WIE�REAS, Steven R. aild Peggy A. Beck (hereinafter "the applicants") are the •
owners of the property located at 2795 Shadywood Road within tiie City of Orono (hereinaFler
"the City") and legally described as follows:
Tracts A and B, Registered Land Survey No. 500, files of Registrar of Ti�les,
. Couniy of Hennepin, MN (hereinafter "the property"); and
W�I�I2EAS, after due published and mailed notice in accordance with Miimesota
• Statutes and the City of Orono Zoning and Planning Codes, the Orono Plaruiing Coininission
held a public hearing on May 18, 1998, at which time all persons desiring to be heard
concerning this application were given the opportunity to speak thereon; and �
WHERE�.S, the applicants have applied to the City for a variance to Municipal Zoning
Code Section 10.22, Subd. 2 and Section 10.56, Subd. 16 (L) 1 and 2 to permit constructioii
of a lakeside deck as proposed in Exhibit A as prepared by Coffin and Gronberg on Au�ust
27, 1997 as revised October 30, 1997, April 22, 1998, and June 15, 1998, where 4,818 sq. ft.
(19.08%) hardcover exists in the 0-75' setback where a 19.5' x 17.66' (344.37 sq. 'ft.) sect�on •
of the badmintoi�/sport court will be removed to allow 37 sq. ft. (17.86%) is proposed and none •
is allowed; and where 3,672 sq. ft. (39.70%) of hardcover exists in the 75-250- setback wllere
� a 2.5' x 17.66' (44.15 sq. ft.) section of the badminton/sport court will be removed to allo��v 350
sq. ft. of new deck where 3,977.85 sq. ft. (43%) of hardcover is proposed and 2,312.5 sq. ft.
(25%) is allowed.

2. The properry is located in the LP�-1B Single Family Lakeshore Residential �.

The property consists of .79 acre or 34,500 sq. ft. .

3. The Orono Plaruung Coirunission reviewed this application on May 18, 1998 and
recommended approval by a vote of 3 to 2. �
4. The Planning Coinmission made the following findings of fact:
A. The zoning lot does not meet -the minimum lot area or lot width
requirements for the LR-1B district.
B. The existing house is 160' from Shadywood Road and is located in both
tlie 0-75' and 75-250' setback.
C. The existing residence is 87' froin the 929.4' elevation for Lake
Minnetonica and 8' from the channel.
• D. The proxiinity to the channel is a hardship due to boat traffic noise.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect tr�c conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicants, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicants; and would be in keeping with the' spirit and •
intent of the Zoning Code and Comprehensive Plan of the City.
6. The City Council has considered this application including the findings and
recommendations,of the Planning Commission, reports by City staff, corrunents
by the applicants and the effect of the proposed variance on the health, safety
and welfare of the commutiity. . :.
CONCI,i1SI0IVS, O1�D�R AND CQI�DITIONS
� Based upon oiie or more of the above findings, the Orono City Council hereby
grants variances to Municipal Zoiiing Code Section 10.22, Subd. 2 and Section 10.56, Subd.
16 (L) 1 and 2 to permit the construction of a lakeside deck as proposed in E�ibit A where
4,818 sq. ft. (19.08%) hardcover exists in the 0-75' setback where a 19.5' x 17.66' (344.37 sq.
• ft.) section of the badminton/sport court will be removed to allow 37 sq. ft. (17.86%) is
proposed and none is allowed; and where 3,672 sq. ft.�(39.70%) of hardcover exists in the 75-
250- setback where a 2.5' x 17.66' (44.15 sq. ft.) section of the badmintoi�/sport court will be

removed to allow 350 sq. ft. of new deck where 3,977.85 sq. ft. (43%) of hardcover is
proposed and 2,312.5 sq. ft. (25%) is allowed.
1. The applicant is to remove a 17.66' x 22' (388.52') sq. ft. from the sport court
as shown on Exhibit A.
2. To advise the applicants and all future property owners that future requests for
hardcover variances will not receive favorable consideration. �
3. Authorities granted by this variance run with the property not with the
applicants, but are permissive only and inust be exercised by application for a
building permit within one year of the date of Cotulcil approval, or this variance
will expire on that date (June 22, 1999).
. 4. Violation of or non-compliance with any of the terms and conditions of this
variance shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor. �
5. The undersigned applicants have read, understood and hereby agree to the terms
of this resolution and on behalf of themselves, their heirs, successors and
assigns, hereby agree to the recording of this resolution in the Chain of Title of
the property. ' '
Adopted by the City Council of the City of Orono, Miiinesota at a regular
meeting held on the 22nd day of June, 1998.
