The subject property at 2477 Shadywood Road is zoned B-4, Office and Professional Business
District. Administrative offices are permitted in this district. No exterior display or selling of
merchandise to the general public is allowed in this zoning district (Section 10.43).
When I spoke to Mr. Berney, I understood that he was intending to locate an office at this location.
If he intends to display vehicles either in or outside of the building as indicated on #7, it is not
allowed in the zoning district.
Within the B-4 district,the aggregate square footage of sign space per lot shall not exceed the sum
of one square foot for each front foot of building,plus one squaze foot for each front foot of lot not
occupied by a building. No individual sign shall exceed fifty(50)square feet(Section 10.61, Subd.
3. A).
Signage, however, is a moot point if the business does not comply with zoning.
I signed the application with the above restrictions in mind, based on my conversation with Mr.
Berney. I believe that I was misled about the nature of this proposed business and therefore rescind
my signature from the license application.

I am writing to inform you that Mr. Berney's proposal to lease office space for a used
wholesale car dealership is not in compliance with the zoning code.
The property at 2477 Shadywood Road is zoned B4, Office and Professional District. No
exterior display or selling of inerchandise to the general public is allowed.
Mr. Berney filled out an application for the State of Minnesota indicating that the site has a
display area for at least 5 vehicles. He indicated to me that he has been provided with 5
parking spaces. He told the City that he won't conduct display. However, he indicated on his
license application that he has a display area. Therefore, the City of Orono will not approve
his license.
I have enclosed the section of the Zoning Code that pertains to the B4 District.

The subject property at 2477 Shadywood Road is zoned B4, Office and Professional Business
District. Administrative offices are permitted in this district. No exterior display or selling
of inerchandise to the general public is allowed in this zoning district.
Mr. Berney told me that he would not have a display lot at this location. He later told me
in a phone conversation that he did have 5 parking spaces assigned to his office. These are
the spaces that he informed the State were available for display.
He cannot operate a new or used display or open sales lot at this location. If Mr. Berney
proceeds with his interest to operate a dealership at this location where vehicles are on display,
he will be violating the zoning code. Orono does not provide for new or used car dealerships
in any zoning district.
I therefore, rescind my signature on this application because I have been informed that the
licensing category he has applied for includes display.
I have attached last year's application which shows that he did not complete some of the
sections which referred to retail sales. He also indicated it was for wholesale. It is clear now
that he changed his licensing category.

§ 10 .61
Subd. 2. Signs in "R" Districts. Within "R" r�istricts,
the following signs are permitted:
A. Nameplates .
1. One nameplate sign for each dwelling and
such sign shall not exceed two square feet in area per surface, and
no sign shall be so constructed as to have more than two surfaces.
2. One nameplate sign for each dwelling group
of six or more units, and such sign shall not exceed six square
feet in area per surface and no sign shall be so constructed as to
have more than two surfaces.
3. One nameplate sign for each permitted use
or use by conditional permit other than residential and such sign
shall not exceed twelve square feet in area per surface.
B. Illumination. Symbols, statues, sculptures and
integrated architectural features on non-residential buildings may
be illuminated by flood lights provided the direct source of light
is not visible from the public right-of-way or adjacent residential
district.
C. Setbacks, Etc. Any sign over one-half square
foot shall be set back at least five feet from any property line.
No sign shall exceed eight feet in height above the average grade
level. Signs may be illuminated but such lighting shall be
diffused or indirect.
Subd. 3. Signs in "B" anc� •"I" Districts, Within the "B"
and "I" Districts nameplate signs and business signs are permitted
subject to the following regulations:

art institutes, galleries and playhouses.
H. Restaurants (Class I) . Restaurants which are
located within and mainly servicing an office building oroviding
there is no outside display or advertising of the restaurant use .
I. Parking. Off-street parking when the principal
site of the off-street parking abuts on a lot which is in another
"B" or "I" District and is in the same ownership as the land in the
"B" or "I" District and subject to those conditions as set forth in
Section 10.61, Subdivision 4 and other such conditions as found
necessarv by the Council .
J. Public Services. Public service structures, including, but not limited to, e s
inclu� electrical transmission lines and buildings such as telephone exchange and
b u i 1 d stations,booster or pressure stations,elevated tanks, lift stations and electric ,u r e
s t a t i power substations. Personal�,vireless services and coinmercial broadcastin� w e r
s ub s t antennas and towers shall not be considered essential services.
Subd. 5. Accessory Uses. Within any "B-4" Office and
Professional Business District, the following uses shall be
permitted accessory uses:
A. Any accessory use as regulated in the "B-1"
District.
Subd. 6. Area, Height, Lot Width, Yard, Setback and
Design Requirements.
A. Area. The minimum lot size shall be 20 ,000
square feet.
B. Lot Width. The minimum lot width shall be 100
feet.
C. Front Yards. The minimum front yard shall be 20
feet.
D. Rear Yards. The minimum rear yard shall be 30
feet and unless the rear yard has access from a public street or
alley, a side driveway of 12 feet shall be provided to assure
access,

E. Setback Requirements. No building shall be
nearer than 35 feet to any front lot line, 35 feet to any rear lot
line, 15 feet to any side lot line, 35 feet to any side lot line
adjacent to street; except when abutting or across the street from
an "R" District, no building shall be less than 35 feet from such
lot line.
F. Fencing. Wherever a "B-4 " Office and
Professional Business District abuts an "R" District along the side
or rear lot line, a fence or compact evergreen hedge not less than
50� opaque nor less than six feet in height (no less than three
feet nor higher than four feet adjacent to street) shall be erected
along the abutting lines except within the required front yard.
G. Building Design and Construction. See Section
10.40 , Subdivision 6, Subparagraph G.
H. Drainage. No land shall be developed and no use
shall be permitted that results in water runoff causing floods,
erosion, or deposits on adjacent properties. Site and drainage
plans shall be submitted by the applicant in such detail as
required by the Council and those plans shall be reviewed by the
City Engineer before submission to the Planning Com mission and
Council for approval. Such runoff may be required to be properly
channeled into a natural water course, ponding area, storm drain or
other public facilities. Any change in grade affecting water
runoff whether onto adjacent property or otherwise must be in
compliance with the Surface Water Management Plan and shall be
consistent with other applicable regulations or City Code
provisions and subject to the approval of other agencies having
jurisdiction over the area affected by the drainage.
I. Height. No structure or building shall exceed
2-1/2 stories or thirty feet in height except as provided in
Section 10 .75.
SBC. 10.44. B-5 LIMITSD NEIGHBORHOOD BQSIN$SS DISTRICT.
Subd. 1. Purpose. The "B-5" Limited Neighborhood
Business District is intended to provide a district for businesses
that supply commodities or perform a service primarily for
residents in the surrounding neighborhood, which businesses are not
high traffic generators and do not necessitate an inordinate amount
of hardcover. The district may adjoin residential districts or
other business districts which are subject to more restrictive
controls. The district shall have immediate access to adequate
highways and public sanitary sewer. Because of the location of the
"B-5" District as contemplated in the area known as Navarre in the
City, the uses are limited in order to limit the hardcover in that
area and to limit the future generation of traffic for that
property in that use district since there is already a traffic
problem in Navarre.

the location of administrative office buildings and related
offices. The office uses allowed in this district are those in
which there is limited contact with the public and no exterior
display or selling of inerchandise to the general public. The
district shall have im mediate access to adequate highways and
public sanitary sewer .
Subd. 2. Application. All applications for a building
permit in any "B-4" Office and Professional District shall be
reviewed by the Council and may be referred to the Planning
Commission for review.
Subd. 3. Permitted Uses. Within any "B-4" Off ice and
Professional Business District, no structure or land shall be used
except for one or more of the following uses:
A. Municipal Buildings. Municipal buildings where
the use conducted is customarily considered to be an office use.
B. Offices. Professional offices and offices of
the general nature.
C. Clinics, Clinics for human care on an out-
patient basis only.
D. Banks and Insurance Offices.
Subd. 4. Conditional Uses. Within the "B-4" Office and
Professional Business District no structure or land shall be used
for the following uses except by conditional use permit:
A. Nursing Homes, Hospitals. Nursing homes,
hospitals, rest homes or retirement homes, provided the site shall
contain not less than 600 square feet of lot area for each person
to be accom modated and that no building be located less than 35
feet from the side lot line .
