A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
Sections 78-350 and 78-1288
FILE No. 06-3239
WHEREAS, John J. Henry, III, a single person, (hereinafter "Owner") is
the owner of the property located at 2216 Shadywood Road within the City of Orono
(hereinaf�er "City") and legally described as: Lot 11 Block 1 Wileys Park Lake Minnetonka
Heruiepin County, Minnesota(hereinafter "the Property"); and �
WHEREAS, Vogue I.C.F. Homes (hereinafter "Applicant") has made
application on behalf of the Owner to the City for a variance to Municipal Zoning Code
Section 78-350 to allow coilstruction of a replacement residence on a lot that is 0.39 acre in
• area when 0.5 acre is required and is 51 feet in width when 100 feet is required; and
WHEREAS, Vogue I.C.F. Homes has made application on behalf of the
Owner to the City for a variance to Municipal Zoning Code Section 78-1288 to allow
construction of a replaceinent residence oii the Property with 27.7 percent hardcover in the 75
to 250 foot zone when 25 percent is allowed; and
WHEREAS, after due published notice and mailed notice in accordarice with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Coirunission held a public hearing on NovemUer 20, 2006, at which times all persons desiring
to be heard concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVEI) by the City Council of Orono,
Minnesota:
FINDINGS .
1. This application was reviewed as Zoning,File#06-3239.
2. The property is located in the LR-1 C zoning district, where 0.5 acre acre is the
minimum lot area and 100 feet is the minimum lot width. The property is
approximately 0.39 acres in area and 51 feet in width.

and on a vote of 3 - 1 recommended approval of the variances, based on the
following findings:
a. The lot was created before there were subdivision regulations.
b. A house has existed on the property since 1920.
c. There is no adjacent property the Owner could acquire to enlarge the lot.
d. There are numerous lots with houses in the immediate vicinity of this
property that are of similar size and width so the proposed house would not
be out of character with the surrounding axea.
e. Structural lot coverage is only 12.75 percent when 15 percent is allowed.
• f. The house is located eight feet behind the average lalceshore setback. To
eliminate the hardcover variance would require the house be moved eight
more feet away from the lake. Because of the narrow lot this increase in
lakeshore setback would substantially impair lakeshore views from the new
residence.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, coinments
by the applicant and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that -
granting the variances would not adversely affect traffic conditions, light, air
nor pose a fire hazard or other danger to neighboring property; would not
merely serve as a convenience to the Owner, but are necessary to alleviate a
demonstrable hardship or difficulty; are necessary to preserve a substantial
property right of the Owner; and would be in keeping with the spirit and intent
of the Zoning Code and Coinprehensive Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants variances to Orono
. Municipal Zoning Code Sections 78-350 and 78-1288 to allow construction of a replacement
residence subject to the following conditions: �
l. Council approval is based on the site and house plans submitted by the
Applicant and annotated by City staff, attached to this Resolution as Exhibits
A. and B. Any amendments to these plans may require further Planning
� Commission and City Council review.
. 2. Hardcover in the 0-75' zone shall be limited to 0 s.f. or 0%. Hardcover in the
75-250' zone shall be limited to 2,581 s.f. or 27.7%. Hardcover in the 250-
500' zone sha11 be limited to 1,115 s.f. or 28.5% per the proposed site plan and
• the hardcover allowance surrunary as depicted on Exhibit C. The Owner is
advised that any future requests to increase hardcover or change the nature of
existing/approved hardcover shall require City approval, and increases in
hardcover will not likely be approved without concurrent reduction in existing
hardcover. �
� 3. No height variance is �anted. The basement depth under the garage and .
middle portion of the house shall be increased as necessary to comply with the
' 2.5 story height limit.
4. Prior to issuance of a building permit the grading plan shall be revised to
address the issues outlined in the City Engineer's report and to ensure drainage
problems are not created for adjacent properties.
5. The Owner shall not place any plastic or fabric liner material under any
laudscaping on the property to ensure their permeability as non-hardcover
surfaces. •
6. Authorities granted by this resolution run with the property not with the
Owner, but are permissive only and must be exercised by obtaining a building
permit for the new construction before December 1 l, 2007 or the variance will
expire on that date.

7. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
8. The undersigned Owner has read, understood and hereby agrees to the terms of
this resolution and on behalf of his heirs, successors and assigns, hereby agrees
to the recording of tlus resolution in the chain of title of the property.
