A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTIONS 78-736 AND 78-1288 AND AN AMENDMENT TO RESOLUTION NO. 4674 FOR A CONDITIONAL USE PERMIT �PURSUANT TO MUNICIPAL ZONING CODE SECTION 78-734(11) FILE NO. 09-3405 � �� : O O - C ITY of ORONO ,� ;. � ti � ��� �p~' RESOLUTION OF THE CITY COUNCIL �kESII�4 NO. �� �i O A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTIONS 78-736 AND 78-1288 AND AN AMENDMENT TO RESOLUTION NO. 4674 FOR A CONDITIONAL USE PERMIT PURSUANT TO MUNICIPAL ZONING CODE SECTION 78-734(11) FILE NO. 09-3405 WHEREAS, International Minesterial Fellowship, a Minnesota non- profit corporation, (hereinafter "Owner") is the owner of the property located at 2477 Shadywood Road within the City of Orono (hereinafter "City") and legally described as: Tract A and B, Registered Land Survey No. 88, files of the Registrar of Titles, Hennepin County, Minnesota(hereinafter "the Property"); and WHEREAS, Frank Masserano III has made application on behalf of the Owner to the City for a revision to the conditional use permit for a place of worship approved by Resolution No. 4674 for a place of worship to allow construction of a 22-foot by 45-foot entry deck; and WHEREAS, Frank Masserano III has made application on behalf of the Owner to the City for a Variance to Municipal Zoning Code Section 78-1288 to allow 44.25% hardcover within the 500'-1000' setback zone where 35% is normally allowed and 45.9% currently exists in order to construct a deck, rearrange portions of the existing drive and parking lot, and construct an entrance addition; and WHEREAS, Frank Masserano III has made application on behalf of the Owner to the City for a Variance to Municipal Zoning Code Section 78-734(11) to allow this deck to be constructed 30 feet from the property line when a 50 foot setback is required; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on October 19, 2009, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File#09-3405. 2. The Property is located in the B-4 zoning district. 3. The Planning Commission reviewed this application on October 19, 2009 and on a vote of 6 - 0 recommended approval of the conditional use permit revision and variznce, based on the following findings: a. The proposed deck for access and gathering is reasonable and customary. b. The design of the deck is compatible with the building and surrounding residential area. c. If this portion of the building were used for office purposes the deck could be located as close as 35 feet from the rear property line. d. There are a number of trees screening the deck from the adjacent properties. e. The Owner has agreed to plant additional evergreen trees in order to screen the southern portion of the parking lot from adjacent residential properties. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicant and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that �-anting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Owner but necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial Page 2 of 5 � �� O O CITY of ORONO � ,� ;.. � ti ��� p~' RESOLUTION OF THE CITY COUNCI L �kESH.Og'� NO. ; n n ;� property right of the Owner; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-734(11) to allow construction of a 22-foot by45 foot deck with a 30-foot setback from the rear property line where a 50-foot setback is normally required for church structures; a variance to Municipal Zoning Code Section 78-1288 to allow 44.25% hardcover within the 500'-1000' setback zone where 35% is normally allowed and 45.9% currently exists in order to construct a deck, rearrange portions of the existing drive and parking lot, and construct an entrance addition; and a revision to the conditional use permit for a place of worship approved by Resolution No. 4674 for a conditional use permit to construct the deck, subject to the following conditions: l. Council approval is based on the site plan, building plans, and landscape plans submitted by the Owner and annotated by City staff, attached to this Resolution as Exhibits A, B & C. Any amendments to these plans may require further Planning Commission and City Council review. 2. Hardcover in the 500'-1000' zone shall be limited to 15,153 s.f. or 44.25°/o per the proposed plan and hardcover allowance summary as depicted on Exhibit A. Owner is advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. 3. Owner shall implement the landscape plan (Exhibit C) prior to the final inspection or first use of the deck and/or entrance addition. Should weather conditions prohibit implementation of the landscape plan a financial guarantee in the form of an escrow shall be required. 4. Authorities granted by this resolution run with the Property not with the owner, but are permissive only and must be exercised by obtaining a building permit for the new construction before November 9, 2010 or the conditional use permit revision and variance will expire on that date. All other findings and conditions of Resolution No. 4674 remain unchanged and valid. 6. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 7. The undersigned Owner has read, understood and hereby agrees to the terms of this resolution and on behalf of its successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property.
