A demolition permit must be obtained from the City by your contractor prior to removal. The 1985 fee schedule has established a fee of $30.00 for the demolition permit (an addi- tional fee of $.50 for the state surcharge to be included). Please contact Tom Jacobs of the Building and Zoning Department if you have any questions concerning application for the demolition permit. CITY of ORONU Poat Office Box 66�Crystal Bay,Minneeota 55323•Municipal Offices • • � . � � On the North Shore of Lake Minnetonka May 9, 1985 Dr. Milton and Dorianne Seifert 1856 Shadywood Road Wayzata, MN 55391 Re: Resolution of the City Council of Orono #1523 Dear Dr. and Mrs. Seifert: Per the Council directive set forth in Orono Resolution �1523, see enclosed, the rental of the two residential units adjacent to Hennepin County #19 must cease as of July 1, 1988. In that resolution, you as owners of the property were given the opportunity to use said structures for leqal non-rental purposes, - exclusively for guests, or as assessory structures for possible storage, etc. uses. If said structures are to be used as guest houses a Conditional Use Permit will be required by the City 'to legally establish the structures as guest house units. A Conditional Use Permit is a land use application requiring review and approval by the Planning Commission and the City Council. The filing dates for all land use applications are 25 days before the 3rd Monday of each month (- June 20th Pianning Commission meeting, deadline date is May 27, 1988 , July 18th Planning Commission meeting, deadline date is June 24th, 1988). If structures are to remain as assessory structures for approved assessory residential uses specific alterations to the structures will be required by the City as follows: 1. The sealing off of existing sewer lines serving each unit. 2. Removal of all plumbing fixtures. These alterations should be completed by July 29, 1988. You also may consider using one structure as a guest house and the other as an assessory structure. In any event, the City must ask that you submit a written statement concerning your intentions regarding the future use of the structures after all rental use ceases as of July 1, 1988. We would ask that this statement be submitted to the City no later than June 15, 1988. Mabusth Building & Zoning Administrator City of Orono P.O. Box 66 ' Crystal Bay, Minnesota 55323 Dear Ms. Manusth: I have your letter of May 9, 1988 to which I would like to respond. Below please find same: Unfortunately, we were out of the country at a medical meeting when your letter arrived. That, coupled with the backlog in the medical practice, will make it just about impossible to meet your deadline of May 27, 1988. The deadline of June 24 is no doubt manageable, but I am not clear why a meeting with the Planning Commission is being requested. Our contract stipulates that-- The applicants agree that the two rental units adjacent to Hennepin County Road 19 shall cease to be used as rental uni�ts in any �orm as of July 1, 1988. After July 1, 1988, these units may not be used for any purpose except for guests of the owner of the principle structure on a no consideration or payment basis. It is the i,ntent that after July 1, 1988, these buildings will not be rented in any way to anyone. In any event, the use of these two structures for rental purposes shall be terminated as of July 1, 1988 or upon sale or transfer of the property, or upon the applicants no longer being the owner thereof, whichever comes first. It would be my understanding that this contractual agreement binding both parties is a settled matter not requiring a conditional use perm�t. One intent is to use these guest houses for visiting medical professionals from other parts of the country and abroad. We are not interested in revisi.ng our contract so that these units could be used as an assessory structure. We would be interested in your response to the above. The applicant contends based on the very specific conditions of this resolution that he does not have to apply for a Conditional Use Permit for the guest house use. Mark, in reviewing the resolutions contends that item three on page 3 of Resolution �1523 suggests that all special conditions setforth in this agreement ar� null and void as of July 1, 1991 and that the guest house use must cease. Please advise if we can send a letter back to Dr. Seifert suggesting that guest house use can be made of the structures until July 1, 1991. Staff would appreciate your opinion at your earliest convenience. Please let me know if you need additional information from the old files on this long and lengthy application review.
