Before the City witl issue a final certificate of occupancy tor Z172 Shadywood Road, the following must be
resolved:
• Hardcover (Third Garage Stall)
When building permit 2010-00336 was issued it was noted on the plans and on the permit that a third
garage stall was not allowed. On the survey submitted, date 2-16-2011, Staff noted a third garage stall
and an area called "drain rock on dirt"which were not approved with Resolution No. 5932. Staff has
since observed a new wall constructed to close up the third garage stall with an appearance similar to
the remaining two garage doors. This resolves the issue, however it will be noted on the certificate of
occupancy that a third garage stall is not and will not be approved.
• Hardcover (Drain Rock on Dirt)
During your conversation with Melanie in February, she informed you that the drain rock on dirt must be
removed. It is not in compliance with the approved plan. Please submit an updated As-Built survey
and hardcover calculations following its removal.
• Vegetative Buffer
Resolution 5932, requires submittal of plans for a native shoreline vegetative buffer. Exhibit A of this
Resolution notes the required planting area. This requirement was also noted on building permit 2010-
00336. Plans for a shoreline buffer and an escrow must be submitted before the CO will be issued.

Demolition Permit:
• Form available at www.ci.orono.mn.us, under permits and licenses. Must be signed
by owner.
• Zoning Disclosure Form: Attached, must be signed by owner.
• Sewer and water disconnect permit must be issued and work completed and
inspected before demo permit is issued.
Escrow Agreement for demo and construction permits:
• Agreement for owner to sign attached.
• Agreement and $2,500 check from owner must be in office before demo permit is
issued. (You may bring them when you pick up the permit.)
Variance Resolution:
Owner needs to stop in at City offices to sign between 8am and 4:30pm this Friday or
7:30am and S:OOpm Monday through Thursday and 7:30am and 11:30am on Fridays. You
may pick it up and take responsibility for getting it signed (before a notary). It must be
signed and returned before the construction permit is issued.
The $2,500 escrow from the variance application cannot be rolled over to the permit
escrow. The owner should submit a written request to have that escrow refunded.

RE: Conformance with Building Permit 2010-00336
As a result of your recent request for a temporary certificate of occupancy (C.O.), staff reviewed
your building permit and property file in order to define the outstanding issues for the issuance
of a final C.O. According to the approved building permit plans and as noted within Resolution
5932 (copy attached), your third garage stall is to be no wider than 6 feet. Your property was
limited to no more than 4,040 square feet of hardcover within the 75' to 250' zone. During the
recent inspections and review of your property staff noted that the third garage stall does indeed
exceed 6 feet in width. The increase in size results in an increase to the size of the driveway
which must be accounted for in your hardcover calculations. This falls under "assumed
hardcover"; see the enclosed Hardcover Information sheet. The result of the wider garage door
is that your property now exceeds the approved level of hardcover within the 75' to 250' zone.
The additional assumed hardcover is illegal hardcover and the need for it must be removed.
Additionally according to Resolution 5932, plans for a native shoreline vegetative buffer must be
submitted prior to the issuance of the final certificate of occupancy. These items were noted on
your building permit at the time of issuance.
Before the City will issue a final certificate of occupancy verification of compliance with the
approved plans will be required. An as-built survey is required to be submitted which reflects
the third stall garage door is reduced to no wider than 6-feet and hardcover levels must be in
compliance with approved plans. Further a planting plan for the native shoreline vegetation
planting area must be received and approved by staff— note that a cash escrow will be required
for the plantings to assure viability through a growing season.

