RE: Hardcover Violation
Steve,
Following our May 8, 2012 meeting I emailed you with a summary of our discussion (copy attached). At
that time we allowed you to place additional hardcover in front of the third "garage stall" in exchange for
removal of an unpermitted lakeside patio, stone outcroppings and decorative stone wall near the
driveway. You also stated your intent to submit plans to make the third stall door a functioning door.
In 2010-2011, when you built your home the property was granted a variance allowing 4,040 s.f. or
35.29% hardcover in the 75-250' zone. As a result of this approval the 250-500' zone was limited to 626
s.f. or 24.89%. The addition of an approved third garage door resulted in hardcover which exceeded
approved levels. Therefore the City required the third garage door to be "removed" and landscaping to
be installed in the place of driveway hardcover. You chose at that time to cosmetically alter the
overhead garage door to make it non-functioning. On May 12, 2011 our inspector confirmed this
cosmetic change and the City issued a certificate of occupancy shortly thereafter.
On July 25, 2012 our inspector visited the site and noted the hardcover in front of the third "garage" stall
had been installed yet the required removal of the unpermitted hardcover had not been removed. The
inspector also observed the 2011 compliance change to the garage door had been un-done making the
current third garage stall door illegal. As a result your property is no longer in compliance with the
conditions of your hardcover variance and your building permit. This overhead garage door must be
completely removed and a wall or a wall and a door less than 6-feet in width constructed in its place.
This letter will serve as your official notice that your property is in violation Resolution No. 5932 and
building permit #2010-00336. The property must be brought into compliance before Fridav Auqust 31,
2012. In order to bring the property into compliance all of the illegal hardcover and the overhead
garage door removed. A building permit is required for any construction activity and you must submit an
as-built survey with hardcover calculations upon completion to verify compliance. Please be advised if
you fail to comply with this notice this matter will be sent to the City Attorney for review and may result
in criminal prosecution.

Following our August 3 and August 23 letters, a building permit was issued for conversion of the third
garage stall to a 6' door. Building permit #2012-00872 was issued on September 4, 2012, yet no
framing or final inspections has been completed. Please call 952-249-4600 to schedule all inspections.
� Also according to the proceeding letters all illegal hardcover was to be removed and an updated survey
with hardcover calculations was to be submitted verifying the property is in compliance with Resolution
No. 5932 and building permit number 2011-00336. An updated survey and hardcover calculations
must be submitted before October 12, 2012.
Please be advised if you fail to comply with this notice this matter will be sent to the City Attorney for
review and may result in criminal prosecution.

We received an as-built survey and hardcover calculations for the property addressed
2172 Shadywood Road from surveyor Mark Gronberg. A copy of the survey and hardcover
calculations are attached for your reference. The survey received however is incomplete and does
' accurately reflect all improvements to the property; including, but not limited to are a fence and stone
: outcroppings along the fence, which we have photographs of from pervious site visits, which are not
. shown on the survey. The fence is not hardcover, but the stone outcropping / stone wall is hardcover
and must be reflected in the hardcover calculations.
All illegal hardcover must be removed and an updated as-built survey and hardcover
calculations submitted before October 19, 2012. Please be advised if you fail to comply with this
notice this matter will be sent to the City Attorney for review and may result in criminal prosecution.
