A RESOLUTION GRANTING A VARIANCE
TO MUNICIPAL ZONING CODE
SECTION 10.22, SUBDIVISION 2
� FILE NO. 2191
WHEREAS, Walter R. Wittmer and Sharon K. Wittmer (hereinafter "the
applicants") are owners of the property located at 2780 Shadywood Road within the City of
Orono (hereinafter "the City") and legally described as follows: �
Tract B, Registered Land Survey No. 1196, Hennepin County, Minnesota
(hereinafter "the property"); and
, W�REAS, the applicants have applied to the City for a variance to Municipal
Zoning Code Section 10.22, Subdivision 2 to permit construction of a 12' x 24' two level single
stall garage addition at the northwest corner of the residence resulting in 4,603 s.f. or 29%
• hardcover within the 75-250' setback area where the code would allow 25%; hardcover exists
at 4,995 s.f. or 31.4%.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #2191.
2. The property is located in the LR-1B, Single Family Lakeshore Residential
Zoning District requiring one acre in area.
3. The Orono Planning Commission reviewed this application on November 18,
1996 and recommended unanimous approval of the variance as proposed based
upon the following unique findings and hardships:
A. Structural coverage is proposed at 9% where the code would allow 15%. �
B. No other variances are required for this improvement.

C. Hardcover is proposed at 29% within the 75-250' setback area where
31.4% exists resulting in a hardcover decrease of 392 s.f. or 2.4%.
D. Hardcover in the 0-75' setback area is proposed at 66 s.f, or 0.7% where
953 s.f. or 9.98% exists.
E. 1,929 s.f. of a shared easement drive area has been deducted from the
75-250' setback area having additional impact on allowed hardcover.
F. The City has received no negative comments from the property owners
notified of this review.
G. 9,550 s.f. of lakeshore yard consists of flat grassed yard area allowing
for treatment of runoff before entering lake. .
• 4. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicants, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicants; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
5. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicants and the effect of the proposed variance on the health, safety
and welfare of the community.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants a variance to Municipal Zoning Code Section 10.22, Subdivision 2 to permit
construction of a 12' x 24' two level single stall garage and grants a 4% hardcover variance
within the 75-250' setback area, subject to the following conditions:

1. All hardcover improvements scheduled for removal as shown on Page 5 of this
resoiution shall be completed prior to the footing inspection for the new
construction. �
2. Authorities granted by this variance run with the property not with the
applicants, but are permissive only and must be exercised by application for a
building pernut within one year of the date of Council approval, or this variance
will expire on that date (December 9, 1997).
3. Violation of or non-compliance with any of the terms and conditions of this
variance shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
4. ,The undersigned applicants have read, understood and hereby agree to the terms
• of this resolution and on behalf of themselves, their heirs, successors and
assigns, hereby agree to the recording of this resolution in the Chain of Title of
the property. .
Adopted by the City Council of the City of Orono, Minnesota at a regular
meeting held on the 9th day of December, 1996.
