Sec.13.04 RIGH'I'S OF SUBJECTS OF DATA
Subd. 1. Type oE'data. The righrs of individual on whom�e data is s[ored or�o be stored shall be as set forth in this secrion.
Subd.2. Information required to be given individual. ?.n individual asked to supply private or confidential data conceming himself shall
be informed of: (a) the purpose and intended use of the requested data within the collecRng'sta[e agency, poliUcal subdivision,or statewide system;
(b)whether he may refuse or is legally required to supply the requested data;(c)any known consequence arising from his supplying or refusing to supply
privare or co�denrial data;and(d)the idencity of other persons or entides aurhorized by state or federal law to receive the data. This requirement shall
not apply when an individual is asked to supply invesdgadve dan, pursuanc to secdon 13.82, subdivision 5, to a law enforcemenc officer.
The commissioner of re�enue mav place the nodce reauired under this subdivision in the individual income tax or propertv tax refund
instructions instead of on[hose forms.
Subd. 3. Access to data b�individual. Upon request to a responsible authority,an individual shall be informed whether he is the subject
of stored data on individuals, and whe[her it is classified as public, private or confidenaal. Upon his further request, an individual who is the subjec[
of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content
and meaning of[hat data. After an individual has been shown the private data and informed of its meaning,the data need not be disclosed to hirn for
six months thereafter unless a dispute or acrion pursuan[to [his secaon is pending or addiaonal data on the individual has been collected or crea[ed.
The responsible authoriry shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority
may require che requesting person to pay the actual costs of makine, certifying, and compiling the copies.
The responsible authoriry shall comply immediately, if possibie, with any request made pursuant to[his subdivision, or within five days of
the date of the request,excluding Sa[urdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comp(y wi[h the request
within that time,he shall so inform the individual,and may have an addidonal five days wirhin which to comply with the request,excluding Saturdays,
Sundays and legal holidays.
Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private
data conceming himself. To exercise this right,an individual shall notify in writing the responsible authoriry describing the nature of the disagreement.
The responsib(e authoriry shall within 30 days either: (a)correct the data found to be inaccurate or incomple[e and attempt to nodfy past recipients of
inaccurate or incomplete data, including recipients named by [he individual; or(b)notify the individual that he believes the data to be correct. Data
in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data.
The determination of the responsible authoriry may be appealed pursuant to the provisions of Ihe administrative procedure act reladng to
contested cases.

Read the following information before completing the application for exemption from the property taz of
improvements made to homes 35 years of a;e or older.
Minnesota law encourages property o«�ners to rescore or renovate their older homes. This law, commonly referred to as
"This Old House" exempts from the property ta.Y all or a portion of the value of improvemenu made to homes 35 yeazs of
age or older.

In order to be eligible for exemption,the property must meet the follo�ving three criteria:
1. Property must be 35 years of age or oider at the time the improvements commence.
2. Property musc be receiving the homestead classification. This includes property classified as residential homestead
(including duplexes and tripleses)blind/paraplegic veteran/disabled homestead and agricultural homestead. Relative
homesteads are eligible for the exemption.
3. The total mazket value of the property must be less than�1�0,000 (residential: land and buildings; agricultural:
house/gazage/1 acre). In special circumstances, a property��ith a total market value of$1�0,000 or more but less t3�
$300,000 may qualify for the eYemption. In these instances,your assessor��ill help you determine if your property is
eligible for the e�emption. Properties with a total market value of$300,000 or more do not qualify for the exemptioa
If your propem� is a condominium and}�our living unit is receiving the homestead classification, anv improvemenu ma�e
to the unit would qualify for the exemption. Improvements to common areas are not eligible. If your property is a duplez
or triplex and it is receiving the homestead classification, improvements made to am•portion of the property qualify for the
e:cemption from the property tas. If vour propem•is used as a homestead and for a non-residential use,the eYemption
applies only to improvements made to the residential portion of the property receiving the homestead classification. For
e:cample, if your property is used both for a residence and for a business, the e�emption applies only to the improvements
made to the homesteaded residential portion of your propem�.

