On August 13, 2015 the Ciry received a buifding permit application for a second story addition. Staff conducted a
preliminary review based on the information provided and recommends the following items be submitted or revised in
order for your application to be considered complete and for the plan review to continue:
1. Resolution. The property owners should make arrangements to sign the original resolution at the City Offices
(Monday through Friday, 8:00 am to 4:30 pm). The signatures of both Jeff and Elaine are required on the
resolution. They don't need to sign the document at the same time, but when they arrive they should have a
driver's license or other form of identification along with them for their signatures to be notarized.
2. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal
of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City
for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee
conformance with City Code Chapter 79 relating to erosion control and stormwater. No additional escrow
money is required at this time. An updated escrow agreement is enclosed. The properry owner must sign the
escrow a�reement and return.
Your project probably won't trigger the Minnehaha Creek Watershed District's(MCWDs) permitting requirements;but
please contact the MCWD directly at 952-471-0590 regarding your project. Please note,the City of Orono will not issue
a building permit without a copy of the MCWD permit or documentation stating the proposed project does not trigger
any of their permitting requirements. The above information is required in order for the plan review to continue.

Finally had a chance to pull your file and look at the survey. I reviewed the survey and based on the elevations provided
by Frank Cardarelle's survey (Advance Surveying didn't have any topography or floor elevations) it appears there will not
be a problem raising the first floor 8 inches... the basement will still be defined as a basement. Also if you and Ryan have
concluded that the a i ional 8 inc es results in a stili conforming height as measured from existing grade you should
proceed with permitting.

Hi Melanie-
Ryan came over to the house yesterday to do some final measurements and a question came up. We have been
planning on maintaining the first floor and building up from there. In looking at the first floor structure (which
was originally constructed in 1920), we all kinda think it would be better to replace the first floor with new
trusses. Then, the next question is, if we do that, does it make sense to add a course of block around the
perimeter which would add about 8 inches of height to the basement (currently the basement is only 6 feet 6
inches to the ceiling). Of course, doing this would add height to the whole structure. I believe we are well
below the height restrictions where we would need any sort of variance so is it possible to increase the height of
the building as long as we are within the height requirements?
We need to know this befare we can finalize the plans.

AGREEMENT made this q+h day of �-C �e , 20 15, by and between the CITY OF ORONO,
a Minnesota municipai corporation ("City"}and�� o�t{"Owners"y.
Recitals
1. A building permit application has been filed for a second story addition located at
1990 Shadywood Road the ("Subject Proper#y"j, legally described as Lot 40, Shady-Wood, Hennepin County
Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUIVDS. Contemporaneously with the execufion of this Escrow
Agreement, the Owners shall deposit$2,500 wifh the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the pfan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit appfica6on. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Poflution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2015-01032 and Land Use
Application#15-3750 if comp(iance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As khe City receives consultant bills for incurred costs, the City wi11 in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event Ehat the Owners do not make payment
to the City within the fimeframe outlined in#3 above, shafl issue a Stop Work Order until the Owners pay alf expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners Eo
reimburse the City for eligibfe expenses the City has incurred.
5. CLOSlNG ESCROW. The Balance on deposit in the escraw, if any, shal! be returned to the
Owners when the review has been completed and written notification is received firom the Owners requesting #he
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City sha9f have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

2. Owners request the City to review said plans which requires City approval and may require
consulting legal and/or engineering review.
3. The City is willing to commence its review of the application and incur costs associated with said
review only if the Owners establish an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $�:��0��with the City. All accrued interest, if any, shall be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, or legal consultant review) or will
incur in meeting with the Owners, reviewing the plans, and preparing agenda packet material for City Council
review of application#� - �. Eligible expenses shall be consistent with expenses the Owners
would be responsible for under a land use application.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall cease all reviews until the Owners pay all
expenses invoiced pursuant to #3. The City may draw from the escrow account without further approval of the
Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when all requirements related to the project are complete. City Staff shall review the terms of this escrow
agreement iwo times per year to determine whether the requirements of the project have been successfully
completed and whether it is appropriate to return the funds. Owner may also request the release of the funds,
and such funds shall be released upon City Staff receiving the appropriate verification that all requirements of the
project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
