You labeled the back of wall as 7.0'. I think this was to the back of the old wall, or you typed incorrectly because the back of the new wall is 5.7'+/- (for wiggle in the wall). Would you please correct this for my records. Also, on the latest version you labeled the neighbors garage (7.1') and their house (31.4') off the line, but the notation of(6.0') for the location of our house off the line disappeared. I know there is a lot of ineasurements and notes in that area, but can you squeeze that in there also so it is all on one copy? Thanks. Attached are pictures from my site visit. As you will see,the wall varies between 4-6 inches of the lot line to the 1880 side. There are 3 points with pins in the ground, and I added an additional 3 lathes for double checking. Working from street to lake. Lath 1 - marks pin Lath 2 - line at edge of house near wall termination. (6.0 feet off foundation per survey) Lath 3- line at corner of neighbors garage. (7.1 feet off foundation per survey) Lath 4 -marks pin(mid span) Lath 5 - line at edge of house near wall termination. (6.0 feet off foundation) Lath 6 -marks pin(lake side). Pictures to follow in same order as described above. Any questions let me know. The reasonable manner would be far proper surface water drainage. The house was built in 1953 and is located approximately 6'-0" off of the south property line. The house has a 7'-0"basement and the egress windows are located on this south side.There would be no change in the manner of how the property has been used for the past 60+years. 2. Yes. The plight is a result of the age of the house and the condition of the grade that has been changed by nature over the last 6(7+years. The grade and remnants of old timbers buried in the bank along the south property line make it is reasonable to assume that over the couise of the last 60+years the grade has changed as a result of natural decay and erosion. This resulted in a 1:1 g�-ade toward the house from the property line to the egress window wells. The property was purchased in September 20Q6 and in the spring of 2007 the landscaping was improved(removing vegetation and installing a rock bed next to the house) in addition to adding gutters to help pmaide positive drainage away from the house. Over the course of the last seven years the area has continually deta-iorated due to the surrounding grade from the south directing water to this area and eroding the area further. 3. No. If the eariance is gx-anted for the re-build and e�ension at this location it will enhance,not alter, the essential character of the locality. We believe once sligk-itly past the ends of the house there is no value in changing the existing appearance of the current landscape. The grades at these points slopes positively away from the building. What erosion and decay has created at these points away from t1-ie house has become a"rolling�'topography of grass providing a pleasant and acceptable appearance for all adjacentparties. 4. "Reasonable use" for this area does not exist under the zoning Chapter without this wall. Positioning the retaining wall any closer to the house than at the property line will result in fiuther property damage by not providing an adequate buffer for drainage,air and egress to the building. We feel strongly because the area is so small the only reasonable use of the area is the existing egress window wells for the basement,surface water drainage and air circulation to prevent rot and mold of the building. 5. Both properties were"improved" in the early 1950's. 60 years of weather has changed to topog�aphy and conditions which are present between the two properties. What is also unique is that the house at 1880 is 6'-0"offthe property line,along with an accessory garage at 1890 being located 6'-0" ot�the property line in an area with(3)feet of elevation change between these structures. Re-grading the area with a proper swale,so the neighbor's water stays on their property,as a remedy will not work because of the grade elevation differences and the 70' of length with this issue. There are also utilities in this area that would have to be located and assumingly relocated. 9. Not Known 10. Yes. If this variance is not g�-anted the result would be one of two negative outcornes. 1.The gfiading of the yard at 1890 continues to shed water to the north resulting in water problems continually due to the topography. This is turn will result in the unsightly stacking of sandbags to protect the stxucture. 2.If the wall is built in eomplianee with the city ordinances the building suffers from lack of separation between grade and a wood structure resulting in physical damage and preservation of the prop�-ty. It will also result in the removal of the existing eg�ess window wells resulting in the limited enjoyment of the lower level as it is currently used. 11. No.The g�-anting of this variance will not adversely affect the zoning code. This is a simple existing condition that has been deteriorating over tune,not something new that proper plaruiing could have prevented. 