Randgaard Trust U/A Dated December 19, 2000, (hereinafter the "Owner") is the owner of the property located at 2765 Shadywood Road within the City of Orono (hereinafter the "City") and legally described as: Tracts E, F, G, H, I and J of Registered Land Survey No. 415 files of Registrar of Titles, County of Hennepin (hereinafter the "Property"); and WHEREAS, Thomas M. Randgaard, co-trustee of the Thomas M. Randgaard Trust U/A Dated December 19, 2000, (hereinafter the "Applicant") on behalf of the Owner has made application to the City of Orono for an after-the-fact variance to Orono Municipal Zoning Code Section 78-1680 to allow installation of approximately 60 square feet of additional hardcover for an elevated patio (hereinafter"East Patio"); WHEREAS, there are existing legal non-conforming improvements within the 75- foot setback on the Property and in accordance with Orono Municipal Code Section 78-71 the Applicant intends to perform in-kind replacements including the following: a paver sidewalk, convert a porch (a.k.a. hot tub room) to an above grade patio; reconstruct an at-grade patio and convert a deck to the East Patio; and WHEREAS, in conjunction with the in-kind replacement of the East Patio, the Owner has made application to the City of Orono for an after-the-fact variance to Orono Municipal Zoning Code Section 78-1279 to permit construction of the East Patio 42 feet from the OHWL of Lake Minnetonka and approximately 1.5 feet closer to the OHWL than the deck it was replacing where a 75' lakeshore setback is normally required; WHEREAS, in conjunction with the in-kind replacement the Applicant has made application to the City of Orono for a conditional use permit (hereinafter the "CUP") pursuant to Orono Municipal Zoning Code Section 78-966 and 78-1286 to allow installation of rain gardens as well as an after-the-fact CUP to address the filling related to the as-constructed elevated patios within the 75-foot setback on the Property; and Page 1 of 5 � o� O �,: O CITY of ORONO ��,. ��r��� � }� ��t � ��� �� ` � RESOLUTION OF THE CITY COUNCIL '� � �� :�_ �� 6 3 9 � �� y' ° �G'�' NO. �k'ESH�4 WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the Orono Planning Commission on March 17, 2014 at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File number 14-3656. 2. The Property is located in the LR-1 B One Family Lakeshore Residential Zoning District which requires a minimum lot area of 1.0 acre and a minimum lot width of 140'. 3. The Planning Commission reviewed this application at a public hearing held on March 17, 2014 and voted 6 for and 0 on a motion to approve the CUP and the hardcover variance based on the following findings of fact: a. The Property contains 32,622 square feet (0.75 acres) in area. b. The Property has lakeshore on two sides therefore there are two separate 0- 75' zones. The property has 153' in width at the southern location of the Ordinary High Water Level (hereinafter the "OHWL") and 184' in width at the southern 75' from the OHWL; and has 244' in width at the northern OHWL and 209' in width at the northern 75' from the OHWL. c. The Applicant's proposed landscape plan has been designed in a way which offers screening of the improvements with a natural vegetation as viewed from the lake and from neighboring properties. d. With a total of 20.54% overall hardcover, the Property will conform to the 25% hardcover limitations of a Tier 1 lot. e. Minnesota State Statute 462.357 permits an existing non-conforming structure to be reconstructed in-kind. The construction of the paver sidewalk and the conversion of the west porch to an elevated patio and pavers appear to be in-kind replacements and can be approved administratively. f. After-the-fact hardcover and lake setback variances are required because discrepancies between the 2007 and current surveys, and the available information in applicant's submittals, testimony and City records, are Page2of5 .� o�,. The ApplicanYs proposed rain gardens, paver walkway, elevated patios and landscaping will not alter the essential character of the neighborhood and will result in minimal or no negative impact on adjacent properties. h. The ApplicanYs' project will not adversely impact views of the lake currently enjoyed by the adjacent properties; views of the property from the lake will be improved with the new stair and landscape screening offered. i. The ApplicanYs request is in harmony with the purpose and intent of the ordinance. j. The Applicant has demonstrated that enforcing the provisions of the Zoning Ordinance deprives the Applicant of the reasonable use of their Property. k. The proposed grading within the 75-foot setback area will not have an adverse impact on surrounding lands. Drainage patterns for runoff leaving the site will not be significantly altered. I. The Applicant has provided a landscape plan which will serve to screen and mitigate views of the retaining walls and stairs from the lake in a natural manner. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Applicants and the public, and the effect of the proposed variance and CUP on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance and CUP would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Applicants, but is necessary to alleviate a practical difficulty; is necessary to preserve a substantial property right of the Applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. Page 3 of 5 � , � O� O �, O CITY of ORONO ��, ���`�-._, +-� � �% -';� D►► RESOLUTION OF TH ITY COUNCIL "�" f �Y �4• .:�`� ,�,�' 6 �� 7 � G NO. ��kESH�g'� CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants the following: a) An after-the-fact variance to Orono Municipal Zoning Code Section 78-1680 to allow installation of approximately 60 square feet of additional hardcover for the East Patio; b) An after-the-fact variance to Orono Municipal Zoning Code Section 78-1279 to permit construction of the East Patio 42 feet from the OHWL; c) A CUP pursuant to Orono Municipal Zoning Code Section 78-966 and 78-1286 to allow installation of rain gardens; d) An after-the-fact CUP to address the filling related to the as-constructed elevated patios within the 75-foot setback on the Property; Subject to the following conditions: 1. Council approval is based on the survey, construction and landscape plans submitted by the Owner and annotated by City staff, attached to this Resolution as Exhibits A, B & C Any amendments to the approved survey/site plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Proposed hardcover levels are conforming to the Tier 1 standards and shall not increase above 4,019 square feet or 15.6% within the 0-75' zone and 6,072 square feet or 20.54% overall. Structural coverage limitations will also be met. No variances are granted for an increase of hardcover or structural coverage. 3. Authorities granted by this resolution run with the Property not with the Owner, but are permissive only and must be exercised by obtaining administrative building permits for the patios, paver walkway and rain gardens walls and commencing construction of said project within one year of the date of Council approval, or the variance and CUP will expire on that date (April 28, 2015). 4. Upon completion of the project and prior to release of escrow monies the Owner shall submit an as-built survey and as-built hardcover calculations verifying compliance with the approved plan. 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor.
