Staff observed the lighting on <br /> the building and noted that the fixtures do not offer any shielding of the light source. The lighting is <br /> excessivety bright and is directed off of the property. It appears to violate City Code section 78-1573 <br /> (below). Further, the lighting appears to be a nuisance to neighboring property owners and a potential <br /> hazard to drivers. <br /> City Code Section 78-1573 states: <br /> "Any use requiring an operation producing an intense heat or light transmission shal/be performed with <br /> the necessary shie/ding to prevent such heat or light from being detectable at the /ot line of the site on <br /> which the use is located. Lighting in al/instances shall be diffused or directed away from R districts and <br /> public streets" <br /> This letter will serve as your notice that the lighting on the property must be brought into <br /> conformance with City Code Section 78-1573 on or before December 6, 2010 in order to avoid <br /> legal action by the City. In order to comply with Section 78-1573 new fixtures must be installed or the <br /> existing exterior light fixtures on your property must be modified to direct the light downward, and to <br /> shield the light source so as not to be detected from the property line. I have attached an information <br /> sheet from the International Dark Sky Association (IDSA) regarding types of acceptable fixtures. A link <br /> to acceptable lighting fixtures can be found by accessing IDSA's website at www.darksky.org . <br /> Please be advised, if you fail to correct the violations this matter will be sent to the City Attorney for <br /> consideration of legal action.
