Dear Ms. Wachman:
The City's ISTS (septic system) ordinance provides that a property in the shoreland zone with a
non-compliant septic system will not be issued a building permit until the septic system is
replaced. This is the reason the building permit for the pool was not issued. This does not mean
you have to wait until the septic system replacement deadline of 2010 to obtain a building permit
for the pool. It means you cannot receive a pool permit until the septic system is replaced. As
soon as the septic system is replaced, the pool permit can be issued. �
In the fall of 2006, you and I discussed the section of the ISTS ordinance related to the required
timelines for replacement of non-compliant septic systems. We discussed that your property was
mistakenly classified as being located in a non-shoreland zone. This resulted in a notification to
you that your non-compliant septic system would need to be replaced by 2010 vs. the 2007 date
for septic systems in the shoreland zone. I indicated to you that, although your property is in the
shoreland zone, because you were informed of a 2010 compliance date, your property would be
treated tinder this section of the ISTS ordinance as if it had a 2010 compliance date.
As indicated in the first paragraph above, the 2007 and 2010 compliance dates are not the only
septic system replacement triggers in the ISTS ordinance. The ordinance also provides that a
property in the shoreland zone with a non-compliant septic system will not be issued a building
permit until the septic system is replaced. Again, as soon as the septic system is replaced, the
pool permit can be issued.

Dear Evelyn Turner and Willie Gibbs
This follows our phone discussions regarding the out of code septic systems on
Salem Court, which are now subject to lakeshore regulations. Please keep in mind
the new regulations require the changes to septic 3 years earlier than we had been
informed for the last few years.(not 2010, but 2007).
To date only Wachmans and DeLucas are aware of the required changes.
There are several residents willing to examine the possibility of city septic;
The new people ( De Luca) at 2140 Salem which you indicated in your 8/2/06 letter,
Wachmans at 2135 Salem
The Hirschbergs at 2180 Salem
The Soderstroms at 2055 Salem
That is 4 out of the 7 residents. Possibly the residents at 2095 Salem: Paul
Beaganski and Katayoun Mohammad-Zadeh are also interested as their septic is
close to the wetland.
Kindly advise if the city would do a feasibility study. In addition it would be
appreciated if you are able to provide us with a contact resident from the recent
Jamestown Road septic project.

This folilows our phone discussion of Sept 29 2006.
Attached is a letter directed to 2135 Salem regarding lakeshore
regulations, from Evelyn Turner quoting Mr. Willie Gibbs dated
August 2, 2006.
Also attached is a letter in response to the city dated August 17,
2006.
In addition please see letter from Mr. Gibbs (dated 8-06) which was
recieved September 26, 2006.
Please clarify if we are subject to lakeshore/ shoreland regulations
around Dickey's Lake (Are the homes on Dickey Lake Drive?) and if
our septic update is due in December 2007, or 2010 as we have
been given 2 dates.
Several people living on Salem court are interested in city septic, I
have asked about the 25,000.00 per house fee and we are still
assuming that is the worst case estimate for sewer.
What will it take for us to be able to have a feasibility study? Are we
able to have a study prior to the cost estimate, is that possible?