12. Yes.There is no convenience associated to granting this variance except that allowing the retaining wall to be placed at the property line will result in a zero balance g�-ading situation. In other words we will not be adding or removing any soils from the area,just redistributing what is already there. It is however alleviating the difficulty of the drainage and water issues resulting f�m the existing conditions caused o�er tim�. StunmarY: The area we are asking for a variance t�o the retaining wall ordinance is 6' wide and 70' long. It is located to a side of the house that is not a foeal point from either the lake orthe road. One-third of this area is also common the neig�ibor's accessory garage which is also located 6'-0" off this same line and at an elevation 3'-0"higher than the grade at this property. The neighbor's located at 1890 Shadywood Rd. are in favor of this improvement as it will leeel outthe eroded slope of their yard and also help maintain adequate soil coverage over the footings at their accessory garage. They will not see the re�taining wall except for the top face from any point of their property. This may become a mute point as they have an intention to install a fence along this property line. No other person will see this wall as it will almost be entirely hidden from view because of the house only being 6'-0 off the property line and it not extending past the house front and back any more than what it takes to taper back down to existing gx-ade. The largest hardship is the water problem this condition has created over time. This variance would �liminate the hardship of continually cleaning a flooded basement and worry that the water is creating a potential for a future str-uctural problem with the foundation of the house which would result in a large disturbance to both us(1880)and our neighbor(1890)in order to remedy. Fences and walls within a required rear or side yard shall not exceed a height of six feet above original grade. b. Lakeshore lots. 1. Fences within the required street(rear)yard or side street yard of a lakeshore lot shall not exceed 42 inches above original grade. Exception: A fence not exceeding six feet in height may be located along the street lot line of a lake frontage lot which abuts a major thoroughfare. A major thoroughfare for purposes of this section means any county road or state highway. If such fence involves fill or berming, the total combined height of both fence and fill shall not exceed six feet above the height of the crown of the major thoroughfare. 2. Fences within the required side yard of a lakeshore lot shall not exceed six feet in height, and any portion located lakeward of the average lakeshore setback line shall not exceed 42 inches in height. The term "average lakeshore setback line" means a line drawn between the most lakeward projection of the fence owner's principal residence structure and the most lakeward projection of the adjacent affected principal residence structure. 3. Fences shall not be constructed within the defined lakeshore yard of a lakeshore lot, i.e., shall not be located within 75 feet of the shoreline for general development lakes, 100 feet for recreational lakes, or 150 feet for natural environment lakes. c. Special provisions. Split rail fences of no more than three rails within a required front, street or side street yard may have a maximum top rail height of 48 inches above original grade. Board rail fences within a front, street or side street yard for the specific purpose of enclosing permitted domestic animals may have a top rail height of 60 inches and shall be no more than 50 percent opaque. d. Intersection sightline obstruction prohibited. No fence shall be installed so as to obstruct a required clear view at street intersections as required by section 78-1371 e. Fence construction and maintenance. 1. The owner of a fence shall maintain it in a condition of reasonable repair and appearance and shall not allow it to become or remain in disrepair or in a dangerous condition. 2. Fences shall be installed with the finished side facing neighboring properties or the street. The term "finished side" means that side having no structural supports. (9) Entrance monuments, defined for the purpose of this section as a nearly permanent physical structure or object, natural or artificial, used to depict an entrance to the property, erected in all residential zoning districts are considered nonencroachments when they conform with the following standards: a. Each monument, with a maximum of two per approved driveway access, shall be limited to a single pillar with a footprint measuring no larger than 25 square feet and no length to exceed five feet; b. The monument must be setback a minimum of five feet from all property boundaries and never fewer than ten feet from the edge of the paved, traveled roadway; c. Plans and/or elevation views of the proposed monuments are required to be submitted for approval by the planning director; Page 2 ' �- d. All signage proposed for the monuments must comply with section 78-1467 e. The monuments are limited to eight feet in height including any appurtenances. Any monument exceeding the maximum height must meet principal structure setback requirements; f. When more than one monument is proposed, and serving two or fewer residences, a minimum horizontal width of 16 feet is required befinreen them; g. When more than one monument is proposed, and serving three or more residences, a minimum horizontal width of 22 feet is required between them; h. Lighting is allowed, in conformance with section 78-1573 and at the discretion of the planning director. i. When a gate is proposed, the following requirements must be met: 1. The gate must open into the property not outward towards the right-of-way, and 2. Gates serving two or fewer residences shall have a minimum horizontal width of 14 feet in the full open position, and 3. Gates serving three or more residences shall have a minimum horizontal width of 20 feet in the full open position, and 4. For all properties, gate height may not exceed the height of the monument, measured from grade, unless principal structure setbacks are met (if monuments are not proposed then gate height shall be regulated in accordance with the fence height regulations of section 78-1405(8), and 5. Gates must maintain an opacity level of no greater than 25 percent, and 6. For locked and/or secured gates a knox box, meeting the standards set forth by the police and fire department, must be provided for emergency access, and 7. On major thoroughfares the monuments and gates must be located 40 feet from the paved, traveled road to allow for vehicle stacking. A major thoroughfare for