TO THE HONORABLE JUDGES OF THE DISTRICT COURY OF HENNEPIN COUN7Y:
Pursuant to Minn. Stat. §508.13, the undersigned Examiner of Titles has examined
the title of the Applicants to the land described in the Application, investigated the truth of
all matters set forth therein, determined whether or not the land is occupied, and, if
occupied, the nature thereof and by what right the occupation is held, and also whether or
not any judgments against Applicants or those through whom Applicants claim title may be
a lien upon the land described in the Application. I have searched all public records, and
fully investigated all facts brought to my notice pertaining to the title, including an
inspection report by the County Surveyor. This report to the Cou�t contains the substance
of the proof and a Certificate of Opinion upon the title.
1. At the time of the filing of the Application herein, the Applicants were the record
owners, except as hereinafter noted, in fee simple of the land in the County of Hennepin
and State of Minnesota described in the Application and as follows:
Lot 6, Block 1, "Wiley's Park" Lake Minnetonka.
2. According to the Application and the Hennepin County Surveyor's Inspection
Report on file herein, the property is occupled by the applicants.
3. The mortgage set out at Paragraph F of the Application has been satisfied by
Document No_ 8173555.
4. I note th f Ilowina encumbrances defects and irreqularities:
(a) 7he legal description shown at Paragraph 1 above differs slightly f�om that
contained in the Application and should be used in all further proceedings.

(b� �he appiicants state at Paragraph "H" of the Application that a defect exists in
their title in that the deed ta the applicants excludes land granted to the Village of Orono for
a sanitary sewer easement. That deed appears at abstract entry no. 245 and is recorded in
Book 2585 of Deeds, page 532, Document No. 3654129. I assume there will be evidence
at the hearing sufficient to sustain a finding of fact in the Decree of Registration that ihe
grantor in the deed recorded in Book 2585 of Deeds, page 532, Document No. 3654129,
Donald M. Becker, did not intend to exclude any part of the land, but rather to show that it
was subject to the sanitary sewer easement, and that the deed should be consirued
accordingly. I recommend as a defendant Donald M. Becker.
(c) Pursuant to the above mentioned easement the following concluding statement
should be contained in the "subject clause" of the Decree'
To a sanitary sewer easement in favor of the City of Orono
recorded in Book 2585 of Deeds, page 186, Document No.
3653332.
I recommend the CitV of�rono as a defendant.
(d) The Application at Paragraph "F" indicates that the property is subject to a
purchase agreement dated May 30, 2003 from the applicants to vendee Ellen DeHaven
Peterson. The following concluding statement should be contained in the "subject clause"
of the Decree:
To an unrecorded Purchase Agreement dated May 30, 2003 in
favor of Ellen DeHaven Peterson.
The vendee has consented to the Application and need not be made a defendant.
(e) The Inspection Report discloses that a highway easement encroaches over the
Southerly part of the land being registered. Pursuant to abstract entry no. 170, the
following concluding statement should be contained in the "subject clause" of the Decree:
To Hennepin County State Aid Highway No. 19, Plat 50, Registrar
of Titles Document No. 1484162.
I recommend the Cauntv of Hennepin as a defendant.

(� The Inspection Report further discloses that a power pole and power and
telephone wires enCroach over the Southerly line and that power and telephone wires
serving the prope�ty to the West may encroaCh over the West line of the land being
registered. There should be evidence at the hearing sufficient to sustain a flnding of fact in
the Decree of Registration as to wheiher the power poles and power and telephone wires
are encroaching as a matfer of right or merely at sufferance. lf they are encroaching as a
matter of right, there must be an appropriate conc�uding statement contained in the
"subject clause" of the Decree. I recommend as defendants NoRhem States Power
Comnany and the telephone comaany maintainin4 the wires, the name of which should
be determined by the applicants° attorney.
(g) Last, the Inspection Report discloses that a concrete block wall claimed by the
property to the West encroaches over the West line of the land being registered. The land
to the West is Lot 7, Block 1, of the same plat. There should be evidence at the hearing
sufficient to sustain a finding of fact in the Decree as to whether the encroachment of the
concrete block wall over the Wesferly line of the land being registered is mainfained as a
matter of right or merely at sufferance. If it is maintained as a matter of right, there must be
an appropriate concluding statement in the"subject Gause"of the Decree.
I reCommend as defendants the owners and encumbrancers of Lot 7, currently
disclosed by the records of the Hennepin County Recorder to be Thomas V. Nordlle and
Ellzab�th M. ordlie as joint tenants, PHH Mortaas�e Services, and Wells Farao Bank
Mlnnesota. National Associati�r .
I also recommend as defendants the occupants of Lot 7, Block 1 of the same plat,
the names of whom should be determined by the applicants' attorney.
