Construction without a proper permit is a violation of City Code Section 86-66. This letter will serve as your notice that the property must be brought into compliance before Mondav. December 2, 2013. In order to bring the property into compliance the porch must be removed or an after-the-fact building permit submitted, with all the necessary requirements, including an updated survey showing all the survey requirements specifically indicating the average lakeshore setback. Please be aware if the porch encroaches into the average lakeshore setback, staff is unable to approve administratively. If you are interested in applying for an after-the-fact building permit, the City's Building Permit Application packet is enclosed. Building permit fees are based on the estimated construction value. The following items must be submitted or revised in order for your application to be considered complete and for the plan review to continue: 1. Certificate of Survey. A survey was submitted, however it does not meet all of the City's survey standards (enclosed),specifically the average lakeshore setback is not shown. Please add additional details to the survey and show the average lakeshore setback line. 2. Hot Tub. The new hot tub shown on the survey does not meet the 10'side yard setback'; a 10' setback from the deck/porch and appears to be located within the average lakeshore setback. The hot tub must be moved to a conforming location. See enclosed Swimming Pools and Hot Tubs information packet. 3. Setbacks. The existing deck is shown set back 7'-8"from the property line,where a 10' setback is required. If it is determined that the porch is not located within the average lakeshore setback,the porch must be altered to meet the 10' setback on the North side. If the porch is located within the average lakeshore setback the porch must be completely removed. 4. Hardcover Calculations. The property is located in Tier 1 of the Stormwater Cluality Overlay District and is permitted up to 25% hardcover. Hardcover calculations are shown on the survey; however, please have the surveyor prepare hardcover calculations, using the City's Hardcover Calculation Worksheet. In good faith, I contacted you by telephone on January 10, 2014, May 2, 2014, May 21, 2014 and August 5, 2014. All of those times resulted in a verbal commitment from you to follow through with the requirements of the December 10th violation letter. To date we have not received the required information. Violation letters were sent to remove the structure or submit an after-the-fact permit. On November 4, 2014 an incomplete after-the-fact building permit was submitted. Additional information was requested. Repeated attempts were made to the property owner, but no additional information was ever submitted. The legality or building practices of this addition were not verified. The screened porch is not a legal, non-conforming improvement.
