Dear Sirs,
This letter is simply to have the record reflect the fact that at no time ever in its existence
has there ever been a problem with the septic system operation at 2135 Sa1em Court. The
system has never failed. In 2006 the city advised us to ask for septic hook-up,and we
tried with no success. Sa1em Court remains a private street and that was a problem with
city septic.
In addition the septic on the property 2140 Sa1em Court had repeatedly failed. The home
sold in March 2007 to Robert Seuss after sellers installed a mound system as 2140 had a
repeated history of septic freezing and failure.
To clarify 2135 Salem Court has at no time ever has a septic problem,is unable to have
city hook up due to private road issues and has been ordered to re-do the septic system
and there is no location for a mound system.
We would like the record to reflect that we continue to desire a pool pernut and are trying
to work with the city for the most practical solution to the city septic non compliance
directive.

This letter is being written in reference to pool permit denial in 2006 at 2135 Salem
We were informed that no permit could be issued as our modified trench septic has not
been redone. In our telephone discussion October 30,2006 you indicated that the septic
deadline was 2010. Is the norm for a pool permit to redo septic system?Why are we
unable to install a pool until the septic deadline of 2010?
The pool permit was applied for by a licensed contractor last year.
We have been unable to enjoy our property and pool as planned. We have children and
the pool is a vital part of enjoyment in the summertime. T'he enjoyment of our property is
being hampered by the city.
We request that the city allow this permit and request your full review in writing stating
the reason for denial of pool pernut.Thank you for your consideration.

We have received an application for a pool permit from Performance Pool and Spa. The permit
cannot be issued because your property is subject to the shoreland regulations and has a non-
compliant septic system. A sta.te regulation does not allow any pernut to be issued until the
system is replaced.
In reviewing the permit we found that the notices you had received regarding the deadline for
replacement of the system were incorrect. The correct date is December 31, 2007. The earlier
date is because your property is subject to shoreland regulations.
Willie Gibbs, septic inspector, indicates it will probably be difficult to find a site for the new
system. You should consider requesting City sewer. The system n t door at 2140 has failed.
The new owner seems to be interested in City sewer. There may e others on the street who are

Scc.13.04 RIGHTS OF SUBJECTS OF DATA
Subd. 1. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section.
Subd.2. Information required to be given individuaf.An individual asked to supply private or confidential data conceming himselfshall be
informed of: (a)the purpose and intended use ofthe requested data within tlie collecting state agency,political subdivision,or statewide system;(b)
whether he may refuse or is legally required to supply the requested data;(c)any known consequence arising from his supplying or refusing to supply
private or confidential data;and(d)the identiry of other persons or entities authorized by state or federal law to receive the data.This requirement shall
not apply when an individual is asked to supply investigative data,pursuant to section 13.82,subdivision 5,to a law enforcement officer.
The commissioner of rovenue may place the notice required under this subdivision in the individual income tax or prop�rRy tax refund
instructions instead of on those forms.
Subd.3. Access to data by individual. Upon request to a responsible authority,an individual shall be informed whether he is the subjectof
stored data on individuals,and whether it is classified az public,private or confidential. Upon his further request,an individual who is the subject of
stored private or public data on individuals shall be shown the data without any charge to him and,if he desires,shall be i�formed ofthe content and
meaning of d�at data. After an individual has been shown the private data and informed of iu meaning,the data need not be disclosed to him for six
months thereatter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created. The
responsible authority shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authoriry
may require the requesting person to pay the actual cosu of making,certifying,and compiling the copies.
The responsible authoriry shall comply immediately,if possible,with any request made pursuant to this subdivision,or within tive days of
the date of the request,excluding Saturdays,Sundays and fegal holidays,if immediate compl iance is not possible. [f he cannot comply with the request
within that time,he shall so inform the individual,and may have an additional tive days within which to comply with the request,excluding Saturdays,
Sundays and legal holidays.
Subd.4.Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private data
concerning himself. To exercise this right,an individual shall notify in writing tlte responsible authority describing the nature ofthe disagreement.The
responsible authority shall within 30 days either: (a)correct the data found to be inaccurate or incomplete and attempt to notify past recipients of
inaccurete or incomplete data,including recipients named by the individual;or(b)notify the individual that he believes the data to be correct. Data in
dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the provisions of the administrative procedure act relating to
contested cases.
