LA18-000080 <br /> WHEREAS, the City of Orono is a municipal corporation organized and <br /> existing under the laws of the State of Minnesota; and <br /> WHEREAS, North Arm Farm, LLC (hereinafter the "Owner") is owner of <br /> the property within the City of Orono, and legally described as follows: <br /> Lots 1 and 2, Block 1 Franzel Addition, Hennepin County,Minnesota <br /> (hereinafter the "Property"); and <br /> WHEREAS, the property is subject to that certain Access Easement <br /> Agreement in favor of the City of Orono dedicated and recorded with Hennepin County as <br /> Document No. 4780829; and <br /> WHEREAS, the aforesaid easement provides for an access route that does <br /> not reflect an accessible route due to steep slopes; and <br /> WHEREAS,the City has accepted a replacement easement that provides for <br /> usable access to the liftstation, making the original easement obsolete, and; <br /> WHEREAS, after due published and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono City Council held a <br /> public hearing on September 24, 2018 regarding said vacation and all interested persons <br /> were given an opportunity to be heard; and <br /> WHEREAS, the Orono City Council finds the vacation as proposed is in <br /> keeping with the public interest and in consideration of the following findings: <br /> 1.
