Orono City Code Section 78-1830 states that structures within the Shareland overlay zone shall
have the lowest level (including a basement level) no lower than the regulatory flood protection
elevation. City Code Section 78-1111 (19) establishes the regulatory flood protection elevation
for Lake Minnetonka as 932.5 feet above sea level.
The property at 2745 Shadywood Road (Tracts C and D, Registered Land Survey No. 500,
Hennepin County, Minnesota) is within the Shoreland overlay zone. In City files is a signed,
original survey made by David C. Craigie (Licensed Land Surveyor 42618) of this property
dated Apri123, 2008. It states the elevation of the floor of the lowest level of the house on the
property is 832.5 feet above sea level.

As we've finished the design process and started the construction phase, three things
have come up that I would like to change. I believe the changes are very minor and are
consistent with the spirit and content of the Council resolution on my plans. The three
proposed changes are as follows:
Back Screened In Porch
• In the resolution approved by the Council, the back screened porch was 147
square feet of total space.
• When my new builder came on board, they determined that the design could not
be built as drawn and would have to be altered. The City Inspector concurred.
The porch wall was drawn butting into the stone fireplace wall, when it needed to
be flush with the side of the fireplace wafl.
• If we go with the design as now drawn, it would eliminate roughly 15 square feet
from the hardcover approved in the resolution.
Chimnev Bumq Out Facing The Driveway
• The original plan called for a 14 foot long chimney bump out that was a straight 6
inches across the 14 foot span.
• The designers have suggested that instead of that, a design element could be
added that would be much more visually interesting and tie in to the theme of the
house.
• They have proposed a rounded chimney bump out that would still be 14 feet wide
but extend from 0 inches at the ends to 24 inches in the middle.
• The height of the new bump out would be 30 feet, which is the same as the
current plans.
• The bump out also faces straight back up the driveway, so would largely not be
visible from the lake, particularly on the Narrows side where there is a significant
tree buffer.
• There would be a very slight increase in the overhang, which is over the
driveway.
• The change was actually suggested by finro neighbors and they are very much in
favor of it.
Railinas
• When railings for the decks were discussed, our goal was to make them as
invisible as possible.
• At the meeting, my builder and I suggested the best solution we knew of at the
time, which was Plexiglas.
• After doing more research and getting feedback from my neighbors, I now
believe there is a solution that better meets the Council's objectives without the
downsides of Ptexiglas.
• The two issues raised about Plexiglas were reflection and potential storm
damage.
• One of my decks faces virtually straight East and one faces virtually straight
West. When I shared the plans with neighbors, they expressed a concern that
the sunrise and sunset hitting the Plexiglas had the real potential to cause a
bright reflection. In looking at some Plexiglas railings on the lake, I think this is a
e ~
very valid concern. If there were reflections off the Plexiglas, it would defeat the
goal of trying to make them as invisible as possible.
• I was also concerned about the strength and safety of Plexiglas given my
location. Sitting in the open on the end of a point on a large bay, I get very
strong straight line winds coming across the lake. When I asked the Plexiglas
dealer how the panels would perform in strong winds, he couldn't guarantee that
they wouldn't shatter or blow out. In a major storm, I would be concerned about
the wind either blowing the panels out of the frames or shattering the panels,
which could create a safety issue.
• I believe the better solution would be to use a stainless steel cable rail.
Minnesota code requires 11 cables that are only 1/8 inch in diameter. I think it
would be far less visible, have no potential for reflection, would be stronger, and
have no chance of shattering or blowing out, since it has virtually no surface area
for wind to hit.
• I'd like to request that I be allowed to switch the Plexiglas to cable rail.
Thank you very much for considering these changes. I think they will live up totally to
the spirit of the resolution and create a better overall plan.
