NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File number 15-3787. 2. The P�operty is located in the LR-1 C One Family Lakeshore Residential Zoning District which requires a minimum lot area of 0.5 acres and a minimum lot width of 100'. 3. The Planning Commission reviewed this application at a public hearing held on October 19, 2015 and voted 4 for and 0 against on a motion to approve the variance. The Planning Commission finds that the following factors support the granting of the request: a. The Property has 12,197 square feet or 0.28 acres in area and 41 feet in width at the OHWL and 45 feet at the 75-foot setback. The Owner proposes to construct a new detached garage resulting in a net increase of structural coverage, 1.9% over the permitted level; the hardcover on the property will remain conforming.The construction of a garage in a residentially zoned property is consistent with the Ordinance. c. The Comprehensive Plan has directives which are put in place to pro�ect the lake, limit massing, and hardcover. Although the additional structural massing will not impact the lake side of the property, the overall structural massing on the Property will exceed the allowed level. The proposed plan results a conforming level of hardcover. � d. The proposed garage will be located in a compliant location and will not result in a nonconforming hardcover level. The Owner's home does not have a basement or storm shelter; the lower level of the proposed detached garage will serve as a severe weather/storm shelter for the Property. e. The detached garage with basement will alleviate a practical difficulty inherent to the elevation of the Property resulting in the absence of a subgrade intemal space to serve as a storm shelter; this situation was not created by the Owner f. The Owner has established that there are practical difficulties. The Property is narrow in width and is divided by an existing sewer line. The existing home is situated with an attached garage accessed off of the side street. The orientation and proximity to the sewer line does not permit a larger addition to the home or an extension of the driveway to branch off of the existing driveway. These are circumstances unique to the Property not created by the Owner. g. The Owner proposes to use the Property in a reasonable manne�not permitted by the official controls. h. The variance will not alter the essential character of the locality. The Property is long and retatively narrow; the location of the proposed garage does not appear to result in a negative impact on the character of the neighbofiood. i. The lakeshore property is encumbered by a sewer easement and situated on a corner resulting in challenging setbacks; the proposed level of hardcover is not out of conformance with the general neighborhood. j. The Property is on a corner with the access oriented toward Crystal Bay Road to the east, while the neighbors to the west front on the lake and are accessed Page 2 of 5 , „ , �Ol V � C ITY OF ORONO RESOLUTION OF THE CITY COUNCIL ��� �.�'~� NO. � �J � � kESH�R at the rear. The neighbors to the east all face the lake, yet front on Crystal Bay Road. The Property is relatively unique in this neighborhood. k. The Owner has indicated that granting of the variance is necessary for the preservation and enjoyment of a substantial property right of the Owner. I. The granting of the proposed variance will not in any way impair health, safety, comfort or morals, or in any other respect be contrary to the intent of this chapter. m. The granting of the requested variance will not merely serve as a convenience to the Owner, but is necessary to alleviate demonstrable difficulty. The Owner has indicated that the need for a storm shelter and additional storage on the Property serve as a practical difficulty. 4. The Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Owner and the public, and the effect of the proposed variance and conditional use permit on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning distri�t; that granting the variance and conditional use permit would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council grants a variance from Orono City Code Section 78-1685 to allow construction of a 298 square foot detached garage resulting in 16.9% structural coverage, 242 square feet over the allowed 15% structural coverage level; subject to the following conditions: 1. Council approval is based on the survey and plans submitted by the Owner and annotated by City staff, attached to this Resolution as Exhibits A & B. Any amendments to the approved plans which are not in conformity with City codes will require further Planning Commission and City Council review. 2. The structural coverage level shall not exceed 16.9% or 2,071 square feet; overall hardcover levels shall not exceed the allowed Tier 1 levet of 25%. Compliance with all permitting requirements of the Minnehaha Creek Watershed District. 4. Authorities granted by this resolution run with the Property not with the Owner, but are permissive only and must be exercised by obtaining permits and commencing construction of said project within one year of the date of Council approval, or the approvals granted by this Resolution will expire on that date (November 9, 2016). 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and.shall be punishable as a misdemeanor. 6. The undersigned Owner has read, understands and hereby agrees to the terms of this resolution and on behalf of the Owner and the Owners' heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the Property.
