A RESOLUTION
GRANTING VARIANCES
TO THE ORONO,MINNESOTA, CITY CODE
SECTIONS 78-350 AND 78-1288
FILE NO. 10-3456
WHEREAS, Steven B. Dore, a single person, (hereinafter "Owner") is the
owner of the property located at 2172 Shadywood Road within the City of Orono
(hereinafter "City") and legally described as: Lot 18 and that part of Lot 19 lying
southeasterly of a line drawn parallel with the southeasterly line of said Lot 19 and distant
12.5 feet northwesterly therefrom in Block 1, WILEY'S PARK LAKE MINNETONKA
Hennepin County, Minnesota(hereinafter "the Property"); and
WHEREAS, True North Homes, Inc. has made application on behalf of the
Owner to the City for variances to Orono Code Section 78-350 to allow construction of a
replacement house on the Property which has a width at the lake shore of 62 feet when a lot
width of 100 feet at the lakeshore is required and an area of 0.43 acre when an area of 0.50
acre is required; and
WHEREAS, True North Homes, Inc. has made application on behalf of the
Owner to the City for a variance to Orono Code Section 78-1288 to allow 38.96 percent
hardcover in the 75 to 250 foot zone when 25 percent is allowed; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission
held a public hearing on April 19, 2010, at which times all persons desiring to be heard
concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota: •

2. The Property is located in the LR-1C zoning district, where 0.5 acre is the
minimum lot area and 100 feet is the minimum lot width. The Property is
approximately 0.43 acre in area and 62 feet in width.
3. The Plarming Commission reviewed this application on April 19, 2010 and on
a vote of 5 - 0 recommended:
a. Approval of the lot width and area variances, based on the following
findings:
i. The Property was platted in 1907 and has existed in its current
configuration since 1950 and probably earlier.
ii. There has been a seasonal residence on the Property since 1920 or
earlier.
iii. No adjacent property is owned by the Owner or available to
purchase to enlarge the lot.
iv. The location and size of the proposed house are compatible with the
lakeshore houses in this area.
b. Approval of a hardcover variance subject to the amount of hardcover being
reduced by 418 square feet, based on the following finding:
Reasonable use of the Property includes a view of the lake. The
proposed house could be constructed on the lot without a hardcover
variance. However, because of the narrowness of the lot and the
location of the houses on either side, the lake view would be severely
limited. The additional hardcover allows the house to be located near
the average lakeshore setback.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments
by the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air
nor pose a fire hazard or other danger to neighboring property; would not

merely serve as a convenience to the Owner but are necessary to alleviate a
demonstrable hardship or difficulty; are necessary to preserve a substantial
property right of the Owner; and would be in keeping with the spirit and intent
of the Zoning Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a variance to Orono
Code Section 78-350 to allow construction of a replacement house on the Property which has
a lot width at the lake shore of 62 feet when a lot width of 100 feet is required and an area of
0.43 acre when an area of 0.50 is required as well as a variance to Orono Code Section 78-
1288 to have 35.29 percent hardcover in the 75 to 250 foot zone when 25 percent is allowed,
subject to the following conditions:
1. Council approval is based on the site and house plans submitted by the
Applicant and annotated by City staff, attached to this Resolution as Exhibits A
and B. Any amendments to these plans may require further Planning
Commission and City Council review.
2. Hardcover in the 0-75' zone shall be limited to 0 s.f. or 0%. Hardcover in the
75-250' zone shall be limited to 4,040 s.f. or 35.29%. Hardcover in the 250-
500' zone shall be limited to 626 s.f. or 24.89%, per the proposed site plan and
hardcover allowance summary as depicted on Exhibit C. The Owner is
advised that any future requests to increase hardcover or change the nature of
existing/approved hardcover shall require City approval, and increases in
hardcover will not likely be approved without concurrent reduction in existing
hardcover.
3. Owner shall not place any plastic or fabric liner material under any landscaping
on the property to ensure their permeability as non-hardcover surfaces.
4. Authorities granted by this resolution run with the Property not with the
Owner, but are permissive only and must be exercised by obtaining a building
permit for the new construction before May 10, 2011 or the variances will
expire on that date.

5. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
6. The undersigned Owner has read, understood and hereby agrees to the terms of
this resolution and on behalf of his heirs, successors and assigns, hereby agree
to the recording of this resolution in the chain of title of the property.
