SGT Erickson requested I stop by their office and speak with the reporting party (RP) David Albertson. I arrived and met with Albertson who said he has lived in the area for years and has always used city property (an alley just south of 1998 Shadywood Road), to go through the area as he is snowmobiling. RP said years ago the city had the alley posted as a Fire Lane. RP told me the owner at 1998 Shadywood had a variance issued so the house there could be built three feet onto the alley. RP said over the years someone has removed the gravel from the alley and planted grass. The area is also no longer posted as a Fire Lane. He has still used the alley up until this year for snowmobiling with no problems. RP gave me a copy of a city map he said he obtained from the city of Orono last week. The map shows that there is an alley that runs between two residences just south of 1998 Shadywood Road. The RP marked the on the map that the alley is a Fire Lane however the original map only shows the area is an alley that is city property. RP said this year the resident at 1998 Shadywood Road has been causing problems for him when he tries to use the alley. The resident there has had a camper parked blocking the alley. When RP put his fire lane flier (see attached map), on the camper the RP said the resident came out and screamed at him. The camper was moved however. RP said his brother tried to drive through on his sled when the resident came out of his house and threw a 2 X 4 piece of wood in the way. RP said his brother drove over it and continued on his way. R.P said resident now has put up a No Snowmobiles Allowed Sign up by the alley, has strung rope up between the two residences that border the alley and parked a snowmobile in the alley to block access along with two sawhorses. RP wants to know if he can use this alley to sled through and if we can unblock the alley. OBSTRDCTIONS IN STREETS AND PRIVATE ROADS. Subd. i. Obstructions. It is a misdemeanor for any person to place, deposit, display or offer for sale, any fence, goods or other obstructions upon, over, across or under any street or private road without first having obtained a written permit from the City, and then only in compliance in a1I respects with the terms and conditions of such permit, and taking precautionary measures for the protection of the public. An electricai cord or device of any kind is hereby included , but not by way of limitation, within the definition of an obstruction. Subd. 2. Fires. It is a misdemeanor for any person to build or maintain a fire upon a street or private road. Subd. 3. Dumping in Streets or Private Roads. It is a misdemeanor for any person to throw or deposit in any street or private road any naiJ.s, dirt, glass or glassware, cans, discarded cloth or clothing, metal scraps , garbage , Ieaves, grass or tree �imbs , paper or paper products , shreds or rubbish, oil , grease or other petroieum products, or to empty any water containing salt or other injurious chemicai thereon. It is a vioiation of this Section to haul any such material , inadequateiy enclosed or covered , thereby permitting the same to fali upon streets or private road. It is aiso a vioiation of this Section to place or store any building materiais or waste resulting from building construction or demolition on any street or private road without first having obtained a written permit from the City. The building oermittee shali remove alI construction or demoiition waste, or soil washed or tracked into any street. Subd . 4 . Signs and Other Structures . It is a misdemeanor for any person to place or maintain a sign , advertisement, or other structure in any street or the right-of-way of any private road. Subd. S. Placing Snow or Ice in a Roadway. It is a misdemeanor for any person, not acting under a specific contract with the City or without speciai permission from the City, to remove snow or ice from private property and piace the same in the roadway of any street or private road.
