But there are a few more items to take care of: Demolition Permit: • Form available at www.ci.orono.mn.us, under permits and licenses. Must be signed by owner. • Zoning Disclosure Form: Attached, must be signed by owner. • Sewer and water disconnect permit must be issued and work completed and inspected before demo permit is issued. Escrow Agreement for demo and construction permits: • Agreement for owner to sign attached. • Agreement and $2,500 check from owner must be in office before demo permit is issued. (You may bring them when you pick up the permit.) Variance Resolution: Owner needs to stop in at City offices to sign between 8am and 4:30pm this Friday or 7:30am and S:OOpm Monday through Thursday and 7:30am and 11:30am on Fridays. You may pick it up and take responsibility for getting it signed (before a notary). It must be signed and returned before the construction permit is issued. The $2,500 escrow from the variance application cannot be rolled over to the permit escrow. The owner should submit a written request to have that escrow refunded. Dore 6530 Cambridge Street Minneapolis, MN 55426 RE: Conformance with Building Permit 2010-00336 As a result of your recent request for a temporary certificate of occupancy (C.O.), staff reviewed your building permit and property file in order to define the outstanding issues for the issuance of a final C.O. According to the approved building permit plans and as noted within Resolution 5932 (copy attached), your third garage stall is to be no wider than 6 feet. Your property was limited to no more than 4,040 square feet of hardcover within the 75' to 250' zone. During the recent inspections and review of your property staff noted that the third garage stall does indeed exceed 6 feet in width. The increase in size results in an increase to the size of the driveway which must be accounted for in your hardcover calculations. This falls under "assumed hardcover"; see the enclosed Hardcover Information sheet. The result of the wider garage door is that your property now exceeds the approved level of hardcover within the 75' to 250' zone. The additional assumed hardcover is illegal hardcover and the need for it must be removed. Additionally according to Resolution 5932, plans for a native shoreline vegetative buffer must be submitted prior to the issuance of the final certificate of occupancy. These items were noted on your building permit at the time of issuance. Before the City will issue a final certificate of occupancy verification of compliance with the approved plans will be required. An as-built survey is required to be submitted which reflects the third stall garage door is reduced to no wider than 6-feet and hardcover levels must be in compliance with approved plans. Further a planting plan for the native shoreline vegetation planting area must be received and approved by staff— note that a cash escrow will be required for the plantings to assure viability through a growing season. Dore 6530 Cambridge Street Minneapolis, MN 55426 RE: Site Inspection 2172 Shadywood Road As a result of the driveway replacem�nt, a site inspection was perFormed on May 1, 2012 at the property addressed 2172 Shadywood Road. The site visit resulted in several violations noted: 1. Weed Prevention/Landscape Fabric. City Code Section 78-1211 defines hardcover. All the weed preverrtion/landscape fabric under mulch is considered hardcover and must be removed. 2. Lakeside Patio. According to the as-built survey dated 7-1-11 and Resolution No. 5932 a lakeside patio area was not proposed nor approved. The additional hardcover must be removed. A partial copy of the as-built survey and resolution are attached. 3. Retaining Wall. The retaining wall near the driveway turnaround is not show on as-built survey and is considered hardcover. Depending upon which hardcover zone it is located in, it may be required to be removed. 4. Vegetative Buffer. The required vegetative buffer size has been modified. Please restore the buffer to the approved size and plantings. If planting have changed from what was approved, provide a new planting plan. All construction activity must stop immediately until the above issues are resolved. A stop work order will be issued if activity continues. The property is in violation of Resolution No. 5932 and must be restored to the approved as-built condition. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. If you choose not to restore the property to its approved condition, you must apply for an after- the-fact variance. After-the-fact (double) fee will apply. You should note that according to Resolution No. 5932, page 3 of 4, Item #2, any future request to increase hardcover or change the nature of the existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. They are not all going 30 mph either as the speed limit is posted. Shadywood is a very, very busy road as you know. Some of the drivers are going 40-45-even 50 mph. There is "ZERO"time for drivers to re-act to me pulling out of my driveway backwards currently because I can't go out out forward. I'm basically just praying that nobody is coming while I just go for it and pull out of there..... What makes it even worse is my neighbor one house down is sometimes parking a business van and a trailer in his driveway and if that is there I can't see ANYTHING! Please also take note that I could of seriously injured or even worse killed a guy on a motorcylce today, along with almost causing several other accidents in the past few days. It is very, very, VERY dangerous! I'm not kidding, it is a disaster in the making. For your enjoyment, attached is a picture of what I paid $975,000 for in Jan. 2007 and now have $2,500.000.00 million dollars into this silly on-going disaster. I wish I would have left what was there and let somebody else deal with all of the hassles. What a nightmare this has been for me...Look at the curb appeal I have done for the area and how I have helped the economy with building a new house. I felt good about, but don't anymore and regret the whole deal. I honestly didn't need all of this stress caused by the ideas of others, but do accept 100% responsibility for the end result actions, even though I shouldn't. Since the plan is not to scale, we are unsure if the proposed driveway changes meet City code requirements. The driveway must be as wide as the garage...all three stalls and at least 15 deep before it can begin to taper. The proposed plan must be put onto a survey, by a registered land surveyor. A zoning application must be submitted, with all the requirements including an updated survey and hardcover calculations by November 16th. A zoning application is attached. The violations on this property were to be corrected by October 19, 2012. If we don't receive a complete application by noon on Friday November 16tn we will be forced to send this matter to the City Attorney for review and may result in legal action. For your information I have attached a partial copy of a survey dated, October 17, 2012 and hardcover calculations. The allowed hardcover on the property is 25% of the entire lot.
