Sec.13.04 RIGHTS OF S[JB.TECTS OF DATA -
Subd. 1. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this secaon. �
Subd.2. 7nformation required to be given individual. An individual asked to supply private or confidential data conceming himself
shall be informed of: (a)the purpose affi inunded use of the requested data within the collecting state agency,political subdivision,or statewide
rysum;(b)whether he may refuse or is legally required to supply the requesud data;(c)any lmown consequeace arising from his suppiying or
refusing m supply private or confidenaal data;and(d)the idendry of other persons or entiaes authorized by srate or federal law co receive the data.
Tl�is requirement shall not apply when an individual is asked to supply invesrigadve data,pucsuant to secdon 13.82, subdivision S, to a law
enforcement o�cer.

Subd.3. Access to data by iadividual. Upon request to a responsible authority,an individual shall be informed whether he is the
subject of stored data on individuals,and whether it is classified as public,private or co�denaal. Upon his further request,an individual who
is the subject of stored private or public data on individuals shall be shown the dara without any charge to him and,if he desires,shall be informed
of the content and meanin�of that data. Aher an individual has been shown the private data and informed of its meaning,the data need not be
d'uclosed to him for six months theceaf[er unless a dispute or action pursuant to this secaon is pending or addidonal data on the individual has been
coilecud or created. The responsible authoriry shall provide copies of the private or public dara upon request by the individual subject of the data.
The responsible auehoriry may require ehe requesring pecson to pay the actual cosu of making,certifying,and compiling the copies.
The responcible authority shap comply immediately,if possible,with any request made pursuant to this subdivision,or within five days
of the dau of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with
the request within that time,he shall so inform the individual,and may have an addiaonal five days within which to comply with the request,
excluding Saturdays,Sundays and legal holidays.
Subd.4. Procedure when data is aot accurate or complete. An individua!may concest the accuracy or completeaess of public or
private data concerning himself. To exercise this right,an individual shall notify in wridng the responsible authoriry describing the flature of the
disagreemenG The responsible authoriry shall within 30 days either: (a)correct the dara found to be inaccurate or i�omplete and attempt to nodfy
past recipients of inaccurate or incomplete data,inc(uding recipients named by the individual;or(b)noafy the individual that he believes the data
to be correct. Dara in dispute shall be disclosed oaly if the individual's statement of disagreement is iacluded with the disclosed data.
The determination of the reaponsible authoriry may be appealed pursuant to the provisions of the administrarive procedure act relating
w contesud cases. -
