On May 14, 2014 Andrew with Gray Gardens applied for an after-the-fact zoning permit application for the hardcover
changes made to 2216 Shadywood Road. While he was in our office discussing the project, he noted a portion of the
retaining wall on the southwest corner of the property has been removed.
This same day the property was inspected and landscape plastic was found under the mulch/wood chips and gravel
patio area. Plastic underlayment is considered hardcover and will must be removed from the mulched area or included
in the hardcover calculations. The gravel/paver patio will be considered hardcover.
On May 15, 2014 we received an as-built survey dated 5/12/14. Additional information will be required before we can
proceed with our as-built review. The survey and hardcover calculations must be updated to reflect:
• All improvements
• The portion of the retaining wall that has been removed
• The edging/coping around the pool as hardcover
• The fire pit as hardcover
• Unless the plastic is removed, the areas where there is plastic under mulch/wood chips will be considered
hardcover
• The 'gravel' patio area as hardcover
To assure the hardcover calculations are done to the City's requirements, please review the attached Hardcover
Information Packet and use the City's Hardcover Calculation Form. The survey still lists hardcover by 'zones'.

Violation of Approved Resolution#6323
2216 Shadywood Road
The property addressed 2216 Shadywood Road received a variance for 100 sq ft pool/spa ahead of the
average lakeshore setback. On May 7, 2014 we received an as-built survey dated 4-14-2014 showing a
pool/spa 173 sq ft in size; 73 sq ft over the sized approved. The pool/spa must be reduced to the approved
size. Partial copies of the proposed and as-built surveys are enclosed. '
As noted on the issued building permit,permits requined forany additional harolcoverinstallation, i.e. decking
around spa. The survey shows landscaping improvements and the City did not issue a Zoning Permit for
changes in hardcover. City Engineer, Jesse Struve, will perform a site inspection in the near future.
Depending upon the type of materials used for the patio labeled "gravel" additional changes may be
necessary.
Hardcover calculations are shown on the survey but may not be accurate. Please have the hardcover
calculations completed on the City's Hardcover Calculation Worksheets for accurate calculations. The metal
stairs are hardcover and structure and must be included in the calculation. Enclosed is a copy of our
hardcover information packet.
In closing, the pool/spa must be reduced to the approved size of 100 sq ft, updated hardcover calculations
and survey submitted. An after-the-fact Zoning Permit is required for the hardcover changes. The permit
fee is$50 and the after-the-fact fee is $50 for a total of$100.
We will continue to hold your $2,500 escrow until the property is in compliance with the permit. If you have

Hi Dana,
As we are finalizing our review of the proposed spa (pool) permit for 2216 Shadywood Road there are a couple of
outstanding items to be completed before we can issue the permit.
• Rebecca must come to Orono City Hall to sign the resolution approving the spa (pool)forward of the average
lakeshore setback.

Thank you for the updated survey. Page 2 of the attached information packet entitled Swimming Pools and Hot Tubs
states a pool or hot tub may not be placed lakeward of the average lakeshore setback according to City Code 78-
1279(6). As the survey reflects,the proposed spa is forward of the average lakeshore setback and cannot be permitted.
If the property owner chooses to pursue placement of the spa forward of the average lakeshore setback,a variance is
required. Attached is a copy of the variance application. A variance application requires a $700 application fee and a
$2,500 escrow. The next variance application deadline is Wednesday,August 215L a Noon.