RE: Site Inspection
2172 Shadywood Road
As a result of the driveway replacem�nt, a site inspection was perFormed on May 1, 2012 at the
property addressed 2172 Shadywood Road. The site visit resulted in several violations noted:
1. Weed Prevention/Landscape Fabric. City Code Section 78-1211 defines hardcover.
All the weed preverrtion/landscape fabric under mulch is considered hardcover and must
be removed.
2. Lakeside Patio. According to the as-built survey dated 7-1-11 and Resolution No. 5932
a lakeside patio area was not proposed nor approved. The additional hardcover must be
removed. A partial copy of the as-built survey and resolution are attached.
3. Retaining Wall. The retaining wall near the driveway turnaround is not show on as-built
survey and is considered hardcover. Depending upon which hardcover zone it is located
in, it may be required to be removed.
4. Vegetative Buffer. The required vegetative buffer size has been modified. Please
restore the buffer to the approved size and plantings. If planting have changed from
what was approved, provide a new planting plan.
All construction activity must stop immediately until the above issues are resolved. A
stop work order will be issued if activity continues. The property is in violation of
Resolution No. 5932 and must be restored to the approved as-built condition. Violation of or
non-compliance with any of the terms and conditions of this resolution shall constitute a violation
of the zoning code, shall automatically terminate any authority granted herein, and shall be
punishable as a misdemeanor.
If you choose not to restore the property to its approved condition, you must apply for an after-
the-fact variance. After-the-fact (double) fee will apply. You should note that according to
Resolution No. 5932, page 3 of 4, Item #2, any future request to increase hardcover or change
the nature of the existing/approved hardcover shall require City approval, and increases in
hardcover will not likely be approved without concurrent reduction in existing hardcover. A
variarice application is attached.

The following words,terms and phrases, when used in this article, sha11 have the
meanings ascribed to them in this section, except where the context clearly indicates a different
meaning. Unless specifically defined in this section, words or phrases used in this article shall be
interpreted as defined elsewhere in this chapter. All distances, unless otherwise specified, shall
be measured horizontally.
Hardcover means any material that interferes to any degree with the direct absorption of
rainfall into the ground. Examples include buildings;tennis courts; pools, including water
surface; decks,regardless of spacing;roofs of any sort, including roof overhangs; play structure
platforms; driveways (concrete, asphalt, gravel, or dirt); sidewalks,ramps, etc.; any surface
intended to be driven on; landscape beds lined with plastic sheeting or weed-prevention fabric;
tops of retaining walls; patios and stepping stones;porous pavement; temporary buildings; and
any vehicle, material, or equipment that prevents direct absorption of rainfall into the ground and
that is stored for an extended period of time.

Hello Christine.
Bob is going to call you on Monday to make an appointment to see if we both can come in and talk to you reguarding a
resolution ASAP. Hopefully sometime Tuesday?I would also like to come and clear my conscience with you, along
with sharing the facts with you and have you hear my side of the story, which will be the true version about how I got into
this mess. I didn't get here on my own, that's for sure..l'm not the bad guy here, but I'm sure paying the price of almost
pure hell while others have made a lot of money off their so called great ideas. ThaYs for dang sure... I think you will at
least find it interesting to hear my side of the story I would hope. I also did not represent myself at the permit processing
either. I'm not acting like a Tom Petters here, but I did put my trust in others without seriously knowing the harsh rules of
the system or consequences. If I would have known the turnout of the problems with my lot I would have never of done
any of this. Trust me on that..l had my patio table on the grass last year and it sucked. I did try it....
This is a grave concern, which needs immediate action taken. I have a Escalade vehicle and I CAN'T currently turn
around in the turn around area at the top of my driveway because it is not done because of the stop work order. Christine,
this is forcing me to backout of my driveway blindly where people come flying by at a hard to see already blind spot when
they are heading north on Shadywood Road. They are not all going 30 mph either as the speed limit is
posted. Shadywood is a very, very busy road as you know. Some of the drivers are going 40-45-even 50 mph. There is
"ZERO"time for drivers to re-act to me pulling out of my driveway backwards currently because I can't go out out
forward. I'm basically just praying that nobody is coming while I just go for it and pull out of there..... What makes it even
worse is my neighbor one house down is sometimes parking a business van and a trailer in his driveway and if that is
there I can't see ANYTHING! Please also take note that I could of seriously injured or even worse killed a guy on a
motorcylce today, along with almost causing several other accidents in the past few days. It is very, very, VERY
dangerous! I'm not kidding, it is a disaster in the making.
For your enjoyment, attached is a picture of what I paid $975,000 for in Jan. 2007 and now have $2,500.000.00 million
dollars into this silly on-going disaster. I wish I would have left what was there and let somebody else deal with all of the
hassles. What a nightmare this has been for me...Look at the curb appeal I have done for the area and how I have helped
the economy with building a new house. I felt good about, but don't anymore and regret the whole deal. I honestly didn't
need all of this stress caused by the ideas of others, but do accept 100% responsibility for the end result actions, even
though I shouldn't. I can honestly say that I didn't read or fully understand what the heck the consequences were for doing
this. It's a safe bet that others have violated hard covers rules out there. (I can proof it.) I know that doesn't make it right
for me to do it, but I got talked into it and yes I got caught and had a strange feeling that I would. I was worried about it.
That's for sure.
Dear Christine. I know and respect that you are just doing your job and I will comply 100% with whatever agreement we
can come up with. I plead and ask for mercy from you. I'm a good and honest person. I go to a men's Bible Study and
attend Our Savior Lutheran Church in Excelsior. I have a clean record. I'm not some arrogant piece of crap Lake
Minnetonka citizen who thinks they can do whatever they want because they have money. I'm humble and very honest. I
will do what you want me to do without any issues or fights.
Please let Bob know what we can do for setting up a meeting. We need to get that turnaround done rush.
Once again I'm very sorry for violating the City of Orono rules. I need help and mercy with this issue....

