I would first like to inform you that your attorney is wrong about needing a search warrant to enter on to the property. If the ordinance violations are in plain site a warrant is not required. The junk computers and other debris on the property are visible from the road and adjoining properties. I would also like to inform you that the City of Orono has the legal right to enter on to the property and correct the violations and the costs to do so will be assessed to your taxes (city code 58-1(c)). Those costs will be certified to the County Auditor and collected in a similar manner as a special assessments to your taxes. I need to hear from you by Apri17, 2006 as to the progress of the clean-up and arrange a time to meet on the property and discuss final clean-up and a time frame. If I do not hear from you by then,the necessary steps will be taken to have the property cleaned up and assessed to you. I would like to take this opportunity to thank you for the progress you have made in the effort to clean-up the property. I must know inform you that I have received additional complaints, from multiple complainants concerning the remaining materials stored outdoors. I have been further informed that the complainants will not let this matter drop this time until all materials,junk, household,unlicensed/inoperable vehicles,have been removed from the property. I do not cherish the prospect of having the City contract with an outside company to come in and abate the property. It frankly ends up being a lot of work and time for the City, at a time of the year when this office is extremely busy with inspections and the up coming election. In addition an abatement will cost you a large amount of money assessed to yol�r property for something that you may not want to do, but are certainly capable of doing. The abatement bill not only includes the company that does the work but also disposal costs, the time the City has invested and the City Attorneys time as well. Please have the offending materials removed from the property or properly stored in an enclosed building by November 9, 2006. Staff is once again receiving numerous complaints about the unlicensed inoperable vehicles, bags and boxes of garbage, containers,junk appliances such as air conditioners, containers with liquid content, lawn equipment, scrap or junk building materials and other miscellaneous junk and debris. Staff inspected and photographed the violations on April 13, 2007. The above mentioned vehicles (green colored car and Dodge pickup), and other junk and debris must be removed from the property or stored in an enclosed building by May 6th, 2007. I have enclosed the information regarding the city sponsored cleanup days and the Hennepin County household hazardous waste collection days. The city cleanup has reduced fees and the Hennepin County collection is free. I strongly urge you to take full advantage of these cleanup days. I will re-inspect the property on May 7, 2007 and document any remaining violations. I will schedule an abatement cleanup within the next 10 days after inspection to remove any remaining violations. You will be billed for all expenses involved in the abatement including the cleanup company, all disposal fees and city staff time. JUNK CARS, FURNITURE, HOiISEHOLD FURNISHINGS AND APPLIANCES STORED ON PUBLIC OR PRIVATE PROPERTY. It is unlawful to park or store any unlicenced,unregistered or inoperable motor vehicle lacking essential parts, household furnishings or appliances,or parts or components thereof,on any property,public or private,unless housed within a lawfully erected building. Any violation of this Section is declared to be a nuisance and upon seven days written notice to the owner,as shown by the records in the office of the County Auditor,of private premises on which such material is found,the City may remove the same and certify the cost of such removal as any other special assessment. For the purpose of this Section,an inoperable motor vehicle shall be defined as lacking,including but not limited to,parts essential to operation,such parts being wheels,tires,motor,drive train,battery,or having two or more flat tires,or having the interior,including the driver's position,used for storage in such a manner that no person can operate the vehicle. (iJnlicensed cars) X SECTION 9.55. MAINTENANCE OF PRIVATE PROPERTY. SUBD. 1. It is the duty of the owner of every vacant property and the owner and occupant of every occupied property to maintain same in a neat,clean and presentable manner free of any junk,debris,refuse,litter,dead trees,or noxious weeds,and to remove all other public health or safety hazards therefrom. (Clean up debris in yard) SUBD.2. Grass and Weeds. The owner or occupant of every lot or parcel shall regularly cut or otherwise maintain all grass and weeds thereon at a height of not more than six(6)inches. SUBD.3. Any violation of this section is declared to be a nuisance and public safety and welfare hazard and upon seven days written notice to the owner,as shown by the records of the office of the County Auditor,of private premises on which such material is found or any conditions