I �o�l�og A RESOLUTION GRANTING VARIANCES TO THE ORONO,MINNESOTA, CITY CODE SECTIONS 78-736 AND 78-1435 AND REVISING RESOLUTION NO. 5880 FILE NO. 10-3469 � a / >' d� � � , F, fr !� fi r f� �� � f � rf .V. #.. af i S p� 7 ��� �� � ��� ��. !A s � o� 0 0 � CITY of ORONO � � :.. � ti ti RESOLUTION OF THE CITY COUNCIL ��`9k'ESYi�g'�G NO. � 9 Q tl A RESOLUTION GRANTING VARIANCES TO THE ORONO,MINNESOTA, CITY CODE SECTIONS 78-736 AND 78-1435 AND REVISING RESOLUTION NO. 5880 FILE NO. 10-3469 WHEREAS, InternaHonal Ministerial Fellowship, a Minnesota non-profit corporation, (hereinafter "Owner") is the owner of the property located at 2477 Shadywood Road within the City of Orono (hereinafter "City") and legally described as: Tracts A and B, Registered Land Survey No. 88, files of the Registrar of Titles, Hennepin County, Minnesota (hereinafter "the Property"); and WHEREAS, on July 23, 2001 the City Council of the City of Orono approved Resolution No. 4674 granting a conditional use permit to allow use of part of the property as a church, and on November 9, 2009 the City Council approved Resolution No. 5880 revising the site and building plans approved as part of Resolution No. 4674. WHEREAS, Frank Masserano III has made application on behalf of the Owner to the City for a variance to Orono Code Section 78-1435 to allow placement of an accessory building to house trash and recycling containers closer to the street than the principal building; and WHEREAS, Frank Masserano III has made application on behalf of the Owner to the City for a Variance to Orono Code Section 78-736(e) to allow placement of this accessory building 7 feet from the southeasterly property line when a 15-foot setback is required; and WHEREAS, Frank Masserano III has made application on behalf of the Owner to amend the site and building plans attached to Resolution No. 5880 to include this accessory building; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on June 21, 2010 at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. This application was reviewed as Zoning File#10-3469. 2. T'he Property is located in the B-4 zoning district. 3. Orono Code Section 78-1578 requires an enclosure for trash conta.iners for non-residential uses unless the containers are kept inside the principal building. : 4. The Planning Commission reviewed this application on June 21, 2010 and on a vote of 5 - 0 recommended approval of the setback variances and conditional use permit revision, based on the following fmdings: a. The proposed building will be located 85 feet from Shadywood Road. The minimum setback for a principal building is 35 feet. It will be screened by a berm and trees along Shadywood Road and trees along the southeast property line. Its design is compatible with the principal building. Its decorative block and stucco walls and standing seam metal roof will help ensure it remains in good condition. b. The previously approved location for a trash and recycling enclosure is between the principal building and the southeast property line. It does not comply with either the structure to structure setback or the lot line setback. That location would not accommodate all the trash and recycling conta.iners the offices and church require. At its proposed location the accessory building will still be convenient to the service area of the principal building, facilita.ting trash removal and recycling. c. A location in compliance with all setback requirements would place the building near the house on the residential property that adjoins the rear of the Property. Without restrictions that would be difficult to enforce, the use and servicing of the trash and recycling conta.iners would disturb the residents of the adjacent property to the rear. 5. The City Council has considered this application including the findings and Page 2 of 4 �o� 0 0 � CITY of ORONO � : � ti ti RESOLUTION OF THE�IQY�4 UNCIL ���k'ESI3�g'�G NO. recommenda.tion of the Planning Commission, reports by City staff, comments by the applicant and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 6. The CiTy Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect tr�c conditions, light, air nor pose a fire hazazd or other danger to neighboring property; would not merely serve as a convenience to the Owner but necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the Owner; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. The City Council also finds that the change to the site plan for the conditiona.l use permit is not inconsistent with Orono Code Section 78- 916(a). CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a variance to Orono Code Section 78-1435 to allow construction of an accessory building, for storage of trash and recycling containers only, closer to the front lot line than the principal structure, grants a variance to Orono Code Section 78-736(e) to allow the accessory structure a seven-foot setback from the southeasterly property line when a 15-foot setback is required, and approves a revision to the site plan and building plans attached to Resolution No. 5880 to add the accessory building as shown on the attached Exhibit A to Exhibit A of Resolution No. 5880 and to add the building plans attached as Exhibit B to Exhibit B of Resolution No. 5880. Resolution No. 5880 otherwise remains in effect. 1. Authorities granted by this resolution run with the Property not with the owner, but are permissive only and must be exercised by obtaining a building permit for the new construction before June 28, 2011 or the approvals will expire on that date. 2. The variances remain in effect, even if the conditional use permit for a church lapses, until the principal building is replaced by a different building or until the principal building or this accessory building is removed and not replaced within 6 months of removal. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned Owner has read, understood and hereby agrees to the terms of this resolution and on behalf of its successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property.