In the past meeting I was told that I could remove the garge door plate so I could open the garge door to let air in. It was
stated that as long as I didn't drive in and out of that 3rd garge stall, which is impossible that would be fine. I also brought
in pictures of the drainage problems on the lakeside buffer showing proof that the two properties on both sides drain into
my yard and nothing drains into the lake. I was told that your engineer was going to look into this matter and call back with
his plan. I never heard anything back on that issue. Bob also stated that he was going to get some samples on other
landscape products to show you. He stated that he has been extremely busy and I don't know where that has landed?
Tracey and Bob. Please set up a meeting with these people, so we can all sit in the same room and get this abortion of a
property figured out. I'm available anytime next week. As stated to Christine in the past meeting I'm not a criminal and will
comply.

Steve,
Bob Renaud from Southview Design contacted me requesting an extension for the hardcover removals on your
property. Below is a summary of our conversation:
A land alteration permit is not necessary since the outcropping of boulders will be removed, dirt around
the removal area will be used to fill in the indentation and mulch will be placed over the top. The
lakeside patio will be removed and sod will be put in its place.
Bob indicated an updated survey and hardcover calculations are being prepared because he felt the
outcropping of boulders near the turn-around can remain and would be in accordance with hardcover.
As Bob and I discussed on the phone, the variance allowed for 4,040 s.f. or 35.29% in the 75-250' zone
and 626 s.f. or 24.89% in the 250-500' zone.
Once all the illegal hardcover has been removed and before September 15, 2012, please submit updated
hardcover calculations and an updated as-built survey. Our engineer will perform a site inspection to verify
compliance.
I have not heard from nor received any information from Tracey Weathers with plans for the garage door
removal. The deadline of August 31, 2012 remains for the garage door modifications to be completed.
Remember a building permit is required for any construction activity.

Bob Renaud stated that he will handle the other hardcover issues with you and has stated that he has made contact.
Please remember that I didn't get into this mess on my own, but I will do my best to make it right. As stated in our last
meeting I feel your building inspector should have red-flagged and stopped the job when the door issue came up. Part of
the job description of a building inspector should be to protect the home owner. Many other people in my neighborhood
have added hard cover and as stated and I have pictures and proof if we end in court....Somebody a few doors down just
added some blue-stone blocks to bottom of there deck or a walkway on the lakeside.