in violation of this code section exist,the City may remove the same or correct any conditions in violation, and certify the cost of such removals or corrections as any other special assessment. IN GENERAL Sec. 58-1. Maintenance of private property. (a) It is the duty of the owner of every vacant property and the owner and occupant of every occupied property to maintain the property in a neat, clean and presentable manner free of any junk, debris, refuse, litter, dead trees, or noxious weeds, and to remove all other public health or safety hazards from the property. (b) The owner or occupant of every lot or parcel shall regularly cut or otherwise maintain all grass and weeds on the property at a height of not more than six inches, except this provision shall not apply to the following: (1) Publicly owned parks, trails or nature areas. (2) Property actively being farmed or used for agricultural purposes in conformance with chapter 78. (3) Residential properties in excess of one acre gross lot size when located in the RR- 1A, RR-1B, LR-1A and RS rural residential zoning districts, provided that such properties or portions of properties shall be maintained in conformance with this subsection upon notice from the city that lack of such maintenance has caused complaints from abutting property owners and is thereby creating a public nuisance. (4) Wetlands vegetation as defined in chapter 78. (5) Grass, weeds or underbrush on any slope in excess of 100 percent (45 degrees). (c) Any violation of this section is declared to be a nuisance and a public safety and welfare hazard, and upon seven days' written notice to the owner, as shown by the records of the office of the county auditor, of private premises on which such material is found or any conditions in violation of this code section exist, the city may remove such matter or correct any conditions in violation, and certify the cost of such removals or corrections as any other special assessment. Maintenance of drainage systems; interference with drainage; permit for drainage systems. (a) Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning: Private drainage system means any storm sewer, ditch, tile line, or other facility, together with all appurtenances, constructed by a private person or existing on private property, for the purpose of collecting or conveying natural precipitation. Public drainage system means any storm sewer, ditch, tile line, or other facility, together with all appurtenances, constructed by the city from public funds, whether or not the cost was specially assessed, or maintained by the city from public funds, for the purpose of collecting or conveying natural precipitation. IN GENERAL Page 2 of 2 owner of the land upon which it is constructed, to maintain such system in good and workable condition and not to alter its capacity, inlet location or discharge location without a permi.t from the city. (c) Obstructions. It is a misdemeanor for any person to obstruct or place any obstruction in or upon any public or private drainage system. (d) Contract required. It is a misdemeanor for any person to construct, reconstruct, or in any way alter or extend any public or private drainage system unless such person is within the scope of a contract with the city or has a written permit from the city. (e) /ncrease of vo/ume, ve/ocity. It is a misdemeanor for any person to increase the volume or velocity of surface water runoff leaving his property, or to channel any surface water runoff so that it is redirected outside of the normal, natural watercourse as such surface water is discharged from private property on to public streets, public property, or on to neighboring private property, without a permit from the city. (Code 1984, § 9.04) Sec. 58-3. Junk cars, furniture, household furnishings and appliances stored on public or private property. It is unlawful to park or store any unlicensed, unregistered or inoperable motor vehicle lacking essential parts, household furnishings or appliances, or parts or components, on any property, public or private, unless housed within a lawfully erected building. Any violation of this section is declared to be a nuisance; and upon seven days'written notice to the owner, as shown by the records in the office of the county auditor, of private premises on which such material is found, the city may remove the vehicle and certify the cost of such removal as any other special assessment. For the purpose of this section, an inoperable motor vehicle shall be defined as lacking parts essential to operation, including but not limited to wheels, tires, motor, drive train, battery; or having two or more flat tires; or having the interior, including the driver's position, used for storage in such a manner that no person can operate the vehicle. It is unlawful for any person to abandon a motor vehicle on any public or private property without the consent of the person in control of such property. Abandoned motor vehicles shall be removed, impounded and disposed of in accordance with state law. For the purpose of this section, the term "motor vehicle" means as defined in Minn. Stat. ch. 169.
