It appeazs that the fence and gate were installed on Hennepin County's property, within the right-of-way for Shadywood Road. Hennepin County owns approximately 110' of right-of-way in front of your property. According to City tiles, the southwes�� orner u:your garage is 3.4' from tYie frondstreet property line. Any fence or gate along a !�ront�:�:x?et pr,�nerty li�e for lakesh�re property is required to be 6 ft. or less in height and located t:ither on the property line ��r with>>� the Lot:.ndaries of the property line. It does not appeaz that the fence conforms to the location requirement. It also appeazs that tiie gate is on the County's property. I am not awaze that you have received permission from Hennepin County to locate a fence on their property. If you have received permission from the County to use their property in this manner, please provide me with this information so that I may place it in the street file for this property. Pedestrian Traffic: The Permittee shall maintain, at all times, safe facilities for pedestrians/bicyclists through the project area. Access to Local Businesses and Residences: The Permittee shall maintain, at all times, any and all esisting access to adjoining properties and residential streets. Miscellaneous: Any Hennepin County survey monuments, disturbed during the construction, shall be collected and stored at one location by the permittee. The Surveyor's office shall be notified at (612) 348- 3131 to pickup any monuments. Any mailboxes disturbed by this project shall, immediately, be re-established to original or better condition. Any fence constructed as part of this project shall be installed in such a fashion as to not impede sight distance to adjoining driveways. All structure casting elevations shall match existing surratmding terrain. The permittee shall incorporate adequate erosion control measures to ensure CSAH 19 right-of- way or existing drainage devices/ditches are not impacted. If erosion and/or site sediment is deposited within County property, the permittee shall immediately cease all operations within County property and restore such to original or better condition. This permit is issued "after-the-fact". The fence was installed �vithin County property and therefore eYists at the discretion of Hennepin County. The fence may at some future time require relocation inside the private property of the homeowner.
