Dear Mr . Kearns:
As you are aware the City of Orono has for some time now been working
with the abutting landowners north of your property (Richard Raiche,
etal) to clear up tax parcel and title problems between them and the
' City. We also discovered a "gap" in the legal descriptions between
your property and theirs which needed your review.
The Raiche property is now owned by Stephen and Suzanne Schmidt. Mr. •
Raiche, the Schmidts and the City are now completing an agreement to
resolve our differences. At the time we do that, we would also like
to clear up two related questions which� will need your assistance.
Please refer to the attached colored map, specifically those areas
marked as parcels #4 and �5 .
Parcel �4 is a "gap" between the Union Oil property anc� the Rudh-Ulrick..�
property to the west. There is a recorded driveway easement to the City
over the east 7� ft. of the Rudh-Ulrick property, and over the west 7� ft.
of the Union Oil property (see your attached title insurance description,
schedule B item� �7 as sent to me on 9-15-81) . We would ask that you
� agree to quit claim deed this gap area to the City so as to ensure good
title to the City for the entire public driveway. The City is also
receivinq identical quit clai.m deeds for this same area from both Rudh-
Ulrick and Raiche-Schmidt.
Parcel #5 is the "gap" between the Union Oil and Raiche-Schmidt property.
This area has been and is still included in the tax parcel description of

the Raiche-Schmidt property. As per your 9-20-82 letter to Mr. Raiche
(attached) , you have agreed that this area is not clai.med by Union 0i1.
Therefore we ask that you agree to quit claim deed this gap area to
Schmidt.
We have enclosed two quit c�.aim deeds for the above parcels �4 and �5
which we ask that you execute and return to my office for recording at
your earliest convenience.

I am pleased to f inall.y have eompleted the enclosed paperwork necessary
to implement the parking lot agreement as discussed at ouic meeting of
January 13, 1983.
For the record, it is the understand3.ng of the City that we will settle
our conflicting interest by agreeing to the following actions (tefer to
the attached drawing for parcel locations) :
A. You and others having interest in the chain o� title will
deed to the City the �entire area now used as public parking
lot, including: ,
1) Parcel �1; The area originally warrant�e deeded to the
City, and still shown as a City-owr►ed tax parcel.
2) Parcel �2; The area now included in Rudh-Ulrick's tax
deseription. ,
3) Parce7. #3; The area originally leased to the City and �
sti11 in active use for the through alleyway.
H. In return €or the above, the City wi11 approve rear-setbaak
and on-site parking variances such that your remai.ning property
wil]. be able to be developed to the same (or greatery maximum
density as if the entire torrens parcel were available for
development without con€licting City interest.
C. The City will assist in having Union Oil deed to you the
"gap" area �Parcel �5) iying south of your torrens description,
but a�ready incl.uded in your tax descriptian.
D. As a • f inal .�learing of interests, the City will seek quit claim

, � , E. The City agreed to assume costs of preparing the �develapment
praposal sketches, deeds, and variance resolutions, and to
do the actual recording of all documents. The City would
accept the above deeds in the form of a "qift" if you chose
to view them as such �for tax purposes. However, the City
wi13. not agree, as you asked today, to pay for an appraisal
to assist in detezmining value for such ta►x purposes.

potential of the torrens property as is, with and without
the proposed agreement.

By 3chmidt: 4 Quit �laim Deeds to City of Orono for Parcels 1,2,3 &4 .
By Raiche: 4 �uit C1aim Deeds to City of Orono for any interest in
parcels 1,2,3 & 4.
By Lovgreen(?) :4 (blank) Quit Claim Deeds to City of Orono for any
interest on parcels 1,2,3 & 4.

If thexe are any other unrecorded contract for deed or mortgage interests,
thase Qersons must also quit claim their interest to the City of Orono.
A1so required from Douctherty is their Owner' s certificate of Title
iduplicate) as mailed to them by Hennepin County on March 9, 1983, so that
these deeds may be recorded.
Also attached are three original copies of the proposed Variance aptaroval
resolution which must all be si ned {and notarized) b both Dou hert and
Sc a. t, an t en retur�ed or City sa�gnature.

As soon as all the above are executed and returned to the City, the
Variance Resolution will be placed on the next City Council Agenda
for adoption and then the Variance and all deeds will be recorded
by the City Attorney' s office. As soon as recording i� accomplished,
the City will then instruct the County Asate�sor to co=rect the pl�t
maps and tax records accordinq to these descriptions.
This has been a long and complicated situat�.on. I would hope that the
final szgnatures and agreement can now be completed in short order.
