Dear Mrs . Finkelstein:
In response to your request for information regarding the
buildability of your separated parcel , I have researched City
files and would make the following comments :
1. At the request of a previous owner of the property, the
City declared this lot unbuildable in 1974 and refunded the
City water assessment. In 1977, a new owner of the property
applied for a building permit, which ultimately was denied.
No activity has taken place since then other than removal of
the garage which previously existed on the property.
2. There are a number of additional factors besides the
"non-buildable declaration" which come into play regarding
buildability of this property:
a) To be buildable, the property must contain at least
0.40 acres of dry land above the 929.4' elevation, and
this acreage cannot include wetlands.
b) No filling can occur below the 931.5' flood plain
elevation for Lake Minnetonka. This property is
adjacent to a wetland that abuts Lake Minnetonka, and
therefore is unquestionably subject to such
regulation.
c) If you were ultimately granted approval to build on
the property, you would have to pay a water connection
charge of approximately $4,500.00. There might also be
some sewer connection charges, however the property was
apparently served with sewer and assessed in the 1960s.

d) Current tax valuation on the property totals
$1,500, with taxes being about $70.00/year. Land
valuations for non-lakeshore building lots in the
neighborhood appear to be $20,000-25,000. Clearly,
this parcel has not been taxed as buildable land.
Given the history of the property, I believe it is very
questionable whether the City would allow you to build on it.
Your initial step would be to have a topographic survey
completed. Such a survey should include 1' contour lines plus
contour lines for the 929.4' and 931.5' elevations, which are the
normal water level for Lake Minnetonka and flood plain elevation
respectively. Based on that survey, we could then determine
whether or not the dry buildable area (above the 929.4 elevation
and not wetland) is la.rge enough to meet the zoning district
requirements. If not, the next step would be to apply for a
variance. If no variance is needed, you would have to ask the
Council for re-instatement of buildability and water service.
One further consideration is that the property may have been
partially filled long ago and this could lead to foundation
concerns.
Again , I think there is a high probability that this
property would not be approved as a building site. However, if
you wish to pursue it, certainly the survey work noted above
would be the first step. I am enclosing documentation of past
City actions on this property for your review.

I have been confronted with a situation somewhat
unique. P'Is. Dalhaug has applied for a building
permit at the above site. The parcel meets the
zoning requirements. However, after checking
the records, we found this lot declared unbuildable _
by a court order. A previous owner, Wesley ��Jegen,
filed the petition and upon his request, Council waived
the assessment and refunded that portion �•�hich
he had paid to that date.
