We met recently regarding the two Delaney properties one with no address assigned (PID 20-117-23-11-0032) and one
addressed 2465 Shadywood Road. You inquired whether the City would allow the property without an address access off
of Kelly Avenue when/if it is developed in the future. Subject to the performance standards regarding driveways, the City
will allow the property without an address access off of Kelly Avenue. Because there are wetlands along the Kelly Avenue
frontage permits for wetland filling or alteration would likely be required from the City and from the Minnehaha Creek
Watershed District.

TH$ FOLLOFTING ZTB!!S are to be completed before the inspector arrines (If insp ector has to

inspection):
1. Street address must be posted and visible from the street. Where more than one house
is served by the same private driveway or unnamed private road, additional sets of
numbers shall be placed at every fork or other driveway as necessary to direct
traffic to every house including the house farthest from the street.
2. Burn pile must be stacked at burn site meeting the following:
- Minimum 50' from buildinqs
- Wood and paper products only
- 8' maximum diameter, 4 high maximum
3. Draw a map on back side of permit application locating the burn pile.
4. If these conditions are not met, the permit will be denied and you may not apply for
another permit for 30 days.
5. Read all conditions on backside of permit before burning. Violations of these
conditions may result in the issuance of citations and permit may be revoked.
ALL SITES WILL BE INSP$CTED before issuance of burning permit, subject to
avai labi lity of staf f time.

This permit is limited to the foI.lowing conditions:
1. Fire must be attended at aIl times.
2. Provide water supply to burning site.
3. The prevailing wind at the time of the burning shal 1 be away from
nearby residences.
4. The burning shall be conducted as far away from any highway or public
road and controlled so that a traffic hazard is not created.
6. The location of the burning shall be conducted not Iess than 50 feet
from any structure and adequate provision is made to prevent fire from
spreading to within 50 feet of any structure. If the fire is contained in
an approved waste burner it may be Iocated safely not Iess than 15 feet
from any structure and fire extinguishing equipment readily available for
use.
7. If burning of a superstructure occurs within 600 feet from an occupied
residence other than those located on the property, applicant must receive
permission from all residents within 600 feet.
8. Oils, rubber and other smoke producing materials shall not be burned or
used as starting materials.
9. Any fire allowed by this permit shall. be extinguished within four (4 )
hours of a public announcement by the Minnesota Pollution Control Agency
that an air polSution alert, warning or emergency exists. Such burning
shal.I cease until a similar public announcement terminating the alert,
warning or.' emergency is issued.

10. This permit is subject to revocation at the discretion of the local
police department or the permit issuer if:
a) a reasonable, practical alternate method of disposal of the
materia]. exists;
b) a fire hazard exists or develops during the course of the burning;
and
c) any of the conditions of the permit are violated during the course
of the burning.
11. Other reasonable conditions the permit issuing authority may impose.

NOTICy OF HEARING ON PROPOSED ASSESSMENT
TO WHOM IT MAY CONCERN:
Notice is here'oy given that the Council will meet at
7 : 00 p.m. on Monday, August 28, 1989, at the Council Chamoers of
the City of Orono, 1275 Brown Road South, to pass upon the
proposed assessment for street lighting improvement on County
Road 15. The following is the area proposed to be assessed:
The South 1/2 Section 17, Township 117, Range 23
and the North 1/2 Section 20, Township 117, Range
23 and in particular all property abutting County
Road 15 (Shoreline Drive) beginning at the western
border of Orono then easterly to a distance 320
feet east of County Road 15 (Shadywood Road) all
property abutting County Road I9 (Shadywood Road)
563 feet north of County Road 15 (Shoreline Drive)
and 622 feet south of County Road 15 (Shoreline
Drive) .
The amount to be specially assessed against your particular lot,
piece, or parcel of land is $ 2 , 828 . 00 You may at
anytime prior to certification of the assessment to the county
auditor, pay the entire assessment of such property with interest
to the date of payment, to the City of Orono. No interest shall
be charged if the entire assessment is paid within 30 days from
the adoption of this assessment. You may at any time thereafter ,
pay to the City the entire amount of the assessment remaining
unpaid, with interest accrued to December 31 of the year in which
such payment is made. Such payment must be made before November
15 or interest will be charged through December 31 of the
succeeding year. If you decide not to prepay the assessment
before the date given above the rate of interest that will apply
is 8 percent per year. The right to partially prepay the
assessment is not available.

ASSESSING
The proposed assessment rol 1 is on file for public inspection at
the City Clerk's office. The total amount of the proposed
assessment is $118,040.94. Written and oral objections will be
considered at the meeting. No appeal may be taken as to the
amount of an assessment unless a signed, written objection is
filed with the clerk prior to the hearing or presented to the
presiding officer at the hearing. The council may upon such
notice consider any objection to the amount of a proposed
individual assessment at an adjourned meeting upon such further
notice to the affected property owners as it deems advisable.
If an assessment is contested or there is an adjourned hearing,
the following procedure will be followed:
1 . The city wil 1 present its case first by cal ling witnesses who
may testify by narrative or by examination, and by the
introduction of exhibits. After each witness has testified,
the contesting party will be allowed to ask questions. The
procedure wil 1 be repeated with each witne�s until neither
side has further questions .
2. After the city has presented all its evidence, the objector
may call witnesses or present such testimony as the objector
desires. The same procedure for questioning of the city's
witnesses will be followed with the objector's witnesses.
3. The objector may be represented by counsel .
4. Minnesota rules of evidence will not be strictly applied;
however, they may be considered and argued to the council as
to the weight of items of evidence or testimony presented to
the council .
5. The entire proceedings will be tape-recorded.
6. At the close of presentation of evidence, the objector may
make a final presentation to the council based on the
evidence and the law. No new evidence may be presented at
this point.
An owner may appeal an assessment to district court pursuant to
Minnesota Statutes Section 429.081 by serving notice of the
appeal upon the mayor or clerk of the city within 30 days after
the adoption of the assessment and filing such notice with the
district court within ten days after ser.vice upon the mayor
or clerk.
Under Minnesota Statutes, Sections 435.193 to 435.195, the
council may, in its discretion, defer the payment of this special
assessment for any homestead property owner by a person 65 years
of age or older for whom it would be a hardship to make the
payments. When deferement of the special assessment has been
granted and is terminated for any reason provided in that law,
all amounts come due. Any assessed property owner meeting the
requirements of this law and the ordinance adopted under it may,
within 30 days of the confirmation of the assessment, apply to
the city clerk for the prescribed form for such deferral of
payment of this special assessment on his property.
