Dear Melanie:
We reviewed the grading plan dated 6-4-09 for the proposed new home construction at
2100 Shadywood Road. We reviewed the plan for compliance with Chapter 79 of
Orono's Land Use Code. We have the following comments with regards to engineering
matters:
• The grading plan is acceptable from an engineering standpoint.
• The applicable code section is 79-7(c)(1) for individual residential lots disturbing
less than 1 acre of land and fill or excavation of less than 100 cubic yards.
• All submittal requirements have been met except 79-7(c)(1)(h) regarding
appropriate best management practices listed in Section 79-9.
• To bring this submittal in to compliance with the ordinance, the following
information should be provided separately or on the grading plan.
o A statement indicating the plan to handle waste and material disposal.
o A statement indicating the plan to handle hazardous materials.
o A statement indicating the plan to handle liquid waste.
o Show that adequate sanitary facilities will be provided for site workers.
o A statement indicating that any sediment tracked on to a public road will
be removed by street cleaning before the end of each workday.
o Identify and show drain inlet protection for storm sewer on the project
site and along haul or delivery routes.
o A plan indicating the erosion and sediment control inspection and
maintenance requirements as stated in Section 79-9(g)(1),(2),(3),(4)
• The $2,000 financial guarantee identified in Section 79-7(b)(2) should be
sufficient for this project.

Waste and material disposal will be put in 30 yard dumpster provided by Hawkins Tree and Landscape
then hauled and dumped at Demcon.
Hazardous waste and liquid will be disposed at Viola.
Onsite sanitary facility will be provided by limmy's Johnny for site workers.
Any sediment tracked on roadway will be cleaned by the end of the day.

Dear Melanie:
We reviewed the grading plan dated 6-4-09 and the additional information provided by
the applicant dated 6-18-09 for the proposed new home construction at 2100
Shadywood Road. We reviewed the plan for compliance with Chapter 79 of Orono's
Land Use Code. We have the following comments with regards to engineering matters:
• The grading plan is acceptable from an engineering standpoint.
• The applicant has addressed all previous comments regarding erosion and
sediment control except Chapter 79-9(g)(1),(2),(3),(4). The application can be
made complete and acceptable by adding the following to the submittal
documents.
(g) Inspections and Maintenance. The applicant shall be responsible for
conducting inspections and maintenance of all erosion and sediment
control BMPs on site.
(1) Inspections, maintenance, and rainfall on site must be
documented and readily available for review. Inspections are
required as followed:
a. Once every seven (7) days on exposed soil areas.
b. Within twenty-four (24) hours after a one half inch or
greater rain event over twenty-four (24) hours.
c. Once every thirly (30) days on stabilized areas.
d. As soon as runoff occu'rs or prior to resuming construction
on frozen ground.

(2) Maintenance is required as follows:
a. When sediment reaches 1/3 the height of the BMP on
perimeter control devices, sediment must be removed
within twenty-four (24) hours of discovery.
b. If the perimeter control device is not functional it must be
repaired or replaced within twenty-four (24) hours of
discovery.
c. Temporary sediment basins shall be maintained when
sediment reaches �/z the outlet height or �/z the basin
storage volume. Basins must be drained or sediment
removed within seventy-two (72) hours of discovery.
d. Sediment must be removed from paved surfaces within
twenty-four (24) hours of discovery.
(3) Erosion into Streets, Wetlands or Water Bodies. If eroded soils
(including tracked soils from construction activities) enter or
appear likely to enter streets, wetlands, or other water bodies,
prevention strategies, cleanup and repair must be immediate with
the appropriate approvals from the DNR, MPCA, or any other
state, federal, or local agencies as necessary. The applicant shall
provide all traffic control and flagging required to protect the
traveling public during cleanup operations.
(4) Erosion Off-Site. If erosion breaches the perimeter of the site, the
applicant shall immediately develop a cleanup and restoration
plan, obtain right-of-entry from the adjoining properly owner and
get appropriate approvals from all state, federal, and local
agencies as necessary. Then implement the cleanup and
restoration plan within forry-eight (48) hours of obtaining the
adjoining property owner's permission and approval from any
appropriate state, federal, and local agencies.
• The $2,000 financial guarantee identified in Section 79-7(b)(2) should be
sufficient for this project.
