, The survey provided still does not conform to the city standards. In particular: neither existing or proposed contour lines
are shown.The Top of Wall and Bottom of wall elevation are not depicted for the retaining wall. Also the site plan does
not depict the proposed draining pattern.
Based on the spot elevation provided it appears that the proposed retaining wall will be well over 4ft tall . Retaining
walls over 4ft tall require a engineered design signed by a licensed engineer.
The existing retaining wall does not appear to be marked or annotated for removal.
The plan depicts work in the county right of way. A county right of way permit will be required.

On June 11, 2015 the City received a building permit application for a proposed house and garage additions, along
with a proposed retaining wall. Staff conducted a preliminary review based on the information provided and
recommends the following items be submitted or revised in order for your application to be considered complete and
for the plan review to continue:
1. Certificate of Survey. The City Engineer has reviewed the survey and made the following comments. Please
provide two copies of an updated,full size certificate of survey which meets all of the City's survey standards
(enclosed)addressing the comments below.
a. Existing topography or proposed grading is not shown on the west side of the property where the
proposed additions are being shown.
b. A proposed retaining wall is shown in the middle of the proposed driveway addition. Please clarify.
2. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement
to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will
guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required
escrow amount for this project is$2,500. The city currently holds two escrows for this property. The current
escrow will be refunded and the original escrow associated with permit#2013-00843 will be held. Attached
is an updated escrow agreement, combinin� the two permit numbers. The property owner must sign and
return the attached, updated escrow agreement. No additional escrow money is needed at this time.
Your project may trigger the Minnehaha Creek Watershed DistricYs(MCWD) permitting requirements; please contact
the MCWD directly at 952-471-0590 regarding your project. Please note, the City of Orono will not issue a building
permit without a copy of MCWD permits or documentation from the MCWD stating the proposed project does not
trigger any of their permitting requirements. The above information is required in order for the plan review to

Recitals
1. A building permit application has been �led for �� �� '`'� �'�-� located at

2. Owners request the City to review this application which requires City approval and may require
consultant legal and/or engineering review.
3. The City will commence its review of the application and incur costs associated with said review only if
the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement,
the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to reimburse the
City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all
out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal consultant
review) or will incur in reviewing the plan. Eligible expenses shalf be consistent with expenses the Owners would be
responsible for under a building permit application. The escrow will also guarantee reimbursement to the City for all
out-of-pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater
Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be used
by the City to eliminate any hazardous conditions associated with the work an�i to repair any damage to public property
or infrastructure that is caused by the work (including planning, engineering, or legal consultant review)associated with
building permit# if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send
a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to the
City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced
pursuant to#3. The City may draw from the escrow account without further approval of the Owners to reimburse the City for
eligible expenses the Ciry has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owners
when all requirements related to the project are complete. City Staff shall review the terms of this escrow agreement
two times per year to determine whether the requirements of the project have been successfully completed and
whether it is appropriate to return the funds. Owner may also request the release of the funds, and such funds shall be
released upon City Staff receiving the appropriate verification that all requirements of the project have been
successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses in rred by the City exceed the amount in escrow, the City shall ha e the right to certify the unpaid balance
to the s ject p perty uant to Minn. Stat. §§415.01 and 366.012. �

State Building Code. This permit is for only the work described and dces
not grant pertnission for additional or related work which requires separate
permits. All provisions of laws and ordinances goveming this type of work

expire and become null and void if construction suthorized is not
commenced within 180 days of the date of issuance,or if consVuction is

BUILDING PERMIT ESCROW AGREEMENT
Orono Building Permit#2013-00843&2015-00754
AGREEMENT made this �^r' day of �11/J , 20f�, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") Jeff Engler("Owners").
Recitals
1. A building permit application has been filed for an addition to the principal structure and deck
located and a garage and home addition along with a retaining wall at 2760 Shadywood Road the ("Subject
Property"), legally described as Tract A, Registered Land Survey No. 1196, Hennepin County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2013-00843 8 #2015-00754 if
compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
