BUILDING PERMIT ESGROW AGREEMENT

AGREEMENT made this�day of_ , 20��, by and between the
ClTY OF ORONO, a Minnesota municipal corporation ("C� y") and Darere C. Marhula ("Owner").
Recitals
1. Owner has filed an Application for a building permit formally requesting the City to review
plans for a new principal strucfiure located at 2100 Shadywood Raad the "Subject Property", as
more fully shown below:
Lot 30, Block 1, W1�EY'S PARK, LAKE M(NNETONKA, except that part
thereof lying northwesterly of a line drawn northeasterly frorn the most
westerly comer of said lot to the shore af Lake Minnetonka, which line
forms an angle of 80 degrees 36 minutes with the southwesterly line of
said lot, at the most westerly camer of said lot, Nennepin County,
Minnesota.
2. Owner requests the City to review said plans which reguires City approval inctuding
grading.
3. The City will commence its review af the application and incur costs associated with said
review only if the Owner esfiablishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLL�WS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the 4wner shall deposit $2,500 with the City. AI! accrued interest, if any, shall be paid to
the City to reimburse the City for its cosf in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to
the City far all out-of-pocket costs the City has incurred (including planning, engineering, in excess of
$500, or legal cansultant review) or wifE incur in reviewing the plan. Eligible expenses shal! be
consistent with expenses the Owner would be responsible for under a zoning and subdi�ision
application.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City
will in turn send a bill to the Owner. Owner shall be responsible for payment to the City within 30 days
of fhe Owner's receipt of bill.
4, DISBURSEMENT FROM ESCROW ACCOUNT, In the event thaf the Owner does not
make payment to the City within the timeframe outlined in#3 above, the City may draw from the escrow
account without further approval of the Owner to reimburse the City for Eligible expenses the City has
incurred. The City shall notify the Owner the Owner of such draw and the nature of the expense for
which the reimbursement is being made, If the Escrow amount falls below 75% of the original escrow
amount the Owner shall deposit additional surns as directed by the City, or the City shall discontinue
review and post a Stop Work Order.
4. CLOSIPIG ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owner when the review has been compieted and written notification is received from the Owner
requesting the funds.
5. CERTIFY UNPAID CHARGES. If the project is abandoned by Owner, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§495.01 and 366.012.

BUILDING PERMIT APPLICANT: PROPERTY OWNER
I, ��Q�,�J M(�-21�� , understand that the State of Minnesota requires
that all residential building contractars, remodelers and roofers obtain a state license
unless they qualify for a specific exemption from the licensing requirements. This license
requirement applies to owners of residential real estate who build or improve such
property for purposes of speculation or resale.
By signing this document, I attest to the fact that I am improving this house for my own
use and am not building or improving this house for the purpose of reselling it. I hereby
claim to be exempt from the state licensing requirements because I am not in the business
of building or remodeling on speculation or for resale and that the house for which I am
applying for this permit, located at �I�C� S�I/�Clw woo��Orono, is the first
residential structure I have built or improved in the past 24 months. I also acknowledge
that because I do not have a state license, I forfeit any mechanic's lien rights to which I
may otherwise have been entitled under Minn. Stat. �514.01.
Furthermore, I acknowledge that I may be hiring independent contractors to perform
certain aspects of the construction or improvement of this house and I understand that
some of these contractors may be required to be licensed by the State of Minnesota. I
� understand that unlicensed residential contracting,remodeling, and/or roofing activity is a
misdemeanor under Minn. Stat. §326B.082, subd. 16 and can also result in a fine of up to
$10,000. I further state that I understand that the filing of a false statement with the City
of Orono may also result in criminal prosecution and/or civil penalties pursuant to
applicable city ordinances and/or state statutes.
I have also been informed and acknowledge that by listing myself as the contractor for
this project, I alone will be responsible to the City of Orono far compliance with all
applicable building codes and city ordinances in connection with the work being

BUILDING PERMIT ESCROW AGREEMENT
AGREEMENT made this�,Z day of , 20d I, by anc{ between the
CITY OF ORONO, a Minnesota municipal corporafion ("C' yp) and Daren C. Marhula("Owner°).
Recitats
1. Owner has filed an Application for a building permit formally requesting fhe City to review
plans for a new principal strucfiure located at 2100 Shadywood Road the "Subject Property", as
mare fully shown below:
Lot 30, Block 1, WILEY'S PARK, LAKE MINPIETONKA, except that part
thereof lying northwesterly of a line drawn northeasterfy from the most
westerly comer of said lot to the share of Lake Minnetonka, which fine
forms an angle of 80 degrees 36 minutes with the southwesterly �ine of
said lot, at the most westerfy camer of said lot, Hennepin County,
Minnesota.
2. Owmer requests the City to review said p(ans which requires City approval including
grading.
3. The City will commence i�s review af the application and incur costs associated with said
review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
MOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUWDS. Contemporaneously with the execution of this Escrow
Agreement, the Owner shall deposit $2,500 with the City. AIf accrued interest, if any, shall be paid to
the City to reimburse fhe City fiar its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to
fhe City for all out-of-packet costs the City has incurred (including planning, engineering, in excess of
$500, or legal consultant review) or wil! incur in reviewing the plan. Eligible expenses shall be
consistent with expenses the Owner would be responsible for under a zoning and subdivision
application.
3. MONTHLY BILIJNG. As the City receives consultant bills for incurred costs, the City
will in tum send a bi[I to the Owner. Owner shall be responsibls far payment to the City within 30 days
of the Owner's receipt of bill.
4. DlSBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owner does not
make gayrnent to the City within the timeframe outlined in#3 above, the City may draw from the escrow
account without further approval of the Owner to reimburse the City for Eligible expenses the City has
incurred. The City shall notify the Owner the Owner of such draw and the nature of the expense for
which the reimbursement is being made. ff the Escrow amount falls below 75% of the original escraw
amount the owner shall deposit additional sums as directed by the City, or the City shall discontinue
review and po5t a 5top Work Order.
4. CLOSfNG ESCROW. The Balance on deposit in the escrow, if any, shall be retumed to
the Owner when the review has been completed and written notification is received from the Owner
requssting the funds.
5. CERTIFY UPfPAID CHARGES. If the projeot is abandoned by Owner, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§495.01 and 366.012.
