Sec.13.04 RIGHTS OF SUBlECTS OF DATA

Su6division/. Type ojdata The rights oJindividual on whom the data is stored or to be stored shall be as set forth in this section.
Subd.2. Injormation required to be given individuaL An rndividual asked to supply private or confidentia!data concerning himse[f
shall be informed of (a)the purpose and intended use of the requested data withrn the collecting srate agency,political subdivision,or statewide
system;(b)whether he may refuse or is legal[y required to supply the requested data;(c)any known consequence arising from his supplying or
refusing to supply private or confrdential data;and(d)the identity of o[her persoru or entities authorized by state or federa!law to recerve the data.
This requirement shall not apply when an individual is asked to supply imestigative data,pursuant to section 13.82, subdivisron S, to a lmv
enjorcement o�cer.
The commissioner of revenue mav place the notrce reouired under this subdivision in the individual income tax or Dropertv tax refund
rnstructiorrs instead olon those torms.
Subd.3.Access to data by individuaL Upon request to a responsrble authority,an individual shall be informed whether he is lhe subject
of stored data on individuals,and whether it is classrfied as public,privale or conf dential. Upon his further request,an indivrdua!who is the
subject of stored private or public data on indrvrduals shall be shown the data without arry charge to him and, rf he desires,shall be injormed of
the content and meaning of that data.�After an individual has been shotivn the p�rvate data and informed of its meaning, the data need not be
disclosed to him for six months therea,f'ter unless a dispute or action pursuant to this sectron is pending or additronal data on the rndrvidual has
been collected or created. The responsible authorrty shall provrde copies of the prrvate or public data upon request by the rndrvidua!subject of
the data. The resporrsible authority may require the requesting person to pay the actual costs of making,cert�rng,and compiling the copies.
The responsible authority shall comply immediately,ifpossible,with any request made pursuant to thrs subdivrsion,or within feve days
of the date oJthe request,excluding Saturdays,Sundays and lega!holidays,tf immedrate compliance is not possible. If he cannot comply with the
request within that time,he shall so inform the rndivrduaJ,and may have an addrtional five days within which to comply with the request,excluding
Saturdays,Surutays and legal holidays.

data cortcerning himself To exercise this right, an individual shal!notify in writing the resporuible authority describrng the nature of the
disagreemenL The responsible authority shall within 30 days erther: (a)correct the datafound lo be rnaccurate or incomplete and attempt to not�

to be correct. Data in dispule shall be disclosed only if the individual's statement ojdisagreement is included with the disclosed data.