the purposes of this section means any county road or state highway. j. A building permit is required for installation. A survey must be submitted depicting where the monuments will be placed, and the property corner pins must be located for inspection purposes. (b) The following shall not be considered to be encroachments on structure height requirements: (1) Parapet walls that extend no more than three feet above the height of the building. (a) Grading and filling and excavations necessary for the construction of structures, sewage treatment systems, and driveways under validly issued construction permits for these facilities do not require the issuance of a separate grading and filling permit. However, all grading and filling activity approved permits for construction of structures, sewage treatment systems, and driveways shall adhere to the grading and filling standards of this article. (b) Grading, filling or excavating of more than 50 cubic yards is prohibited within 75 feet of the ordinary high water level of the public waters enumerated in section 78-1217 (c) Public and private roads, driveways, parking areas, and public or private watercraft access ramps shall not be constructed within 75 feet of the ordinary high water level of the public waters enumerated in section 78-1217. If no alternatives exist, such improvements shall be subject to the standard zoning variance review procedure, and such review shall take into account the following considerations: (1) Such improvements shall be designed to take advantage of natural vegetation and topography to achieve maximum screening from view from public waters. (2) All roads and parking areas shall be designed and constructed to minimize and control erosion to public waters consistent with the requirements of all agencies with jurisdiction. (d) Except for those projects requiring permits for construction of structures, sewage treatment systems and driveways, a land alteration permit will be required as follows: (1) For movement of up to 50 cubic yards of material within 75 feet of public waters as per item (b) above, a staff-issued land alteration permit shall be required. (2) For movement of 51 through 500 cubic yards of material anywhere within the Shoreland Overlay District, except for within 75 feet of public waters, a staff-issued land alteration permit shall be required. (3) For movement of more than 500 cubic yards of material within the Shoreland Overlay District, conditional use permit approval by the city council is required in addition to the required land alteration permit. (e) The following considerations and conditions must be adhered to during the issuance of construction permits, grading and filling permits, conditional use permits, variances and subdivision approvals: (1) Grading or filling in any type 1, 2, 3, 4, 5, 6, 7 or 8 wetland must be evaluated to determine how extensively the proposed activity would affect the following functional qualities of the wetland: a. Sediment and pollutant trapping and retention; b. Storage of surface runoff to prevent or reduce flood damage; c. Fish and wildlife habitat; d. Recreational use; e. Shoreline or bank stabilization; and f. Noteworthiness, including special qualities, such as historic significance, critical habitat for endangered plants and animals, or others. This evaluation must also include a determination of whether the wetland alteration being proposed requires permits, reviews or approvals by other sections of city ordinances or by other local, state or federal agencies including but not limited to watershed districts, state department of natural resources, or the United States Army Corps of Engineers. (2) Alterations must be designed and conducted in a manner that ensures only the smallest amount of bare ground is exposed for the shortest time possible. Page 1 � � � (3) Mulches or similar materials must be used, where necessary, for temporary bare soil coverage, and a permanent vegetation cover must be established as soon as possible. (4) Methods to minimize soil erosion and to trap sediments before they reach any surface water feature must be used. (5) Altered areas must be stabilized to acceptable erosion control standards consistent with the field office technical guides of the local soil and water conservation districts and the United States Soil Conservation Service. (6) Fill or excavated material must not be placed in a manner that creates an unstable slope. (7) Plans to place fill or excavated material on steep slopes must be reviewed by the city engineer for continued slope stability and must not create finished slopes of 30 percent or greater. (8) Fill or excavated material must not be placed in bluff impact zones. (9) Any alterations below the ordinary high water level of public waters must first be authorized by the commissioner of the department of natural resources under Minn. Stat. § 103G.245. (10) Alterations of topography must only be allowed if they are accessory to permitted or conditional uses and do not adversely affect adjacent or nearby property. (11) Placement of natural rock riprap, including associated grading of the shoreline and placement of a filter blanket, is permitted if the finished slope does not exceed three feet horizontal to one foot vertical, the landward extent of the riprap is within ten feet of the ordinary high water level, and the height of the riprap above the ordinary high water level does not exceed three feet. A riprap permit shall be obtained per the requirements of section 78-969 (� Excavations where the intended purpose is connection to a public water, such as boat slips, canals, lagoons and harbors, are prohibited above the ordinary high water level. Such excavations below the elevation or the ordinary high water level are subject to approval of the department of natural resources and other agencies with concurrent jurisdiction.