I spoke with Tracey Weathers today. He was asking for clarification on what needed to be done
to bring the property into compliance. As I stated in my August 10, 2012 letter, the overhead
garage door must be completely removed and a wall or a wall and a door less than 6-feet in
width constructed in its place. The deadline of Fridav Auqust 31, 2012 remains for the garage
door modifications to be completed.

Jesse: I have a lot of turning radius templates for semi trucks but not for suv's so I measured my Tahoe which has a
turning radius of 21.8 feet which is close to the attached information for the Ford Excursion. I traced this on the attached
survey and couldn't get this move to work in two moves going straight back and then forward. I also went out to the site
and got the same results as I did on paper. However, it was pretty easy to add two extra small moves going forward a few
feet and then backing up and then out the driveway. So it was easy to get out of the site, just not in two moves.

Jesse: I have a lot of turning radius templates for semi trucks but not for suv's so I measured my Tahoe which has a
turning radius of 21.8 feet which is close to the attached information for the Ford Excursion. I traced this on the attached
survey and couldn't get this move to work in two moves going straight back and then forward. I also went out to the site
and got the same results as I did on paper. However, it was pretty easy to add two extra small moves going forward a few
feet and then backing up and then out the driveway. So it was easy to get out of the site, just not in two moves.

survey and couldn't get this move to work in two moves going straight back and then forward. I also went out to the site
and got the same results as I did on paper. However, it was pretty easy to add two extra small moves going forward a few
feet and then backing up and then out the driveway. So it was easy to get out of the site,just not in two moves.

Title VI - LAND USE
Chapter 78-ZONING REGULATIONS
Sec.78-1680.-Hardcover restriction zones.
Within 75 feet of the ordinary high water level(OHWL)of any lake or tributary,and within any bluff or shore impact zone,no hardcover
shall be placed,located or constructed,except for driveways, stairways,lifts, landings and lockboxes as regulated by the shoreland overlay
district.

Sec.78-1681.-Driveways,in general.
All driveways shall comply with the following minimum dimensional standards:
(1� Driveways serving end loading garages shall maintain a width equivalent to the width of all overhead doors extending 15 feet
out from the garage doors.
(2� Driveways serving side loading garages shall provide a minimum turn around or back up depth of 20 feet,as measured from the
garage door(s).
(3� Minimum driveway taper ratio shall be 2:1.
(4� Driveways shall be at least eight feet in width at the street or private road.
(5� A turnaround shall be provided for a driveway with direct access to an arterial or collector roadway,or for a side load garage as
determined necessary by the city planner.The minimum dimensions of the turnaround shall be eight feet in width by 12 feet in
depth.
(6� "Wheel strip"driveways are allowed,but the entire width of the driveway(from outside to outside of the strips)will be considered
hardcover.

We received an application from 2172 Shadywood Rd for the removal of a turnaround portion of the driveway, and the
addition of driveway to allow for access to the third garage stall. By City code the resident needs to be facing forward
when they get to Shadywood.
Can you please check the turning radius of a SUV or truck to see if what is shown can be maneuvered? Essentially they
will be using this area as their turnaround and I just need to be sure this can be done.

Bob,
We have received the attached driveway plan, dated 4-16-2012. Since the plan is not to scale, we are unsure
if the proposed driveway changes meet City code requirements. The driveway must be as wide as the
garage...all three stalls and at least 15 deep before it can begin to taper. The proposed plan must be put onto
a survey, by a registered land surveyor.
A zoning application must be submitted, with all the requirements including an updated survey and hardcover
calculations by November 16th. A zoning application is attached. The violations on this property were to be
corrected by October 19, 2012. If we don't receive a complete application by noon on Friday November 16tn
we will be forced to send this matter to the City Attorney for review and may result in legal action.
For your information I have attached a partial copy of a survey dated, October 17, 2012 and hardcover
calculations. The allowed hardcover on the property is 25% of the entire lot.
