wHER$AS , Rolla and Nancy Martin (hereinafter "the
applicants") are th� owners of the property located at 2675 Shadywood �
Road within the City of Orono (hereinafter "City" ) and legally
described as fellok��;
Tract A, Registered Land Survey No. 1453 , files of Registrar of
Titles, Hennepin County, Minnesota, (hereinafter "property") ; and
wHERgAS, the applicant has applied to the City for a
variance to Municipal Zoning Code Section 10.22 , Subdivision 2 to
permit the construction of a room addition which will increase hard-

e City Council finds that the conditions existing on this
property are peculiar to it and do not apply generally to other
property in this zoning district; that granting the variance
would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger t� neighboring property; would
not merely :exve as a convenience to the applicant, but is
necessary to alleviate a demonstrable hardship or difficulty; is
necessary to preserve a substantial property right of the
applicant; and would be z:� keeping with the spirit and intent of �
the Zoning Code and Comprehensive Plan of the City.

Dear Mr. Hegeness:
After measuring and adding up the hazdcover on your property, and applying the
surveyors calculations from 1996, it seems your lot has more hardcover than you thought.
Here are the totals according to my calculations:
Gross lot area 29,600
Less neighbor's driveway - 1,800
Net lot azea =27,800
Even before adding in the addition in progress, but with the inclusion of about
700 squaze feet of mulch which is underlain with fabric and/or plastic, your total
haxdcover in the 75' to 250' zone is approximately 7170 square feet
7,170/27,800=25.8 %
where 25% is allowed.
� 27,800 X 25 %=6,950 square feet
By removing the fabric/plastic from under the mulch you could get your total pre-
construction hardcover down to:
7,170—700= 6,470 square feet
Your current addition is 306 squaze feet, resulting in:
6,470 +306=6,776 square feet

This would allow you to build a new deck of:
" 6,950—6,776= 174 squaze feet
If you wish too build more deck than 174 squaze feet(as you have proposed),
either additional existing hazdcover will need to removed,or you will need to have a
variance approved by the City of Orono.
You may want to consider hiring a surveyor to recalculate the hardcover on your
lot. This will certainly be required if you decide to apply for a variance. If you have any
questions regarding these calculations please call me at the office.
