where the hardc�ver squa�e footage allotment as catculated based on the assigned tter exceeds 25 pe,rcent
of!he entire lot anea, hardcover shall be Nmi#ed to 25 percent of the entire iot area.
b. No portion of the imperviaus surFaaa square footage al{owed shall be placed within in 75 feet of a lake OHWL
or thbutary bank, exc�pt for those items normaliy allowad in such location as regulated elsewhere in this
chapter.
(4) A lot subject to subsection 7&72(cx2)not meeting the requirements of subsection 78-72(cM2)must be combined
with the one or more contiguous lots sa they equal one or more conforming lots as much as possible.
(5) Norivithstanding subsection 7&72(cx2}, cor�tiguous noncoriforming tots vf record in shoreland areas under a
common rnnmership must be abie to be soid or purchased indiv(dually if each lot contained a habitab�residentia!
dwefling at the time the lots came under cammon ownership and the lots are suitable far,w served by, a sewage
treatment system cons�tent with the requirements of Minn. Stat. § 115.55 and Minnesata Rufes, chapter 7080,
or cannected to a pubiic sewer.
(8) In all vartance requests, zoning and bu�ding permit applications or conditionat use requests, the property awner
shall address,when determined as appropriate by the city engineer or city staff,stormwater n,moff management,
reduction of impervious surtaces, setback increases, r�tora�on of wetlands, vegetative buifers, se�rage
treatment and water supply capabilities, and other conservation-designed actions.
(7} A portlon of a conforming lot may be separated from an existing parcel as long as the remainder of the existing
paroel meets the lot size and sewage treatment requlrements of the zoning district for a new lat and the newly
cxeated parcel is combfned with an adjacent parcel.

This permit is not transferable without District approval, and is valid to the date of expiration. No
activity is authorized beyond the expiration date. If the permittee requires more time to c;omplete
the project, an application for renewal of the permit must be received by the District at least 30
days before expiration.
The applicant is responsible for campliance with all District Rules and for#he action of their
representatives, contractors, and employees.
Conditions: Project to be completed as described in plans submitted to the
MCWD office on November 16t'', 2016 according to the provisions of this permit.
+ Properly install and maintain all required erosion control measures until the
disturbed areas are re-stabilized
• Notify MCWD in writing upon completing installation of perimeter and
sedimentation controls
• When the site is re-stabilized and the MCWD staff has performed a final '
inspection, all perimeter controi must be removed
• Per MCWD Floodplain Alteration Rule, an as-b�aiit survey must be submitted '
to the MCWD upon completion of the project
