Your application is incomplete. The following items must be submitted or revised in order for your application to be considered complete and for the plan review to continue: 1. Certificate of Survey. A survey dated 5-10-13 was provided, but it does not show the average lakeshore setback. Please provide 2 copies of an updated, full size certificate of survey which meets all of the City's survey standards (enclosed). 2. Escrow � Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal of a $2,500 escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. Since this project does not involve land alterations, the required escrow amount is $700. The escrow agreement is enclosed. The property owner must sign the escrow agreement and submit a check for$700. Your project may trigger the Minnehaha Creek Watershed DistricYs (MCWD) permitting requirements; please contact the MCWD regarding your project. Please note, the City of Orono will not issue a building permit without a copy of the MCWD permits or documentation from the MCWD stating the proposed project does not trigger any of their permitting requirements. This tier is permitted up to 25% of the entire lot area to be hardcover. The hardcover calculations on file prepared by Mark Gronberg dated 5/10/10 indicate the hardcover on the property was 6,237 sq ft which included landscaped area with rock underlain with fabric. I believe that you would have enough hardcover available for a potential project according to my rough calculations, which should be verified by your surveyor. Your property is considered a lakeshore lot and according to City Code section 78-1279 (pasted below) structures on your property cannot be located forward, i.e. closer to the lake, than that of your neighbor. I have attached the building permit application. One requirement of the building permit application will be an updated survey, including hardcover calculations. As your neighboring property to the north does not have a principal structure make sure the surveyor you hire shows the lakeward most point of the neighboring property on your survey (the distance to be shown in feet). Building stairs off the deck, even over existing hardcover (fabric under rock) will require a variance. The Planning Commission and Council will like to see that you have made efforts to reduce hardcover on the property if they are to allow additional structure (and hardcover). Unfortunately all the fabric under rock is considered "illegal hardcover" according to our hardcover ordinance. Removing it will be a requirement of the variance and the square footage cannot be used as a "reduction" in existing hardcover. As you mentioned in an earlier email, the hardcover ordinance is being reviewed for possible modifications, but at this time we don't have a timeline for when it may get approved or the final verbiage, so we must follow the hardcover ordinance as it stands today.
