C ITY of ORONO ti ti RESOLUTION OF THE CITY COUNCIL ��`�k'EsBo�'`'�G NO. 5 � 4 1 A RESOLUTION GRANTING A VARIANCE TO MUNICIPAL ZONING CODE SECTION 78-1279 AND 78-1288 FILE NO. 07-3305 WHEREAS, James E. Zimmerman, a single person (hereinafter "Owner"), is the owner of the property located at 2745 Shadywood Road within the City of Orono (hereinafter "City") and legally described as: Tracts C and D, R.L.S. No. 500, Hennepin County,Minnesota(hereinafter "the Property"); and WHEREAS, Owner has made application to the City for a variance to Municipal Zoning Code Section 78-1279 to allow a 19 foot lake setback when a 75 foot setback is required; and WHEREAS, Owner has made application to the City for a Variance to Municipal Zoning Code Sec�ion 78-1288 to allow 23.2 percent hardcover in the 0 to 75 foot zone when no hardcover is allowed; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held public hearings on August 20, September 17, and October 15, 2007 at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File#07-3305. 2. The Property is located in the LR-1B zoning district, where 1.00 acre is the minimum lot area and 140 feet is the minimum lot width. The Property is approximately 0.71 acres in area and 179 feet in width. It is a peninsula that is almost entirely within the 0 to 75 foot zone. 3. The Planning Commission reviewed this application on August 20, September Page 1 of 4 . � �O� O O C ITY of ORONO � r A" ti • ti RESOLUTION OF THE CITY COUNCIL ��9k'Esi;�g'�G NO. 5 7 4 1 17 and October 15, 2007 and on a vote of 5 - 1 recommended approval of the variances, based on the following findings: . a. Virtually the entire property is within the 0 to 75 foot zone. b. The addition to the house is necessary to make reasonable use of this property. c. The amount of hardcover is not being increased. d. The property is burdened with an emergency vehicle turnaround for the private road that serves 2765 and 2771 Shadywood Road as well as the property. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Owner and the public, and the effect of the proposed variances on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other p'roperiy in this zoning district; that granting the variances would not adversely affect tr�c conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Owner but are necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the Owner; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. . CONCLUSIONS,ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a variance to Orono Municip�l Zoning Code Sections 78-1279 and 78-1288 to allow a 19 foot lake setback and 23.9%hazdcover in the 0 to 75 foot zone subject to the following conditions: 1. Council approval is based on the site, rain garden and house plans submitted by the Owners and annota.ted by City sta.ff, attached to this Resolution as Page 2 of 4 , , � O� O O C ITY of ORONO r� r '9" H ti RESOLUTION OF THE CITY COUNCIL ��`�k'ES'SOg'�G NO. -�--r--r- Exhibits A, B and C. Any amendments to these plans may require further Planning Commission and City Council review. 2. Hardcover in the 0-75' zone shall be limited to 7,100 s.f. or 23.2% and hardcover in the 75-250' zone shall be limited to 0 s.f. per the proposed site plan and hardcover allowance summary as depicted on Exhibit D. The Owner is advised that any future requests to increase hardcover or change the nature � of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. 3. All second story decks/porches shall have clear railings. 4. The deck off the master bedroom shall be limited to the area outside the sliding glass doors. 5. Rain gardens shall be provided and maintained on both sides of the driveway. 6. The Certificate of Occupancy shall not be issued until an as-built grading plan verifying compliance with engineering and zoning approvals and with floodplain regulations has been submitted and approved. Any deviation from the approved plan may require Planning Commission and/or City Council review. 7. Owner shall not place any plastic or fabric liner material under any landscaping on the property to ensure their permeability as non-hardcover surfaces. 8. Authorities granted by this resolution run with the Property not with the Owner, but are permissive only and must be exercised by obtaining a building permit for the new construction before April 14, 2009 or the variance will expire on that date. 9. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor.
