Box 66 Orono, MN 55356 Crystal Bay, MN 55323-0066 June 22, 2004 Countrywide Home Loans Attn: Janice (Fax): 952-431-3442 RE: 1780 Shadywood Road—Zoning Compliance To Whom It May Concern: The above referenced property is zoned LR — 1 C, One Family Lakeshore Residential District, requiring a minimum lot size of 0.50 acres and 100' of width at the shoreline and 75' setback. The property has an existing lot area of 0.266 acres and approximately 70' of width at the shoreline and approximately 69' of width at the 75' setback. Principal building setback requirements are 75' from the lake, 30' from the road and 10' on the interior sides as well as an average lakeshore setback between homes. The existing house does not meet the 10' north side yard setback requirement and the existing detached garage located at the road does not meet the required 10' north side yard setback or the 15' required road setback according to a 1999 survey on file at the City Offices. The lot is nonconforming in area at 0.266 acres when 0.5 acres is required. If the existing structure were destroyed, at minimum a variance to lot area and lot width would be required in order to rebuild on the site. Based on the history of lot area and lot width variances for teardowns/rebuilds it is likely that the City Council would grant a lot area and lot width variance, however setback, structural coverage and hardcover requirements must be met.
