Kearns: As you are aware the City of Orono has for some time now been working with the abutting landowners north of your property (Richard Raiche, etal) to clear up tax parcel and title problems between them and the ' City. We also discovered a "gap" in the legal descriptions between your property and theirs which needed your review. The Raiche property is now owned by Stephen and Suzanne Schmidt. Mr. • Raiche, the Schmidts and the City are now completing an agreement to resolve our differences. At the time we do that, we would also like to clear up two related questions which� will need your assistance. Please refer to the attached colored map, specifically those areas marked as parcels #4 and �5 . Parcel �4 is a "gap" between the Union Oil property anc� the Rudh-Ulrick..� property to the west. There is a recorded driveway easement to the City over the east 7� ft. of the Rudh-Ulrick property, and over the west 7� ft. of the Union Oil property (see your attached title insurance description, schedule B item� �7 as sent to me on 9-15-81) . We would ask that you � agree to quit claim deed this gap area to the City so as to ensure good title to the City for the entire public driveway. The City is also receivinq identical quit clai.m deeds for this same area from both Rudh- Ulrick and Raiche-Schmidt. Parcel #5 is the "gap" between the Union Oil and Raiche-Schmidt property. The City would accept the above deeds in the form of a "qift" if you chose to view them as such �for tax purposes. However, the City wi13. not agree, as you asked today, to pay for an appraisal to assist in detezmining value for such ta►x purposes. ATTACHED for your information: 1. As soon as recording i� accomplished, the City will then instruct the County Asate�sor to co=rect the pl�t maps and tax records accordinq to these descriptions.
