Subject: Building Code Violation ?
Hi Ms. Mattson -
Melanie Curtis suggested I contact you in her absence -
>
Could you please advise me on the process one would undertake if a neighbor knowingly made alterations to
their property without city permits (ie; gas, electrical, plumbing, etc.) and/or has property fixtures that were
known by said neighbor to of out of compliance (ie; missing deck (above 30") railings, hot tub placement,
electric dog fence strung along top of inetal fence when should be buried underground, etc.) ?
Said property is currently up for sale (at least there's a For Sale sign out front.
Wouldn't any/all outstanding building code violations need to be corrected and brought into compliance
before sale ?
Also if said violations were a possible hazard (ie; non-compliant/never permitted gas hookup)to the
neighbor's property, how would said "violation" be addressed/rectified ?
Please advise -

Subject: Followup
Hi Mr. Oman -
I've tried, unsuccessfully,to reach both Ms. Mattson & Ms. Curtis in order to followup on a few "suspected
building code violations" on a neighboring property of Mr. Eric Wilson, 1780 Shadywood Road, Orono, MN
55391 (952) 472-1230.
I believe that is property is no longer on the "For Sale" market, but the suspected violations as previously
relayed to your office still remain.
From my perspective, all 3 constitute one form of safety hazard or another and therefore should be
investigated/corrected.
An on-site visit/inspection will quickly/clearly verify my observations as reported.
Also, on another similar/related matter- if it is suspected that a lakeshore homeowner(again neighboring
property of Mr. Eric Wilson, 1780 Shadywood Road) is allowing for a boat (not registered to that
homeowner/address)the to be stored at his dock site (for a rental fee or free) is this an allowed practice ?
If not, what City of Orono Municipal Ordinance number(s) might address/apply in this instance ?
If indeed there is a suspected violation of this type, to whom in the City of Orono is said violation reported to
for investigation, enforcement, resolution ?
Looking forward to hearing from you on next steps.

Hi Chris, What happened was when I got the complaint it was unclear of what all his issues were and I got the
feeling I would go out and we would send a letter and then he would come up with some more crap. So I
called and left him a message so we could discuss it. He never called me back and I meant to get out there but
it didn't happen before I left. My last day I dumped a bunch of stuff on you and that was one of them. I asked
you to have Willie do the inspection but I still think Willie should talk to him first. There is also the issue of an
addition to the deck the guy added in the average lakeshore setback shortly after he got a variance (or maybe
it was the previous owner). Anyway Bruce found it and ET was working on it but it got lost when they left. Its
all in the file. Good Luck!

Sorry to be bugging you while out on leave but in speaking with Chris in your office this morning, she thought
that you might be checking your e-mail periodically as opposed to voice mail and thus suggested I leave you a
note here.
Chris indicated that you were out for an on site review of reported "violations" at 1780 Shadywood Road
yesterday.
Were you able to view/find the code/safety issues I relayed in my previous e-mail ?
Are any/all said issues in need of correction ?

Hi Chris-
I've taken the liberty of attaching a few photos taken today (8/17/12)that clearly show that the ShoreStation
in question in not only within 5' of my lot line (to put it quite bluntly, Mr. Wilson is a liar as Judd Harper of the
LMCD can attest to in his recent dealings with Mr. Wilson) but as the photos clearly show, the one leg of the
ShoreStation is on my property (as my property extends to BOTH sides of the hedge).
The hedge IS NOT the official lot line as I intentionally planted them (7 years ago)well within my property so
as to have access on both sides.
Even if the hedge was the official lot line, the ShoreStation is obviously within th 5' side setback limit.
Again please reply with the date and time the City Inspector is scheduled to come out here for a site review (of
the reported violations of 1780 Shadywood Rd) as I would like to point out what I'm seeing to the Inspector so
as to save him some time and also assure that we've covering all of and the same violations I've forwarded to
your attention.
I show that my first contact with your office was back on July 26th (some 3 weeks ago now) and we have yet
to have an inspection of these matters.
What can we do to expedite this process ?
Most appreciated.

Dan,

The City has regulations regarding exterior storage of materials and debris (City Code 78-1577 ). However due
to the nature of our community as a lakeshore community we make allowances for the overwinter landward
storage of docks, etc. and do not have specified setback requirements. Boats must be stored at least 5'from
the property line; docks and the like materials should be stored entirely on the subject property. We don't
disallow the storage of docks and other lake access items (lifts, etc)... Typically this type of storage happens
during non-boating, winter months. We understand this property owner needed to move their dock to meet a
LMCD setback and apparently chose not to relocate the dock rather just removed it for the season.
I spoke with the owners of 1780 Shadywood Road. They stated their ShoreStation is located at least 5' off the
property line. Our City inspector will take a look when he performs a site inspection of the property regarding
the other complaints you reported.

Hi Chris-
I just wanted to followup with you on our phone conversation from earlier this afternoon regarding the
storage placement of the ShoreStation at 1780 Shadywood Rd (Mr. Eric Wilson residence).
Were you able to reach Mr. Wilson (or his wife Leslie) ?
Is he now aware of the fact that this location is not compliant to lot line setback rules ?
Did he make a committment to move it ?
To the location he's stored it over the last 3 winters ?
z
As I shared in our phone conversation, Mr. Wilson is due to leave the country next week for a two year work
assignment in the Middle East.
He has recently leased his home/property for that two year period.
My fear is that once Mr. Wilson leaves the counrty next week, the lessor will have no knowledge of, authority
to nor finances to pay for it's movement.
Just for my own understanding, could you also direct me to which Could you please call me at your earliest
