A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTIONS 78-350(B) & 78-1288
FILE NO. 09-3391
WHEREAS, Daren Marhula, a single person (hereinafter "the Applicant") is the
owner of the property located at 2100 Shadywood Road within the City of Orono (hereinafter the
� "City") and legally described as follows:
��
� Lot 30, Block 1, WILEY'S PARK, LAKE MINNETONKA, except that part
� thereof lying northwesterly of a line drawn northeasterly from the most westerly
� - corner of said lot to the shore of Lake Minnetonka, which line forms an angle of
80 degrees 36 minutes with the southwesterly line of said lot, at the most westerly
� corner of said lot, Hennepin County, Minnesota(hereinafter the "property"); and
�
WHEREAS, the Applicant has made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-350(B) to allow a new home to be
constructed on a property 61 feet in width at the OHWL and 69 feet in width at the 75 foot lake
setback where a width of 100 feet is normally required; and
WHEREAS, the Applicant has made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1288 to allow 3,876 s.f. (28.4%) of
hardcover within the 75' —250' zone where 3,417 s.f. or 25% is normally allowed in conjunction
with the construction of a new home and detached garage.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File 09-3391.
2. The property is located in the LR-1C Residential Zoning District which requires a
minimum lot area of 21,780 s.f. or 0.5 acre and a minimum lot width of 100'.

3. The Planning Commission reviewed this application at a public hearing held on
February 17, 2009 and recommended approval of variances based on the
following findings:
a. The subject property contains 20,290 s.f. or 0.46 acre and has a width of 61' at
the OHWL of Lake Minnetonka and 69' at the 75' lake setback.
b. The lot is substandard in width and a residence has existed on the property for
many years.
c. There is no additional land available to bring the lot width into conformity.
d. The property currently contains 36.6% hardcover within the 75' -250' zone;
the Applicant's proposal suggests a reduction of 1,134 s.f.
e. The hardcover variance as requested is in line with the levels of hardcover
variances approved on rebuild applications with similar lot conditions. At
14%, the proposed residence is below the structural lot coverage limitation of
15%.
f. The proposed structure complies with all lake yard, side yard, rear (street)
yard, and average lakeshore setback requirements.
g. The proposed home is reasonably sized and fits into the immediate
neighborhood.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments by
the Applicant and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variances would not adversely affect traffic conditions, light, air nor pose a
fire hazard or other danger to neighboring property; would not merely serve as a
convenience to the Applicant, but are necessary to alleviate a demonstrable
hardship or difficulty; are necessary to preserve a substantial property right of the
Applicant; and would be in keeping with the spirit and intent of the Zoning Code
and Comprehensive Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a variance to
Orono Municipal Zoning Code Section 78-350(B) to allow construction of a new house on a lot
with a width of 61 feet when a width of 100 feet is required and a variance to Section 78-1288 to
allow 28.4% hardcover within the 75'-250' zone where 25% is normally allowed in conjunction
with the construction of a new residence and detached garage, subject to the following
conditions:
1. Council approval is based on the site plan, landscape plan and house renderings
submitted by the Applicant and annotated by City staff, attached to this Resolution as
Exhibits A, B and C. Any amendments to these plans that are not in conformity with
City codes will require further Planning Commission and City Council review.
2. Hardcover in the 0-75' zone consists of an allowed lake access stair and 85 s.f. of
boulders. Hardcover in the 75-250' zone shall be limited to 3,876 s.f. or 28.4% per the
site plan as depicted on Exhibit A. Applicant is advised that any future requests to
increase hardcover or change the nature of existing/approved hardcover shall require City
approval, and increases in hardcover will not likely be approved without concurrent
reduction in existing hardcover.
3. Applicant shall not place any plastic or fabric liner material under any landscaping on the
property to ensure their permeability as non-hardcover surfaces.
4. Proposed removals of structure and hardcover to be removed shall be completed prior to
a footing inspection for the proposed home.
5. The handrail for the patio staircase cannot exceed 42" in height within the average
lakeshore setback.
6. SURVEYS REQUIRED:
a. A foundation survey with setbacks and top of foundation elevations is required to
be submitted prior to commencement of framing; and
b. An as-built survey with topography and hardcover calculations verifying
compliance with the building permit, stormwater management, grading and

drainage plans shall be submitted prior to the issuance of a Certificate of
Occupancy for the residence.
7. Authorities granted by this resolution run with the property not with the Applicant, but
are permissive only and must be exercised by obtaining a building permit for the new
construction within one year of the date of Council approval, or the variance will expire
on that date (March 23, 2010).
8. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
9. The undersigned Applicant has read, understood and hereby agrees to the terms of this
resolution and on behalf of the Applicant and the Applicant's heirs, successors and
assigns, hereby agrees to the recording of this resolution in the chain of title of the
property.
