Re: Deck Construction without a Building Permit
Dear Mrs. Brock:
It has come to the attention of this department that you
have recently constructed a deck and reroofed your house at 2780
Shadywood Road.
This letter is to inform you that building permits are
required for reroofing and deck construction in the City of
Orono. Please return the enclosed application with the required
submittals before October 29, 1990. If this deadline is not met,
the City may issue citations. If you have any questions or if
you have a problem meeting this deadline, please feel free to
contact me at my office.

RE: After the fact Deck Permit & Hardcove�r Ordinance
Dear Ms . Mabusth:
First of all , I would like to thank you for iche t�me you
spent with me on the telephone on November 15, answering
and directing my questions and concerns in the above matter.
In the past thirteen weeks , you are the only person ico
Iisten with concern and g�ve me logical sug�estions for solution.
As you requested, I will at�empt to chronicle what has
occured be�inning August 1, 1990, the date I moved into
my home at 2780 Shadywood Roacl, Orono, Mn.
Qn August 2, 1990, Helmers-Ryan Inc.Contractors began the
replacemnt of my Lakesade windows , which we found out
were dry-rotted. Along with replacement of tY�e windows,
the bid included replacement of any rotten boards on the
existing deck and replacement of a portiora of the cracked
cedar shakes on my roof. As the contractors got into the
deck port�.on of the bid, I was informed that the entire
deck was rotton, inc]Luding the stairs and many of the support
beams . At that time, Mr. Mike Ryan, Prsident of Helmers-
Ryan gave me another quote �o replace the entire deck,
except for the existing footings . I agreed to the bid,
and instructed them to go ahead with the project. Unfortunately,
I-Ielmers-Ryan Inc. filed for bankruptcy on August 18,before
the project was completed, and no one has been able to
locate an�one involved with the company. Two friends of
mine, who are carpenters helped me finish the project .
I ,nor the carpen�ers who helped me, even thought about
a permit to finish replacement of the deck. I have since
discussed this matter with them, and they told me that the
contractors should taave taken out a permit, but s�.nce
n� one can locate the contractors , I can' t even ask them
why nothing was fi�ed. I also had to have a frien� of
mine,who owns a roofing company, come in to rep�ace the
�efective cedar sl�akes ,which were or�ginal�y supposed
to be done by Helmers-Ryan. After weeks of frustration,
sore muscles , and tiepletion of my bank account, I was
fa.nally ready to enjoy my new home.
Then, in Octob2r, I received a letter from Ly�e Oman,
and the City of Orono, notifying me that a permit for
a NEW deck and roof was never taken out for my property, and
that I should fill out the enclosed forms , and apply
for an after-the-fact permit. I immediately went to
City �a11 , and spoke wi�� Mr. . Oman. Firsr , he �nf�rme�

�xisiGn� de�k was 10 'x28 ' anci the rzew deck is �2 'x32 ' ,
an expans?on of Q. 6a/o. First of alZ , I cior.' t know what
size th� pre-exisitirig aeck was , and s_nce I wa� told
by Lhe City of Orcn� that i,.Y:ere n�ve� was a pre-existing cieck,
tt.e ti�-st time I spake wz�t� Mr. Cmar, I do r?ot know if �r.is
calcu?atic;n is coz�rect . � only krAow that tl�e orig�r�al �ement
slab ur.�er the deck is 27 ' 1(i" x 9"�1° . Mr. Gaffror_ informeu
me that I r�ad two options for resolving this matrer:
l . remcve enough h�a�cicov�r to Ieave �% in 0-75
zone an� no more t1-�an 25%�n 75-25G' zone .
2 . a�ply for an after �he fact hardcover varianc�e
witr a application f.ee c�� $1%5,plus after the fact
ir.vestigation fee of $175 , fo� a totai of_ $350. �
As you can �mag�ne, wh�r. I rec�ived thi.s no��ce , it on�y
aaded to my frustration ar�ri my feelings of bein� victima_ze�
as a new s?ng?e Yiomeowner. Between ��e now bankru�� contrac�or
and my vario�s visits witr� tl�e city, I was reaay to give up.
