Unfortunately there is not a less costly option for Mrs. Ogle.
In 1984 the Ogle's applied for and were issued a conditional use permit to construct retaining walls, planter
retention basins and to alter the grade within 75' of Lake Minnetonka. As a result of the resolution, their
property was allowed to exceed the allowed hardcover for the respective zones.
On July 19, 2012, our building inspector caught the landscaper working without a permit. A requirement of the
after-the-fact permit was an as-built survey and hardcover calculations to confirm the property is at the allotted
hardcover limitations set in 1984.
If the landscaper had applied for a permit prior to starting the work, our permitting process requires a survey
showing the current or existing conditions and as well as an as-built survey once the project was complete.

We spoke and exchanged some e-mails previously regarding 2765 Shadywood tear down issues. I believe I let you know
that the owner of 2771 Shadywood is also a client of mine. She is a recent widow and growing into the responsibilities
that her husband handled before. I met with her last week and she discussed with me that the City of Orono is
requesting an As-Built Survey of the property. She requested quotes from two survey companies. One quote was for
$3,200 and the other quote was for$2,900. She was surprised at the costs of the surveys. I offered to Marlys to

contact you on her behalf. I was hoping for Marlys' sake that you reconsider the As-built Survey order. It is my
understanding that the landscaped surface area was not changed materially except for the removal of pavers and hard
cover and replacement with wood chips. Does a more abbreviated and less costly survey exist that would satisfy your

Mrs. Ogle,
We have approved the as-built survey dated 9/17/12. All expenditures, including escrow refund requests, as a
formality must be approved by the City Council. Your request will be presented to the council on October 22.
The check will be mailed on Tuesday, October 23rd.
Please note resolution #1655 dated July 17, 1984 states, "all planting and planter retention basins must be
permeable surfaces for runoff." I understand from speaking with Craig Frick of Superior Lawn & Landscape the
pond was lined with plastic and the pond was replaced using plastic with holes poked into it. Any future
projects at this address will require the removal of the plastic and replacement with permeable material.
