A RESOLUTION
APPROVING THE PLAT OF FRANZEL ADDITION
FILE NO. LA18-000066
WHEREAS, the City of Orono (hereinafter the "City") is a municipal corporation
organized and existing under the laws of the State of Minnesota;and
WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has
adopted subdivision and land development regulations for the orderly, economic and safe
development of land within the City;and
WHEREAS,on October 19,2016, Kevin Anderson("Developer")on behalf of James
Franzel, (the "Owne�'), submitted an application for approval of a preliminary approval of 3 lot
subdivision of the Property located at 800 North Arm in the City of Orono and legally described as:
Lot 9,Auditors Subdivision No.362 and Outlot 1,Pirates Cove,Hennepin County,Minnesota,
(hereinafter the"Property");
WHEREAS, at its regular meeting on June 26, 2017, the Orono City Council
granted approval for the Preliminary Plat per the findings and conditions of Resolution No. 6774;
and
WHEREAS, on June 25, 2018 the Owner made formal application for final plat
approval for the Property; and
WHEREAS, the Owner has made minor modifications to the preliminary plat, in
preparation of the final plat, has reduced the number of lots from 3 to 2, and has removed the
planned street extension.
WHEREAS, the Owner has agreed to comply with all pertinent conditions of
Resolution No. 6774 and has completed or has agreed to complete all other requirements of the
platting regulations of the City.
NOW, THEREFORE, BE IT RESOLVED that based on the findings of Resolution
No. 6774, the City Council of the City of Orono does hereby approve the plat of FRANZEL
ADDITION, Hennepin County, Minnesota(a copy of which is attached as Exhibit A)subject to the
following conditions:

1. Dedication on the plat of the perimeter Drainage and Utility Easement as required in
Resolution 6774.
2. The approvals granted in this Resolution shall become effective only when all conditions
of approval requiring actions by the Developer have been satisfied.
3. Building height determination shall be determined by the existing grades on the property
at the time the permit is applied for. No grading is approved.
4. The City and Owner have agreed to modify the existing easement by vacating the existing
access easement and replacing the text and the legal description to correspond to the
actual location of the improvement.
5. There are no modifications to the Average Lake Setback as prescribed in the Orono
Zoning Ordinance.
6. Payment of Development Fees:
a. Park Dedication Fee: $5,500.
b. Stormwater and Drainage Trunk Fee: $5,250.00.
7. The City Clerk shall release the plat documents for filing only upon certification by the City
Attomey, Community Development Director and City Engineer that all requirements of the
platting regulations have been satisfied.
8. The aforesaid plat shall be filed by the City of Orono with Hennepin County on or before
February 27, 2019 together with a certified original copy of this resolution and executed
copies of the easements and covenants pertinent thereto.
