He spoke with your son and informed him of the requirement of a Building permit. A stop work order was posted. As of this date a permit has not been applied for. The previous owner of your home was granted a variance to hardcover limitations in 1997. More hardcover would require further variances and it is very doubtful that the City Council would approve more hardcover. Therefore The City must require you to remove the shed and any extra unapproved hardcover from the property. A deadline of October 6, 2003 has been established for removal, if this deadline is not met The City will initiate legal action. If you have any questions please feel free to contact me at my office. Wayzata, MN 55391 RE: Shed Dear Mr. O'Donoghue: In response to your letter of December 9, 2003, The City is not creating an issue. You created an issue by placing a storage shed on your property in violation of several city ordinances. In my 20 years of building and zoning code enforcement there has been few people try to call a shed a fish house so you may understand my speculation. However as we discussed during your visit to my office, a fish house can only be stored in a conforming location. In the rear yard 10' from property lines, So call it what you will, it is still a violation that must be corrected. Boat and trailer storage is also regulated and enforcement is on a complaint basis. This however is a building and must meet the code requirements of a building. If it has wheels then it becomes a trailer that has to meet other code requirements. Therefore The City must require you to remove the building from the property or apply for a Building permit to place it in a conforming location or if it has wheels, store it in a conforming location.
