It has been brought to the attention of the City a boat registered to you is docked on the Narrows Dock Lots O and P. The Orono Municipal Code prohibits property owners from providing dock slips at their private docks for anyone other than the property owner. The provision of slippage for anyone other than the owner of the property,regardless whether there is a rental fee in��olved, is prohibited. The us� of the Wittman dock for storage of your boat is an ille�al activity and the boat must be removed from the property. The City of Orono has also sent notice of the violation to the property owner. The City of Orono has notified the property owner your boat must he rernoved by July 30, 2000 or the City of Orono may be required to take legal action. RESIDENTIAL DOCKS More than 1/3 of the residential lots in Orono abut the lakeshore. With neazly 40 miles of Lake Minnetonka shoreline, and additional properties abutting Lang Lake, Mooney Lake,French Lake, Dickey's Lake,Lake Katrina, Lake Classen and Lydiard Lake, Orono is home to an abundance of dock owners. The following rules and regulations govern the placement and use of private residential docks in Orono: > Seasonally installed docks are a permitted accessory use for residential properties � which abut the lakeshore and contain a residence structure(Section 10.23 Subd. SA). > New seasonal docks require a one-time permit($30.) and may be reinstalled at the same location annually thereafter without additional permits (Fee Schedule,p. 8). > Permanent docks require a Conditional Use Permit (Sec. 10.55 Subd. 9B) and may require additional permits from the Lake Minnetonka Conservation District(LMCD) and the Minnesota Department of Natural Resources (DNR). > Renting private dock space in the City of Orono is prohibited. Providing slippage for anyone other than the owners or occupants of the property,regardless whether there is a 'rental fee' involved, is prohibited. In brief, such activity is cosidered to be the 'business of docking' and is only allowed within the B-2 Lakeshore Business District (marinas). > Sharing of a single dock by three or more adjacent lakeshore owners is allowed subject to City Council approval of a Joint Use Dock License(Section 5.42). > Placement of docks on Lake Minnetonka is govemed by the LMCD(612-745-0789). . Minimum setbacks from the extended property lines aze required. Contact the LMCD for further information. For other Orono lakes, contact the Building & Zoning Department(249-4600). I understand the boat was previously owned by you until a partial ownership was sold to Mr. William Bates. The boat was required to be removed from the property before July 30, 2000 unless the ownership of the boat was determined to be in your name and registration of the boat reflected you as a joint owner.
