We just wanted to update you on StoneBay ARC approval progress. The ARC members are reviewing the plans now.
The ARC is meeting with Tom Osfar and Bill Gleason Tuesday night and will vote that evening. Though this approval
doesn't include landscaping yet,the ARC is asking where they plan to put the tree that would have been between the
driveways and are they planning to continue to plant shrubs to create the hedge between the boulder wall and the
sideway(like the triple unit building to the north of this).
We will inform you of the results Wednesday morning.

Rose Anna—
We are reviewing the site layout for these two units and note that the original planning called for garage doors to the
outside of the units and service doors next to each other at the center. This left a gap between the parallel driveways
for a tree in the commons area.
The proposed plan (survey, 2"d page of attachment) places the garage doors adjacent to each other with the service
doors at the outer edge. Proposed is one shared driveway with no gap, hence no place for a tree.
On the attached section of the approved landscape plan, the area in orange is the proposed shared driveway. The
dashed lines outside of the orange show the boundaries of the original planned driveways,with a gap in between them

for a tree. I actually think the new proposed plan (orange) works better in terms of creating separation from the existing
neighborhood sidewalk and reducing the angle needed to enter and exit the original garage of the south unit.
The tree from the lost gap should probably be placed between the driveway and the neighborhood sidewalk. When
mature, this might overlap into the tree proposed on the south side of that sidewalk; this could result in an attractive
archway feel bordering the sidewalk.
Just wanted to let you and the ARC see the revision and how it might impact final landscaping. It seems that most of the
commons area boulevard trees planned for Sandstone Circle have yet to be planted, which makes sense as they would
make construction more difficult.

The plan set you submitted to the City on September 3 is dated 9/2/14. The plan set submitted to the StoneBay ARC is
dated 9/9/14. From what we can tell in a cursory review,there are a number of additions and deletions of information
between the two sets; i.e.the 9/9/14 set contains more information than the 9/2/14 set, but also there are details and
notations on the 9/2/14 set that apparently have been removed from the 9/9 set.
We will not start review of the plans until we know the ARC has approved a specific plan set,then we will expect you to
provide us copies of the final ARC-approved set.

I spoke to Adam and discussed the changes requested on the as built I'll have the surveyor make those corrections and
will send it back in.
As agreed to receive the escrows for 709 and 711 now, I will replace the sod damage from the plowing this winter to the
right of the sidewalk at the south side of 709 Sandstone Cir. when we install the sod on the next building.
When the funds for the outstanding escrows and reimbursements for the swale and curb replacement are ready for
disbursement I will bring in a check for the curb stop repair at 681 Sandstone Cir.

1. The overflow elevation is depicted as proposed. That proposed elevation should be removed from the
survey.
2. The driveway to the southeast is listed as "per plans". It should be depicted as existing.
3. The catch basin on Sandstone Circle is listed as approximate location. The actual location of the catch
basin should be shown along with the actual elevation. (Survey Requirement#9)

AGREEMENT made this o2�day o � , 201 , by and befinreen the CITY OF ORONO,
a Minnesota municipal corporation ("City") StoneBay Builders, LLC (" wners").
Recitals
1. A building permit application has been filed a building permit application for a Twin Home located
at 709 & 711 Sandstone Circle the ("Subject Property"), legally described as Lots 41 and 42, Block 1, Stonebay,
Hennepin County, Mlnnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2014-00996 � 2014-00998 if
compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when all requirements related to the project are complete. City Staff shall review the terms of this escrow
agreement two times per year to determine whether the requirements of the project have been successfully
completed and whether it is appropriate to return the funds. Owner may also request the release of the funds,
and such funds shall be released upon City Staff receiving the appropriate verification that all requirements of the
project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

AGREEMENT AND SWORN STATEMENT
The work for which this permit is issued shall be performed according to
the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances goveming this type of work