Only improvemenu that contribute a minimum value of�1,000 or more to the house or garage of a property classed as
homestead during the year of the improvement qualifi�for the esemption from the property tax. This includes improvemeats
such as additions to the existing house and garage. eYpansion of the eYisting house and garage, restoring, remodeling or
upgrading of the esisting house, addition of a porch or deck or construction of a ne�v garage. Please note that the area

Improvements made to the site surrounding the home do not qualifi�for esemption. This includes such improvements to the
site as: eonstruction of a fence, construction of a drive��a��,installation of a la�vn sprinkler system, installation of a
swirnming pooI or tennis court, landscaping of the grounds,agricultural buildings.
If more than 50 percent of the square foota;e of a house is torn down or razed,the original house is deemed to no
longer exist, and any subsequent improvements made to the remaining structure are considered to constitute the construction
of a new house. ?►s a result,the value of any improvements�vould not qualify for exemption. •
If any combination of improvements double the original size of the structure, anv improvement that further increases t�e
size of the structure will not qualify for eYemption.

There is a limit to the dollar value of the improvement which may be exempted. The limit depends on the age of the
property. Houses that are less than 3�years of age do not qualify. Houses that are at least 35 years of ase but less
than 70 years are limited to one-half of the value of the improvement up to a ma�imum exemption of�2�,000. Houses
that are 70 years of age or older are eli�ible to have the total value of any improvements esempted up to a ma.Yimum of
��0,000. The aae of the house is based upon the number of years that the qualifying residence has e:cisted on its preseat
site.

Although the cost of improvements may be substantial, the actua! va3ue added can be significantly less. This can be largely
attributed to three factors:
• Often times, improvements made to a house,particularly an older house, constitute routine maintenance.and do not
cause the valuation to increase. Reshingling a roof, painting the house, repairing a foundation, replacing a plumbing
fixture are all examples of improvements that would not ordinarily result in a value increase.
• Improvements made to an individual's home often times reflect that particular individual's personal likes or interesu and
mosc times the cost cannot be recovered when a property is sold. Adding a sauna, a greenhouse or an indoor swimming
pooi would all be exarnples of improvements that typically add less value than their cost.
• Improvements made to different areas of a house typically result in greater or lesser returns. It is a well established
appraisal principal that remodeling or improving a house's service areas (kitchen, laundry and bathroom)will genera.11y
yield the greatest return to the owner. Expenditures such as finishing basements or attics will generaIly produce the
smallest return.
Although these considerations may vary from house to house and market to market, in almost no instance is it possible to
receive a dollaz for dollar return benve�n cost and value added to the house.

nder the law, a property owner must disclose to prospective buyers whether any improvements made to a home are
eaempt from the property tax. Additionally, sellers are also required to notify buyers that the exemption will
terminate when the property is sold.
If you sell your property, only improvements made b�r the buyer afrer the closing da,te of the sale are eligible for the
exemption.
If the property loses its homestead status the esemption expires as of the nett assessment date.
If the name of one of the owners of the property is removed from the title to the property as a result of a separation or
divorce, or if a name is added to the tit�e of the property as a result of a marriage, the improvements continue to qvalifi�
for the eYemption.
If you transfer the title to the property to someone etse, but retain a life estate in and continue to receive the homestead
classification on the property,the improvemenu continue to qualif}�for the esemption. If you transfer title to a related
person or persons as a gift or inheritance, the e�emption e�pires as of the ne�ct assessment date. .
In general,as lon�as you,the owner of the homestead, made the improvements to the house; maintain the property as your
principal residence and retain an o�z�nership interest or control of the property,the improvements continue to qualify for the
esemption.

If vou liv_e in a citv or to�c�n that reauires buiIding ermits, you must obtain a building permit for construction of the
unprovement before the work commences. In addition you must complete a separate application for value exemption before
the next assessment date. If you do not obtain a building permit before construction begins,the improvements are not
eligible for exemption.
If vou live in a citv or_town that does not reauire building permiu, you must make application for e�emption before the
unprovement is begun.
The exemption may be applied to no more than three separate improvements made to the house and garage. All
improvements lisied on a single building permit or an application for the eYemption constitute a single improvement.
In either case. if more than three separate improvements are planned you must choose�rhich improvements you want to
qualify for the esemption. •
Once an improvement has been designated for e�emption, it cannot be repealed or replaced by a later improvement.
